We serviced ALLCAN Exterior with a CANCELATION NOTICE both in writing (Registered mail couriered on May 23rd, 2022) and verbally as of May 23rd, 2022, as per the contract terms and condition dated signed on November 24th, 2021.As per contract term, if the client does not receive the services within 30 days of the date stated on the contract (Jan March 2022) we have the right to cancel the contract.Continuing with the cancelation term, the Seller, in this case ALLCAN Exteriors, has fifteen (15) days to refund our money.Also, as per Additional Terms and Conditions ******** herein, and added to the signed contract, each party had agreed to indemnify and hold harmless the other party for any claims and losses, damages, liabilities, penalties, punitive damages, expenses, reasonable legal fees and Costs of Any Kind or amount Whatsoever from or arise out of any omission of the indemnifying party in connection with this agreement.No services as per contract signed had been rendered to the customer signing the letter, in this case, therefore, we are requesting the total amount issued as Deposit to be returned.The contractor is now arguing that we owe them consequential damages for their time and efforts to get the quote and details required by insurance to complete our claim. This was never disclosed or included on the terms and condition of the contract executed (Copy ********).
