I am part of GTL Prepaid Settlement. I received a check dated 10/27/2023 for the amount $15.95 . I could not cash the check for the reason it did separate from the postcard it was sent with. The perforated edges were stuck shut and without damaging the check it was impossible to sign reverse for redemption. I am highly disappointed and am sending back the check to Rust Consulting Inc.-7513, P.O.Box 2627, Faribault, MN 55021-9627. The check was issued from Huntington Bank. I need the check reissued and please send in a standard envelope so it does not again get stuck together and one cannot sign the reverse for redemption. It is being returned priority mail and hopefully this issue will be resolved quickly. I NEVER have seen this happen to a check before where it cannot be signed on the reverse or retrieved from the postcard along the perforated edges.Rust Consulting, Inc. Response

Received check dated December 2, 2022. Deposit on December 15th. Posted December 20, 2022. Deposit rejected for closed account. Fee assessed for "returned item." Did Rust really send me a bad check? The preponderance of complaints here would seem to indicate that is not outside the realm of possibility.Rust Consulting, Inc. Response

I am apart of the bimbo bakery settlement. I've been tryna get ahold of a Rust representative but everytime I call the phone just rings off the hook!! Funds were to be disbursed a month ago still nothing. I'm beginning to get worried. I've heard that this business intentionally withholds settlement checks and from the looks of it, this may very much be true. I was not given a website, number, nor correspondence after the fact. I returned all documents and was told to contact Rust by the departmentof Labor. Well it's my money and I need it now. I'll be reaching back out to the U.S. department of labor because this is Absurd. There is no way it should take this long to process our checks, it's been 8 months. LiterallyRust Consulting, Inc. Payments in this matter including the reviewers payment mailed on September 21, 2022. **** has record of two calls from the reviewer during which live agents responded to her questions about the timing of the distribution. This company is a sick joke. I had agreed to participate in a class action lawsuit against ***** ********** quite some time ago. I finally got a check for $21.27 while I was out of town working for several months. When I got home and went through my mail, I found the check and immediately deposited it via my phone. It almost immediately came back as no good, and I was charged a $12.00 return item fee by ***** **********! How insulting! So I checked the check closer, and noticed it had been issued on June 25th, and expired 60 days later on August 24th! Who in the heck does that? Most checks are good for at least 6 months. So when I tried to call them, and at least get the check reissued to cover the $12.00 return item cost, nobody answers the phone, and it is impossible to get through to anyone. So now I have participated in this class action lawsuit, and got screwed out of $12.00 by Rust Consultings ridiculous 60 day check cashing policy. In my opinion, there should be another class action lawsuit against Rust Consulting for their arrogant disbursement abuse of power.Rust Consulting, Inc. Response

This company sent me a settlement check related to UHC. I never agreed to be part of any lawsuit, so I do not plan on cashing this check. Based on others posts on the BBB, the check probably wouldn't clear anyways. I tried to call Rust Consulting for clarification, but their business number has been "Busy" several times in a row. Further leading me to not trust them. These frivolous lawsuits against corporate entities are only in place to enrich large law firms and do nothing for the people in the class. I will not associate myself with any class action suit for this and other moral and political reasons.Rust Consulting, Inc. Response

The review relates to the settlement of two class action lawsuits consolidated for settlement purposes: Doe ** ******************* No. 1:17-cv-4160 (E.D.N.Y.) and ***** ** United Healthcare Insurance, No. 1:21-cv-02791- (E.D.N.Y.). Rust appreciates the opportunity to clarify the following points:The check the reviewer received is valid and can be cashed or deposited. The funds will remain available until the stale date printed on the check.Notice of the settlement was sent to the reviewer last year and included instructions on how to opt out of the settlement for potential class members who did not want to participate and did not want to receive a payment. As per the terms of the settlement agreement, funds left over from uncashed checks will be redistributed as additional payments to those who do cash their checks. Any remaining funds after that will be remitted to the Office of the New York State Comptroller.Rust is not a party to the lawsuits or to the settlement. Awful company. They are in charge of a class action lawsuit and are making the claims so much more complicated and convoluted than it should be, just for me to claim my few hundred dollars. I provided them everything they said I needed to, and they are still saying my documentation is unacceptable. Avoid them if possible.Rust Consulting, Inc. Response

