On May ** 2023, I was driving on ************ Northbound at approximately *****, a truck from LenBeth Weeping Tile had an unsecured load of rocks and a rock had hit my windshield. The driver did not have a visible license plate, I do have pictures of the vehicle as well. Once I had reached my destination I had contacted the company and they asked for me to send pictures of the damages along with pictures of the driver that I had. I was in contact with ************************************* and she agreed through email their driver was at fault and did not have their load secured. They had agreed to pay for the damages, since my vehicle is a leased car I have signed an agreement with Audi that if I do replace the windshield it must be an OEM windshield and not an aftermarket one (I did get an email from Audi and sent it to Lenbeth). They are now refusing to pay for the windshield and have stopped all communications. I do have email proof and photos from LenBeth that they are at fault.Business response

Good Afternoon,
We had been in discussion with the individual that had submitted the complaint. We had offered to pay for half the windshield even though there is no verifiable way to demonstrate that the damage was done by our vehicle. The vehicles were travelling on a high speed road way and the rock could have come from the road, a tire, a vehicle travelling close? The individual that sent the complaint provided pictures, but the pictures were just of our vehicle with the load covered with a tarp which is required by law. There was some mud on the bumper but that simply cannot have caused the damage to the windshield.
When evaluating this incident, we considered the following;
1. Witnesses to the incident, where there are none
2. Discussion with our driver, they confirmed that the load was covered at the time
3. Review of the pictures, which showed that that the load was covered at the time
4. Where the incident took place, on a high speed Provincially maintained road way
We had provided the offer to pay for a new windshield through a professional glass installation company in Calgary, but they wanted an *** from the manufacturer/dealer at double the cost. We further offered to pay for half of the *** windshield. We feel this was a fair and adequate solution as again, our load was covered and there were no witness to the incident to verify that the rock came off the back of our truck. We have not 'refused' to pay, we simply asked for them to provide an address where we could provide a cheque and they stated that was not acceptable and would not provide an address. You can read the email respond that I provided offering this solution, they have included it in their documents.
