      I contacted *********************** (Bedrock Contracting Canada) to develop an external entrance and a legal suite basement located at ************************************************. We agreed and signed a contract on May *** that it will take * months to complete the project. I made initial payment of $****** CAD which I transferred separately via email transfer on ***, *** and **** May with the agreement that more money will be released as job progress, but no meaningful progress was made. He managed to build a retaining wall and ended up making a mistake. He called me and explained that he was sorry that he would demolish the wall and rebuild it. Another payment of $****, $*** and $****** were made in August. A total of $******* has been given to him. Since May ***, no aspects of the jobs done so far have been successfully completed. Below is a list of the incomplete jobs with pictures attached. 1.***************** has not been properly framed and sealed 2.Basement framing is not complete 3.The retaining walls were not straight and stairs were poorly done. The wood and steel bolt used for forming stairs is still sticking out of the retaining walls.4.Furnace is still incomplete 5.The window has not been framed properly from inside. On August ****, I sent him a message and also called him but he did not reply or call me back. I also messaged him on August **** to remind me that our contract would expire on September *** but he did not reply. I believe he has abandoned this project. Winter season is fast approaching and my basement is still not properly sealed from cold weather, especially the foundation. My backyard landscape was damaged during this construction and no attempt has been made to repair it. My deck rails were removed and still have not been installed. In summary, Bedrock Contracting Canada was so unprofessional regarding workplace safety; the quality of the incomplete jobs listed above is a serious safety hazard, below standard and poorly finished.

      he is owing $********* and is finding every loop hole to bail out of his responsibility.

      will i be abandoning a job that i am owed so much money? its crazy for him to think that

      Earlier this year, I decided to develop the basement at my residence, having gotten development permit for a legal basement suite from the City. I signed a contract with *********************** (Bedrock Contracting Canada) on **** May for the project, with an agreement to complete the work in * months.To facilitate this work, I disbursed funds to ************** with an initial cheque of $******, which he cashed on May ****, 2023, followed by two additional payments of $***** each made on June **** and July ***, 2023, respectively. With very little work delivered on the project, I pursed sending additional funds, with $16,000 already sent to **************, with very little progress made. Each time I requested for update on work on my property, it proved always a challenge getting any plans or commitment from him, and in some cases, he just would not respond to my inquiries, or even when he does, it ends up being false. An additional $***** was also sent on August ****, bringing to a total all monies disbursed to $******.When I raised these issues with him sometime in July, he pleaded with me to give him some time to rebuild the trust I had in him, assuring me that progress would be made before Fall/Winter. This has proven not to be the case. Right now, work on my property is in a very terrible state and is currently having an impact on my residence and heating in the main house. When I stopped hearing from him for over a week since he promised to continue the project, I sent him an email on 5th September about the situation of things with the haphazard and poor-quality work on my residence, and its impact on my family's health and safety. Till date, he has not responded to my email or taken any action to address my concerns. With Winter approaching, there is significant risk of damage to my property if urgent action is not taken to fix the mess at the location. Also note that the work done so far with respect to the project significantly falls short of the money collected so far.

      Yes, the complainant is right that we signed a contract to for his secondary suite development with a basement exterior entrance. the specific of the contract says a deposit of $********* was agreed upon and yes, he gave me a cheque of $*********. This money was paid toward the commencement of the job and on the same day he gave me that cheques i told him the deposit has to be paid before work starts. he asked to accommodate him and will make good on it. after the first stage of work, which was digging to the foundation, i told him again that I will need money to have guys on site to do framing and further digging is required as well. he never paid attention to it. i have committed to subcontractors and need them paid, I therefore requested from him again and that is when he sent $**** by etransfer. I again made clear to him that we don't work this way as the whole deposit has to be paid so i can schedule my subcontractors effectively. I explained to him on the first day that the way we work with deposits is to prepay subcontractors so they could buy materials asap since the price of items changes very quickly. Up till now, * months later he has not paid the full deposit. $******* is still outstanding. The amount of work done with labor and materials cost is over $********* which I have partly funded. He wants the job done at a lightning speed but pay when he wants to, how he wants to. I cannot continue to bring subcontractors on site and pay them with the hope of him paying his deposit.

