      Distinct Concrete Solutions was hired to complete a job. At such time as they were engaged they advised the job would take 3 to 5 weeks to complete. We are now on week 15 and they have walked off the job saying they have other commitments. Distinct Concrete Solutions sent an invoice in July, 2021. It was paid in full. Without them completing the job the kitchen cannot be complete, the finisher to the house cannot start nor can the painting. The floor is a complete mess. We ask that they return ASAP to finish the job or refund.

      AS per the customers complaint.   We have not walked off the jobsite.  This is a false accusation.  We advised we would have to return in 2 weeks and they could continue on with the other trades such as finisher and paint and we are able to work around that.  The job was estimated at 3 to 5 weeks barring any unforeseen circumstances involving the job itself.  And there has been a few setbacks as with a lot of jobsites.  The statement from the customer stating its on week 15 is false.  We worked the job and did the bulk of the work thru the whole month of June 2021 (4 weeks).  We were then advised by the customers ***** ****** ******* ******** that they would not need us back to jobsite until end of July.  On July 30th we received a text from ***** ******** stating his counter tops had not arrived thus he would not need us back yet, August 8 we received another text from ***** ******** stating he was not ready for us to return to the jobsite as yet, August 14th we have another text from ***** ******** stating he was now ready for us to return to continue forward.  We did so. And have been back at the jobsite for possibly 4 weeks -minus a few days here and there.  And focusing on changes that were requested by the customers as they were not fully satisfied with some the looks.  This all takes time - at no cost to the client.

      The billing that they received and paid was only for the bulk of the work completed to June 30th 2021.  And was stated on the invoice. They were aware there would be a small final bill for the sealing of the floor.  When we arrived back the customer requested we complete the upstairs as priority as he was wanting to have his wife and himself moved in to the upstairs soon.  This was done at their request - a set back with the sealer - for which they had not been charged for was then rectified for them and this has not been charged to as well.  They were happy with this outcome.

      We have received emails from *****  * ******* ******** in the last 24 hours for which we have responded * *** ******** * the kitchen is not on hold due to us  we have told them to move forward and we have never asked them to stop any of the other trades from continuing.   We were not advised by the client that one of the areas was waiting on a section of floor until last night via email. We have encouraged them to continue forward.  we have advised that the finishers and painters can go ahead as this does not affect our job on this site.  The complaint about floor a mess is  they have is some black dust on the main living floor area that is a minor remnant of the dye we are using to stain the floor at their request and we are not completed on that part yet.  "We are right in the middle of this part as of up to yesterday.(This is also being done and no extra cost to the client as we are  trying to give the finish that they are looking for)

      At no time have we said to hold the job from other trades nor have we said we would not complete the job.  It is our full intention of completing this job as stated to the home owner.

      I am rejecting this response because: it is not accurate
      The reason the project is taking so long is that Distinct Concrete Solutions made a mess of the floor and they have been trying to fix their mistakes.  
      Distinct Concrete is holding other trades up as we have the carpet and gym floor on site and the floor installer was not able to install and left the product advising us that they will return when the concrete floor is complete.    It cannot be installed without the concrete complete.
      Distinct Concrete Solutions left the job site knowing that other trades are waiting on them.  Lew advised us that he was leaving to go work on other commitments that he had.  We are asking that Distinct Concrete return to the job site ASAP and complete their commitment to our project.

      I do not accept the response.  The client is stating we are holding up all the other trades.  In reality, the client put us off because of other trades as per his text messages in previous response for 6 weeks.  July 1-August 14th. Had we been able to continue on thru July we would have had the job completed.  So stating we are holding up the other trades is in accurate.  We have been pushed off by the client initially which has then in turn delayed us in completing this project for the client.  We have advised we will return in 2 weeks to complete the job - yesterday - at which point ***** ******** became EXTREMELY angry, swearing and yelling **  *** * ** ***** ** *** ********* *** ******* *** ** ** * ******** ** * *** *********** **** ** ** * ***** **** *** ******** ** * **** *** **** ** **** **** **** ** ** **** ** ***** *** ******** *** ** *** * **** ** ** ****  Even after the verbal abusive attack Lew informed I apologize you are upset and I will be back in 2 weeks to which he was ignored.  We then received an email threatening court action.

      Regarding the carpet and gym floor, I have let the client know we were not informed by that trade at that time that they were waiting to have the section of floor to those rooms polished and sealed.  This was complete shock to us and had this been communicated at that time would have made that section priority.

      We are not fixing mistakes as stated.... we are trying to give the look the client is after.  Multiple times they have said they were happy with the look, then decided it could use a bit more to it prior to us sealing - which is not a problem and we have 100% felt obligated to make sure the client is completely satisfied. And any concerns the client has had we have made sure to address on the jobsite immediately.  Again any changes or adjustments take time to do.  This has been explained to the client, with full agreement from ***** *********  We are trying to be very accommodating to the client and are being met with refusal to agree.  We have always maintained as much communication with the client, responding to yesterdays emails immediately upon seeing them.   We have not walked off the jobsite and have advised the client when we will return.  It is a very uncomfortable situation with the verbal assault yesterday by ***** ********, but we have pride in our company and stand behind our work and are willing to continue.

      I am rejecting this response because:
      The information is not accurate and all statements made are untrue.

      Lew was well aware that the project is waiting on him to complete the job.  Lew walks past the gym and the movie room when he is on site.  He sees the products there waiting for him to complete the job.  I personally told Lew many weeks ago when the carpet installer was there and left that we were waiting on the floor and I was disappointed that the install could not happen.  I completely disagree that we have been happy with the work so far, Lew is trying to fix mistakes made.  The product that we have so far and the look is definitely not the look or product that Lew sold us.
      Each day that Lew has been on site, we discuss with Lew the problems.  Lew agrees that the floor is not acceptable and he keeps telling us that he does not know what to do or how to fix the problem.
      ***** ******** denies any verbal assault.  ***** ******** was shocked and upset that Lew walked off the site.
      Again, I am requesting that Lew return to the site ASAP, complete the project or refund our money.
