As of March 14, 2001: The Director of Trade Practices has advised the Better Business Bureau that in the Supreme Court of British Columbia on Monday, the 12th day of March 2001: The APPLICATION of the Plaintiff, Director of Trade Practices, coming on for hearing at Victoria, British Columbia, on March 12, 2001; AND UPON HEARING Neilane M. Mayhew, Counsel for the Plaintiff; AND NO ONE APPEARING on behalf of the Defendants, although duly served:
THIS COURT ORDERS, that:
1. The Defendants Andy James Kralik and 500519 B.C. Ltd., doing business as Exterior Home Services, and each of them, pay to the Plaintiff Director of Trade Practices, on behalf of Muriel Egerton, the sum of $75,690.60 plus interest in
the sum of $9,992.72 calculated to March 12, 2001.
2. The Defendants Andy James Kralik and 500519 B.C. Ltd., doing business as Exterior Home Services, and each of them, pay to the Plaintiff Director of Trade Practices, on behalf of Frances Mary Loftus, the sum of $208,631.00 plus interest in the sum of $27,543.57 calculated to March 12, 2001.
3. The Plaintiff Director of Trade Practices is entitled to recover the costs of the investigation of the Defendants from the Defendants with the amount of such costs to be determined by reference to the Registrar.
4. The Plaintiff Director of Trade Practices is entitled to the costs of this application."
As of September 9, 1999: The Director of Trade Practices has advised the Better Business Bureau that, in the Supreme Court of British Columbia: "The application of the Plaintiff, Director of Trade Practices, coming on for hearing at Victoria, British Columbia, on September 9, 1999; and upon hearing John D.
Waddell, Q.C., Counsel for the Plaintiff; And no one appearing on behalf of the Defendants, although duly served:
This court orders that the notice period for the hearing of this application be shortened to one clear day, the Notice of Motion having being served upon the Defendants on September 6, 1999, a statutory holiday;
This court further orders that service of an entered copy of this Order shall be deemed effective service of the Order upon the Defendant, Andrew Kralik, if personally served upon the aforesaid Todd Kralik.
This court further orders that the Defendants, and each of them, be restrained from engaging in any consumer transaction, or a series of transactions, with any one consumer, in which the total charge to the consumer exceeds $10,000.00;
This court further orders that the Defendants, and each of them, be restrained from entering into any transaction with consumers until they have provided the Plaintiff, Director of Trade Practices, with a bond in the sum of $500,000.00,
pursuant to the Bonding Act in a form acceptable to the Plaintiff, Director of Trade Practices;
This court further orders that the Defendants, and each of them, be restrained from entering into any transaction or series of transactions, whatsoever, with any individuals over the age of 60 years;
This court further orders that the Defendants shall have leave to apply to set aside this order upon two clear days notice to the Plaintiff, Director of Trade Practices."
