BBB spoke to a representative from Casablanca Homes to clarify the intent of these clauses contained in their standard contract. Casablanca Homes remained responsive and communicative during this investigative process.
BBB had this contract reviewed by legal counsel and and it was determined that no issues where found with the contract as presented by Casablanca Homes. BBB also contacted the President of the Home Builders Association to see if this type of a clause is a common industry standard. Although it was indicated that this type of clause(s) are not common place, it is within guidelines to include.
The BBB suggests that consumers seek proper legal advice before entering into a contractual agreement to protect themselves for future claims and actions. Although no wrong doing by Casablanca Homes was confirmed, consumers are reminded to exercise due diligence when reviewing and signing legal documents.
It has come to BBB's attention that Casablanca Homes has a non-disparagement clause in its consumer contract that prohibits customers from filing complaints or posting negative reviews as a result of a marketplace interaction. BBB does not withdraw complaints under these circumstances. Consent to post the text of a complaint is solely at the discretion of the customer.
As of 29 February 16, the business's clause, which is found in its contract states: 'The purchaser covenants that the purchaser shall not, under any circumstances whatsoever bring any action, complaint or publicity against the Builder in any court, or in any public forum whatsoever, including social or other media, or do anything whatsoever which might bring public attention to such argument, dispute or claim'.
