Adanac Roofing & Gutters replaced shingle roof on my house according to the contract signed on June 12, 2015. The contract work is backed by ******* **** * star warranty and Adanac Roofing 10 years workmanship guarantee. The contract included remove and replace chimney flushing. Chimney flushing was installed with very low quality that caused a leak. I contacted Adanac with request to fix the chimney flushing, stop leak and repair damage caused by the leak. However the Adanac owner Dan M*** refused to fulfill contractual obligations regarding warranty. Claiming that it is counter flushing leaking and Adanac didn't work on counter flushing and providing no proof. I had to inspect the roof. Inspection showed the main issues with the chimney flushing that causing the leak are with the chimney flushing that Adanac has installed: 1. Corners of apron flashing must be soldered or sealed with roof cement, but they are not. Pictures corner1 - corner4 are clear showing that 2. There are holes between the side flushing pan and roof. We have a long history of providing excellent service and workmanship. We stand behind our work.
As per our agreement, we only replace the step flashing ,back pan and the wall flashing at the roof level around the chimney. The flashing in the rock chimney is called counter flashing.
We told you when we did the roof you need to get a masonry to come and re point and replace the flashing the counter flashing that is cemented in the chimney. Remember you had Kurt at the end of the project you had him come back and paint it for you and he told you then as well.
When you called about a leak we send out a man to make sure it wasn’t leaking at the roof level and again you were instructed to get a masonry there to repair your chimney.
Your chimney and that counter flashing is probably 60 years old. It would be the original counter flashing and chimney when the house was built and has deteriorated and become flimsy over time. You can see in the pictures there has been some attempted work on it over the years.
This is not based on poor workmanship or shoddy materials. The proper way for this chimney to be repaired is for a masonry to come out grind out all the counter flashing and the loose mortar between the rock and the cement on the top of the chimney and re point the cement and add new counter flashing and folded and crept around corners not tared. Tar will break down in the sun and crack in a few years.

I am rejecting this response because:The business ignoring proofs of the poor job they did with chimney flushing installation.
Provided pictures clearly showing that.
The contractor who has inspected chimney flashing for me confirmed low quality of the installation and identified not welded or sealed flashing corners as the primary cause of the leak.
The business instead of fixing what they should do properly from the beginning making false statements as an excuse to do not fulfill contractual obligations regarding warranty:
Adanac- “We told you when we did the roof you need to get a masonry to come and re point and replace the flashing the counter flashing that is cemented in the chimney”
This is not true:
1. If this would be true, it should be listed in the “out of scope” section of the agreement, but it is not.
2. I would newer hire a roofing company which is going to do a partial work only, and I need to hire another contractor to complete outstanding work. E.g. replace counter flashing.

That statement about the counter flashing has no proof. The all parts of the chimney flushing you can see in the pictures where installed by Adanac. If there is a flashing part that Adanac referring as "counter flashing" on the pictures, it was installed by Adanac.

We have been in business for along time now and have a history of providing excellence service and workmanship. We stand behind our work. I am sorry you don't feel that way or don't understand what we have been trying to communicate to you.
If you look at your emails from Kurt June 26th 2015. He send you the invoice and with your concern about the counter flashing how it looked and he came back to paint it for you this
again, is the flashing that is cemented in the mortar of the chimney and is not in our scope of work. The flashing we replaced that is in our detailed quote is on page 3 is 26 guage metal with baked on enamel paint. the counter flashing was a different color as you can see in the corners where the counter flashing has been pulled away. In our scope of work were place all the metal around the chimney not what's cemented in it.It clearly says back pan wall and step flashing never mentions counter flashing because we don’t to that work a masonry is recommended to do that and re point and seal the mortar. This is when Kurt first told you about you should get a masonry there not just the counter flashing needs work but all the mortar around the rocks should be repointed. Then check your email from Kurt dated March 14th 2019 you called about a leak we came out and checked and in the email he tells you again to get a masonry out to repair the counter flashing and repair the cracks in the mortar and also recommended a contractor with a phone number. Now in your email September14th 2021 you say the counter flashing is still leaking. Then October 7th 2021 email from me I tell you again this counter flashing needs to be replaced and your chimney repointed. Until you get the counter flashing cut out the chimney and new counter cemented back in and the chimney re pointed this problem will not go away. This is like a wall leaking behind siding or a window leaking, and it runs down to the roof deck and enter a house the roofer is not responsible. As far as you say you had a contractor come out and say the corners need to be tar is not the proper solution it will crack and try out and shrink in no time or have your chimney counter flashing soldered in my35 years in the business I have never seen one done that way. This is not based on poor workmanship or shoddy materials.
