In Aug 2021 2 representatives knocked to my door and said that the business can fix the hail damage to my house, provide 5-year warranty and prepare the formal documents for signatures. Looking at the business performance, I gave a referral of the business to 2 my neighbours. The business associate told me that they could not promise any reference money, but instead they would provide me with $***** discount. On Oct 27, 2021 the business reported to my insurance company that the work was completed being aware that the work was not completed and there was a punch list of items awaiting completion. On Nov 25, 2021 the business and I signed a copy of their email that the work would be taken care in next couple of days. The work has never been started. On Dec 6, 2021 I received extremely abusive email from the business. At the end it stated that: 1) the business was dealing with less than honest person; 2) to avoid the lien on the property, I had to pay the business the amount of $******** including the $***** discount guaranteed for the referrals and 3) the business will no longer work in good faith.Majority of the business emails to me were in emphatically disrespectful form. The business was rude to my insurance company too. Email dated Oct 27, 2021 is an example: well be in touch with you or your bosses whoever has the basic understanding of mathematics and some common sense. I am not sure if you are familiar with it I do not appreciate you ******** from us.As the work has not been moving, since Feb 3, 2022 I made 3 attempts to meet with the business management. All the attempts werent taken seriously. In order to resolve the issues, I would like the business to provide:1.Native copy of the Contract for review and negotiation 2.Complete the work after signing the Contract 3.Written apology for the groundless abusive email Dec 6, 2021 4.A document that the lien has NOT been placed or lifted 5.Certificate of Completion of the Work and Payment

It is an ongoing process. ****, one of our clients, has not paid us the amount he owed us for the work completed. Seems like he wants to get away with it by making up false statements. He wants us not to charge him deductible and the remaining amount. ***************** did not pay it and wants the homeowner to pay it. He is making up false accusations. He emailed us not to come to his property or he will call the ******. If he does not make the payment, we will be going through the legal route. We have a ton of clients that we did the repairs for and never had any issues. If you have any further questions, feel free to email or call our office ************

      Thank you.

      Complaint: ********

I am rejecting this response because:

      The businessresponse is not satisfactory.
The business demonstrates their disdainful attitude to me by calling me ****. This snippet of a word is not my name.
My insurance has paid the business for all complete work. The business has not completed the work, has not provided a guarantee of materials and a workmanship quality and a warrantee, as was initially mutually agreed. I put on hold the remaining amount of $****** until all of the above issues are resolved. The resolution is action by the business. The total costs of the above is higher than $****** so currently I do not owe the business anything. Nevertheless, I guarantee that my insurance will pay the business $****** upon resolution.
Seems like the business tried to get a double remaining payment asking me to pay $****** from my account making a false statement in their email dated Nov 25, ************************************************************************** fact, the insurance refused to issue a check in my name.
Ive never asked the business not to charge deductible because its *******. Moreover, the business themselves informed me that they would give me a discount in the amount of deductible for the referrals I provided to my neighbors.
The business purposely redirected the east wall downspout, not included in their scope, towards my neighbor property, which is *******. After that I warned the business if they come to my property without appointment, I would call ******.
Summing up, I would like to remind the business that I am open for the discussion and resolution of all issues upon completion of the work and by signing the agreement.Threatening me by going the legal route does not work because I have enough written documents and photos to prove my case. I hope that common sense will win and the business will move from threats to constructive dialog with mutual respect.

      Sincerely,

      ***************************

      1. The original contract is with the homeowner as we only have a copy. The contract was signed at the homeowner's house. We have proof of it.
      2. The contract was already signed. The homeowner met our associate at one of the *** ******* in his community and told our associate he will be emailing us the things he did not like the way they were done. The homeowner has emailed us about a few minor issues he has and would like us to look into them. We can look into this work once we. get paid for the previous work we have completed. The email can be provided as proof.
      3. There will not be any apology from our associate as the homeowner was never abused. We had just stated facts. However, the homeowner needs to apologize to our associate for ********* them at his property when they went there to pick up the final payment. And blaming the pre-existing damages on sub-contractors.
      4. A lien has not been placed yet by us.
      5. A certificate of completion and payment will be issued after the payment of the final invoice.

I hope this helps. The homeowner can hold back $*** for the work he wants re-done. Each subcontractor who has worked on this property has gone back because the homeowner wanted things done differently. We never charged him for the re-visits.

      Complaint: ********

I am rejecting this response because:

      1. The contract has never ever been provided to me by the business. The business cannot provide signed copy because it does not exist. *** ******** ******* ** * ******* ***** ** ****** **** ** **** ** ******

      2. I've provided the business with the pictures of discrepancies. Until these discrepancies are addressed the work can not be considered as completed and the final payment is still on hold.

      3. I was ***** in writing and I've provided BBB with the proving email. I've not ******** any associates of the business. This is simply not true. As for pre-existing damages, both the business and the subcontractor agreed in writing that the damages were done by the siding subcontractor during installation of the siding using very hard hammer. After the damage was reported the business directed the subcontractor to change the hammer to the nailer and no more damages were done.

      4. Final invoice will be paid upon completion of the work and addressing warranty issues which have come over after less than one year since "the repair" completion. The business has been provided with the picture.

      5. The business charged the insurance company for $****** for the fence painting. This scope of work has not been ever touched by the business. This is another ***** which is easy to prove.

      6. Each subcontractor who worked on my property has gone because they have been paid by the business without any inspection from the business side and as such, considered their work as completed.

The homeowner is still encouraging the business to cooperation and is open for any discussion.

      Sincerely,

      ***************************

The paint was scheduled for spring 2022. However, there was a dispute with the previous payment and we had to stop the work.  We have not invoiced insurance for paint. However, it was part of the estimate.