Rust does not typically design or decide upon the claims process, but administers it based on each individual settlements terms as agreed upon by the parties. If the reviewer contacts us using the settlement-specific contact information provided for that case, we can discuss the details of the claim and any potential deficiencies.Customer Response

I provided all correct and required documents for the claim but Rust has been deemed it "unacceptable". Your company is denying I provided the documents and I believe that you are doing this maliciously. Again, if you are thinking of working with Rust, avoid them for a more ethical company.Review from DL

Case No. 17-cv-06220-BLF Kang Vs Wells Fargo When calling in to Rust Consulting you receive various conflicting information. One person states that they don’t have approval, I explain to them its on their website and that Final settlement approval was 12/08/21. Next time you call the person states you will receive your monies within 30 days. Next time you call they say they are waiting on a payment date from the court. If you read the final settlement agreement it does not state ANYWHERE that rust consulting has to wait for a payment date from the court. I don’t understand why they have this number for class members to call for information when the persons answering the calls do not know or understand the case. It would be nice to get a definitive answer from the Settlement administrator since it has been 6 weeks since approval and all law documentation referring to class settlements state that class members should be paid with 6 weeks no longer than 60 days. Order from court 12/08/2021 IV. ORDER (1) Plaintiffs’ motion for final approval of the class action settlement is GRANTED. (2) Rust Consulting, Inc. is appointed as the Settlement Administrator and awarded its fees and expenses not to exceed $80,000. (3) Plaintiffs James Kang and Michael Moses are awarded $10,000 each for their services to the Class and Subclasses and their effort in pursuing this litigation. (4) Plaintiffs’ motion for attorneys’ fees and expenses is GRANTED IN PART AND DENIED IN PART. Plaintiffs are awarded attorneys’ fees in the amount of $21,053,146.92 and litigation expenses in the amount of $99,568.96. (5) Mr. *****’s objection to the class action settlement and Plaintiffs’ request for attorneys’ fees is OVERRULED. (6) In recognition of Mr. *****’s contribution to the Court’s evaluation of Plaintiffs’ motions, he may file a motion for an award of attorneys’ fees and expenses, supported by appropriate legal authority, within 14 days after the date of this order. Any award of attorneys’ fees and expenses will be limited to those incurred in presenting arguments on which Mr. ***** was successful. The following page limits are imposed: 5 pages for Mr. *****’s motion, should he file one; 5 pages total for any opposition, those pages to be shared by Plaintiffs and Defendant; and 3 pages for any reply. (7) Entry of judgment will be deferred pending resolution of Mr. *****’s motion for attorneys’ fees and expenses, if any. (8) No later than 21 days after the void date for individual settlement payments to Settlement Class Members, Plaintiffs shall file a Post-Distribution Accounting in accordance with the United States District Court for the Northern District of California’s class action guidelines.Rust Consulting, Inc. The review relates to the settlement of ********************** Fargo, No. 17-cv-06220 (N.D. Cal.). Rust specializes in the administration of class action settlements and similar programs involving notification, contact centers, claims processing, and fund distribution. Rust is a neutral third-party administrator and was engaged to carry out certain administrative aspects of ********************** Fargo as established by the parties and to answer class members questions. The settlement received an objection prior to final approval; while the objection was overruled and final approval granted, the objector has the right to appeal and the Court has not yet entered a final judgment directing Rust to distribute settlement funds to class members. The objection and the process of resolving it have impacted the previously projected timeline for distribution and we understand the complainants frustration with this. Rust is required to adhere to the terms of our client agreements and the orders of the Court and will distribute settlement funds as soon as we are approved to do so. Any updates regarding the settlement, including the timing for distribution, will be posted to www.kangvwellsfargosettlement.com.The complainant has previously communicated with Rust about this issue through a different online platform and we reached out directly to provide this same information.