      When we started this project, he had the ****** to Cancel signed, and hence have every right to cancel the project if he had concerns with my work ethics as he claims. I spoke to him about my full intention to complete his project, But he has breached our contract by not meeting to his side of the agreement/

      I am rejecting this response because: The response is false. Since the start of this project, I have exceeded the terms of the contract. As can be seen from the attached contract document and communications with him, at no point did what he claimed occur.
      Page 3 of the contract states that payment schedule based on work progress,which I did until I noticed that funds sent was not being used for my work. No agreement was made that full deposit of $*** *** had to be made prior to start of work.
      The claim that my job has not been completed because I refused to pay the full deposit is also false, as can be seen from conversations with him up to this morning.
      The claim that the amount of work done with labour and materials cost is over $********* is also false, as work done is way below the $****** I already paid.I have pictures of work done, and I am open to having an independent assessment of work done to ascertain the true value. This is a step I will take if deemed necessary. The contractor may also provide receipts for work done, to support his claim.
      Of the tasks stated in phase 1 of the contract, not one has been completed,yet he claims to have spent over $******.
            1. Framing, furnace and permits. Digging, entrance framed - S *********
      He visited my site last week and apologized for his actions, pleading to resume work this week. He has not honoured that promise and instead has decided to respond to this claim with false information.
      To reiterate, work on my property is in dire straits and require urgent attention to prevent further damage during winter/snow.
      1. Basement door is not properly sealed/finished, impacting the heating in my house
      2. Incomplete basement stairs and canopy
      3. Damage to lawn/property is not fixed
      4. Faulty drainage installed for basement stairs allows water leaks into my basement
      Documents I have in support of this claim is over 2GB in size. Is there a way to send this?

      obviously, the complainant has not understood the specifics of the breakdown of pay schedule. The first payment was $*********. Upon signing .After completion of some stages the next payment follows after the first $*********. A prepaid amount of $********* first before anything done on the premises. its never a portion of payments of the first $*********. Every subtrade i send to the job will demand payment. This why I ask for a deposit.

      Yes I was there and pleaded with you about completing your job but that does not change the fact that the previous agreement has been breached. I cannot continue to work on the premises when a dispute is in process. I am offering my services as professional and committed to delivering. That is my responsibility but not admission of quilt in any shape or form. I was working to resolve our issues. I work to calm you down and make you understand. Thats what I have to do as a business owner who deals with clients, 

      In my subsequent text to you, i ask that we rewrite a new contract and ask you to even draft it and will go through it and see what works for both of us and then move on. You never responded to that. so what do you want at this point.

      Work has been done on your property and hence money spent which cannot change. There is no refund here to you sir. **** put a stop to the back and forth. Do you want to rewrite a new contract and we move forward or you do not want me to undertake your project any longer. that's what matters now.

      I am rejecting this response because: I wish to state that the response provided by the contractor is blatantly false; from claims work at my site has cost over $*** *** *with no evidence provided), to claims I breached the terms of the contract. As stated in my response, at no time did I breach the terms of the contract, which I already sent in my last response. In my response, I asked that he provide proof of work he claims has been done that cost him over $******, unfortunately he has chosen not to provide this. As stated before, I have over *GB of information that shows exactly what has transpired between me and him from before the inception of the project, until now. This can be provided if required to address this claim. Also, if it becomes necessary to perform an independent evaluation of the work done on my site to ascertain the true nature, quality, and cost, I wouldn't hesitate to do that. In my original complaint I requested that:
      Desired Resolution:
      Finish the job; Refund; If the contractor is not willing to continue/complete the job as agreed, he should indicate that, and refund money collected, and damages done to my yard immediately. This will allow me to engage someone else to see if critical aspects of the job can be completed before winter/snow.

      When he contacted me this week regarding the complaint, I responded that if he intends to focus on and complete my work on time, he should respond to the claim stating that. He has instead decided to use false information and lies to justify his actions. As I already informed him, if by the end of this week there is no work being done on my site, I will utilize additional options available to me to pursue this matter and recover money paid to him. I wish to remind him that making such statements as "There is no refund to you sir" does not truly make it so. It is left for him to decide how he responds next or what action he chooses to take.
