Premium Built Structures Response

We appreciate the opportunity to disagree with the validity of this review and to offer information from our own perspective. In our opinion, there are two sides to every story, and sometimes the customer is not always right.
I am offering a lot of information regarding this situation but a negative review with the Better Business Bureau is something we take very seriously. We have completed several hundred project builds in the previous 8 years of operation as Premium Built Structures. We specialize in the construction of Post Frame Buildings throughout Alberta, and our name remains untarnished in our industry. We are very proud of the great reputation that we have built during this time and the hundreds of happy customers that we have worked for. We have no negative comments, reviews, or info about our company on the internet and we would like to make sure that this is not the first.
Over the previous 10 weeks we have gone through a very stressful building experience with a customer, R****** C***. When his project was completed, he used deceitful tactics to try and hold back a large portion of monies owed despite there being no credible reason to do so. On advice from our lawyer, we then moved ahead with the process of placing a lien on his completed project to enforce the payment of funds owing on the initial contract that was signed before commencement of the project.
On November 3, 2021, Premium Built Structures received notification from R****** C***, upon completion of his project, that he would be holding back funds in the amount of $23, 410.84.
On December 1, 2021, a lien was filed against the said property.
On December 9, 2021, Premium Built Structures lawyer received correspondence from the Lawyer representing R****** C***. Please see the information below:
My client has presented three options:
1. My thoughts are they can have the $13,000 now that’s the septic and flashing J Trim, but the additional $6,000 would be held with you until the windows and door have been changed as per the contract and they pay for the re-inspection $3,000.
2. I will pay them $18,000 now that’s my numbers - $1000 which will be held with you until the windows are repaired, yes they lose the $3,000 for the inspection, but the door I will change at my cost.
3. We send the money to court and we have our day in front of the judge and he will decide, I have chatted to my three witnesses and all have agreed to represent me and provide statements.
It looks like it mostly comes down to the $3,000 which seems like a relatively small amount to argue over but if they are both dug in then we may have to just pay the entire amount into trust. Let me know your thoughts, I can have a call this afternoon if it helps.

On December 9, 2021, Premium Built Structures offered the following in response to the 3 options presented by R***** C***:
Good morning ***,
I’ve spoken with my 3 partners, and we were split on whether to let this go to litigation or not but what we have decided is we will discount the final invoice by the $3000 that R****** is adamant on. As for the windows, I have attached a screen shot of the last email correspondence I had with *** at **** ***** ******** ******** on December 2nd pertaining to R******’s windows showing the case/claim #. It will be R******’s responsibility moving forward to deal with *** ****** at **** ***** and *** ****** at **** *****, to finish up this warranty claim. Premium will no longer be the in between and there will be no $1000 holdback on the windows.
I have attached an updated copy of our final invoice now reflecting this $3000 credit. This will be our last and only compromise to settle this matter without having to involve the courts. If R****** and *** agree, we will have you remove the property lien immediately upon final payment being made and all involved can put this unfortunate situation behind us and move on. If they choose not to accept this offer, then we would like you to take the next steps in moving forward with litigation and we let the court system decide the outcome.

On December 13, 2021, we received the following response from the lawyer representing R****** C***.
*****, my client has instructed me to pay the $20,260.84 amount offered in the attachment to the below email.
I assume the preference will be for me to pay it to your office under conditions that the lien registration is pulled or discharged? To expedite I would like to directly deposit the funds so please confirm if this is possible and provide your trust account details. I can have it done asap.

On December 13, 2021, we received correspondence from the Better Business Bureau that a negative review was made by R****** C*** regarding our business.
As an owner of this business, I have always been dedicated to offering above average customer service, no matter the situation. Like any industry, mistakes can be made on projects, but myself and my team always pride ourselves on the way we handle those situations and come up with an agreeable solution. It is quite often the solutions to a problem and the way we treat our customers through the process that highlight our customer service dedication. We are very aware of this and make it a priority to always do so.
In over 15 years of contracting services and 8 years of specializing in the Post Frame Industry, we have never had a run in with a customer like R****** C***. We were yelled at, berated and threatened on many occasions, yet throughout the process we never reciprocated and always stayed professional. In our humble opinion R****** C*** was trying to cheat the system and use false information to avoid paying his outstanding bill. We felt truly wronged in the situation and believed it was unfair for R****** C*** to use his own discretion without any outside oversight, to decide what he felt was owing on his project.
In 15 years of contracting, we have never placed a lien on a customer’s property. In this situation, with a customer that was so unruly and difficult to deal with, we felt that the only way to mitigate the situation was to have outside oversight offer their opinions and suggestions. It was based on these opinions and suggestions that we ended up with the final outcome and the amount being paid to Premium Built Structures for its services.
R****** has now decided that his final course of action is to write a review, with false information, that can negatively impact a business that truly goes out of its way to treat its customers with respect and fairness. I feel that R****** has only written this review out of spite, due to agreeing to pay a bill that his own lawyer suggested Premium Built Structures was legally entitled to. I don’t feel that an honest review can be written about our business from a customer such as R****** C*** that should be presented to the general public. If so, then in fairness, the alternate side to his version of events should be made available as well.
We are just today completing a very similar project with all of the same build challenges and time constraints that were presented on R****** C***s project. This customer phoned us on Friday, December 10 to offer a glowing review of the crew on site, the building quality, and the way we have handled the logistics throughout. I am sure if contacted, this customer would be very happy to right a review that would show a stark contrast to the false information that has been presented by R***** C***. In some situations, the customers own negative personality and unreal expectations becomes the problem and the hindrance to their own project. In the case of R***** C***s build, we truly do feel this was the case.
I am all for the review process and the rights that customers have to offer up their opinions to others on potential businesses. But I do think that the human personality can sometimes make the review process an unfair one for some businesses undeserving of the negative criticism. I would guess that is why a program like The Better Business Bureau, which is a trusted resource for so many consumers, offers a business the opportunity to disagree with a potential negative review. It is a great that you offer this to business, and we truly appreciate the opportunity to offer our perspective on the situation.
We hope this information helps in making the decision to not put the negative opinion of R****** C*** ahead of the great reputation that we have worked so hard to build.
