      I'd like to cancel the contract with the Pro Rooter Plumbing for the following reasons: 1. the contractor charged me a huge amount money, compared to other contractor's quotes: $21,000 vs. $8,400. 2. I'd like to finish the job (our rental house of **** *** ** was flooded on Nov 14, 2021. Ryan came on Nov 15, 2021 afternoon to fix the flood problem. I told him and then (S**** on the phone) to have a new drain tiles system replaced at the same time. They asked for $21,000 for the project and I accepted the offer ***** ******* Even though I'd like to get the job done as quickly as possible as I care for he tenants' safety and convenience as well as the house may shift or damage if open ditch around the house is there for a long period. However, they did not give me any work plan: when and what they would do and deadlines to finish the job even though I asked them a few times. They dug up some soil and put a pump at the back of the house at 11 pm on Nov 15, 2021. Then, they came and dug up some more soil at the back and and one side of the house: 1 or 2 hours a day for another 3 or 4 days and then stopped. However, other contractors said the job can be done within 3 or 4 days. I tried to communication with S**** to express my concerns and asked him to do something not to delay the project. He did not respond to my phone calls, text messages in timing manner. Rather, he delayed and sometimes even ignored them. Even it's very difficult to make an arrangement to see him in person until Dec 7, 2021. He said he asked the city hall about the drainage connection only 10 days later on Nov 23, 2021 but no response. However, he did not follow it up either. So, I got the info myself from the city. He said he had/has other emergency calls to deal with. He ***** ** **** **** ********* ***** *** **** ******** *** tried to postpone our project because he'd already got the deposit of $5,000. 3. I asked him for his business' valid GST registration # but he can't provide.

      The Original price we had gave to Mr *** was $25,000.00. But he wanted a deal. The best price we could give him to do the Full drainage and connect to existing out pipe was $21,000.00. So we gave a deal from $25,000 to $21,000
      ...as the deposit was given to us we started the same time hydro flushed the pipes ...tried to open the perimeter drainage....
      Then picked up our excavator to dig a hole and set up a pump to avoid any water getting into the house..

      Everything was under control (flooding issue)
      We did explain to Mr. *** that due to the heavy rain fall and flooding happing in the lower mainland
      We will not rush and finish the job because of the $4000.00 deal we had gave him.
      As the work proceeded we had notice that there was ******* construction done on the property/house. As we were excavating we noticed that there was no foundation on the house. We then contacted mr *** and notified him.
      That took time because we had to reroute our excavation work due to safety& structural reasons.
      We lost a few days talking back and forth with mr *** because we found not to code plumbing and building.

      Also we were unable to locate the out pipe. Even though we contacted the **** ** ****** and they had no information regarding the sanitary storm connection. We also notified Mr *** what **** ** ****** had told us but Mr *** insisted that there is a out line. And telling us to dig at multiple locations, But to no avail.( which this took a few more days back and forth)

      He wouldn't believe us to go to the **** ** ****** to apply for a new sanitary storm connection for which a home owner has to apply for and pay for.
      ( which we lost more days messaging back and forth)

      At this stage he started insisting and tell us to excavate a rock pit in the rear of the property and put the out there.
      And TOLD US NOT TO PULL ANY PERMITS WITH THE **** ** ******.

      Mr *** set a meeting on site with his builder WHO did the ******* extension (with out permits).
      And forcing us to do as Mr *** says.

      At that point we will not be doing any ******* work with out permits on this job!
      NOTE:
      As we did our excavation work. We took all safety measures for tenants. (Plywood, caution tape and steal fencing).



      TO BE CHARGE TO MR ***:

      60% of the contract work has been carried out.
      Rental charges oweing.
      Pump
      Ply board
      Fencing
      Hydro jeting and Camera work on initial day.

      We told Mr *** that he should get his own pump and safety equipment so we can pull our safety equipment out.

      We pulled out our fecing and pump but left the Ply boards because Mr *** did not provide any ply board for his tenants. (WHICH WE HAD SPOKE/MESSAGED HIM 2 WEEKS PRIOR)
      (Rental charges still applied until ply wood removal date.)

      We will be in contact with the **** ** ****** to assure that Mr *** gets permits and a licensed plumber to proceed with the work.

      1. Saying that the business has done 60% of contract is rather unreasonable and unfair. They did bare minimum. What they have done was: they tried to do Hydro jetting to clear the pipe clogging at the front and left side of the house and used the metal detector for the gas line as well as dug up ditch at the back of the house and the left side of the house, put some metal fences at some areas of the back of the house and put a submersible sump pump. See the pictures attached. Even under the sundeck, the digging was only partially finished. I asked a third party qualified plumber how much the value of the business (Mr. S****) has done on my property as at Dec 16, 2021. They said it should be only C$1,200. I am OK to pay for the extra $675 for fixing the flood problem + C$1,200. Therefore, I should get the refund of the deposit C$3,125 (C$3,125 = C$5,000 - C$1,200 – C$675). 2. The business does not take their responsibility as a professional for the job done on time. They just hopped one job from another. His text messages to me confirmed that he did the jobs on a priority basis, not the first come first served basis* * ***** *** *** *** **** ** *** ******** ** *********** *** ***** **** *** ******* **** *** ***** **** **** ***** *** *** **** ** **** **** ** *** ****** *** *** ** ***** *** **** ** **** ***** ** **** ** **** *** *** ***** *** *** ** * ******* ** ** *** ***** *** **** ** * ******* ********* **** **** *** **** ******* ****. I prefer them to pay attention to my job. For that, I begged him a few times to have a dedicated person or two to finish the project on a timely manner but he rather ignored my requests. 3. They were supposed to as Mr. R*** told me, dig up around the house and put the sump at the corner of the house, and then lay pipes and cover with gravel around the house. However, they did not complete them. I helped the tenants suck out the water with a pump. I also diverted the down pipe water away from the drain tile holes to minimize the water going into the old drain tiles but they never suggested to do so as a professional. He then came back to the property only on Nov 17, 2021 again and did some digging at the back for an hour or so. My request to Mr. S**** to provide me with their work schedule and the completion date a few times. However, he did not provide them. As the business would not finish the job on time, I asked Mr. S**** nicely to end the contract amicably on Dec 1, 2021. He did not end it until Dec 15, 2021. See text messages between Mr. S**** and I for all messages texted between he and I in detail. Note: I am getting the connection permit from the City. 4. During the price negotiate process for the drain tile replacement project on Dec 15, 2021, Mr. S**** **** * ******** ******* saying that they would fix the emergency problem for $675 and leave the property because he did not have time to talk to negotiate the price of $21,000. As I’m at emergency situation under ******, I accepted the offer of $21,000. The business charged me GST on the invoice without a GST number. He has not provided me with the valid GST # as at today, Dec 20, 2021. 5. On Dec 15, 2021, Mr. S**** texted me that they took away their pump and metal meshed fences from my property after I sent the complaint to Better Business Bureau. On the same day, I replaced the plywood and got a similar pump and hose. I could not replace their pump and plywood until they agreed to end the contract and removed their stuff from my property. I could not remove their stuff without their approval. Otherwise, it’s very simple to get both plywood and the pump right away.
