AGRRED WORK TO BE DONE AND QUOTES ON 23RD MAY 2021 DATE OF TRANSACTIONS - DEPOSIT PAID - 23TH MAY 2021 - PAID $2000 24TH MAY 2021 PAID $2000 25TH MAY 2021 PAID $1000 TOTAL PAID - 5000.00 THE BUSSINESS - MR EUGENE - HAD AGREED FOR WORK TO BE DONE AT OUR PROPERTY - *** ***** ******** ***** ********* - AT TOTAL $10,000 WE HAD AGREED ON PAVING THE SIDES OF OUR PROPERTY AND OUR DRIVEWAY WITH ASHPHALT. FULL REMOVAL OF ALL DEBRIES AND STONES AND MAKE THE AREA READY FOR PAVING. MAKE SIDE AREA STEPS AND COVER IT WITH ASHPHALT. THE COMPANY CAME AND STARTED THE WORK. AROUND JUNE 2ND THEY CLEARED ABIT OF THE ROOTS AND WEEDS AROUND. THEY MOVED STONES AND THAT WAS IT. FROM JUNE 4TH, EUGENE STARTED TAKING US IN CIRCLES. NONE OF HIS STAFF WOULD COME AND DO ANY WORK. HE HAD SO MANY ESCUSES SUCH AS BROKEN DOWN VEHICLE AND KEPT ON PROMISING US THAT HE WILL BE COMING. HE NEVER SHOWED UP. HE CAME AND GAVE ME A CHEQUE AND SIAD IF HE DOESNT START AND FINISH THE WORL WE SHOULD BANK IT. HE DIDNT SHOW UP. WE BANKED IT AND IT CAME BACK UN PAID. HE THAN AGREED TO THEN PAY OUR DEPOSIT BACK IN FULL HE HAS PAID $2500. BUT A BALANCE OF $2500 IS STILL PENDING ALSO HIS STAFF CUT A PLUM TREE WHICH WE HAD SPECIFICALY INSTRUCTED NOT TO CUT - HE HAD PROMISED TO REPLACE IT . HE DOESNT PICK OUR PHONES OR ANSWER OUR MESSAGES PLEASE HELP US GET THIS MATTER SORTED. AS WE ARE OUT OF POCKET AND WE WANT OUR MONEY BACK AS PROMISEDBusiness response

Good day. I want to acknowledge that this project was long and painful. Being a new company, it was a learning project. That’s why I had agreed with the customer to pay him back. But I need to say that the gentleman makes it sound like we didn’t do nothing. I have to say that we removed 2 loads of junk and garbage (that wasn’t part of the project), 3 crews for a total of 6 workers went there to work and 3 of those employees (totalling more than 40 hours) didn’t want to go back because it was to hard and hazardous, it wax very steep. I tried to pull a miracle but I was t able. Even tried to sub it out to other companies that I work with and no one wanted to. Now the company shot down. I started this business mainly for my sons. , and they didn’t step up to the plate. I lost everything for this company. My wife and I worked extremely hard with a sad end result. We were doing good but got to hard and labour was a big issue. For all those reasons , I have decided to to close. I don’t want any issues, I might be able to personally give some money back but he has to be fare because like mentioned above I have payed more than $1500.00 in labour plus disposal of garbage (literally garbage, broken glasses and more) I also have pictures of before and after to show what was done. So please help resolve this, because I actually lost money here and I had 2 partners that went ghost on me. Through this ordeal, I got sick, dealth with broken equipment and rented a trailer to dispose of all this) I also want to say that the gentleman was very nice and supporting through my hardship even if he called numerous, numerous time and was adding to my stess. MY ANSWER - - - When we met first and you came to assess the work needed to be done. You measured and we spoke about the scope of work and all was agreed and a deposit was sent to you and you started work. Shortly then you stopped and only came one or 2 days a week. You had assessed the scope of work, steepness, hazards and how hard the work will be. And you agreed to do all the work. I also got 2 neighbours to give you some work to. We spoke to many of the neighbours who where willing to give you so much work. You kept us in the dark for very long and not explaining to us that you can not complete the work. Several excuses of you not being around and staff not coming and broken-down vehicles. You should have come clean and told us that you could not complete this work as agreed and we would have come to a solution together .

MY ANSWER --We to do not want any issues. But we have gone trough alot . Yes you did do some work, but the area was left in away that we had to get it done it has costed us more than what we planed with your initial quote. We lost more than 2 months in rent of our basement as you had promised to finish the work in less than a month, however it took more than 4 months to realise that you are not going to be doing the work .

MY ANSWER - - yes we have been very nice and patient with you. But we needed answers and we had to call you and you never picked or replied messages.
You had given us a cheque of $ 3500.00 for loss of rent and that came back unpaid? Your staff uprooted a plum tree. You have promised to replace it. How do you propose to clear this???OUR PROPOSAL - - Now as per your proposal we are still going to be fair, but we need an immediate response. The balance owing us is $2500. We are going to agree an amount of $1500 for the balance of our deposit to be paid back to us immediately. Let us know regarding the plum tree and loss of rent mentioned above – how will you settle this?
