      Late summer of 2023, we hired B T ***** Contracting Ltd to shingle our roof. After the work was completed, our roof began leaking. We made the contractor aware and he came back twice to put tar under the shingles. He told a family member that he hoped he hadn't broken any shingles in that process. The roof continued to leak, and the contractor advised he had no idea what the issue could be. He asked us to check if insurance would cover the leaking. They will not do anything about a bad install. He then asked us to ask around and find out what other professionals think the problem could be. Multiple professionals advised that the shingles were damaged by the contractor on installation. The nails were driven too far through the shingles, and this damaged them. We let the contractor know this information, and he told us he would fix the roof if we purchase the materials. Obviously, we won't be paying anything to fix his mistake, so we told him "no". We sent a quote for roof replacement and he stopped answering. The entire roof needs replacing (including sheathing). We also need our bedroom ceiling repaired, as the leaking roof damaged it.

      A Miss ***** ***** stated that my business had been hired to shingle thier roof.. Which I see as a false statement..

      I was under the impression that ***** (******* ** **** and some guys wound be shingling his house on the weekend and could an extra hand..

      My business ( BT***** Contracting Ltd.) did not issue a quote/bid on this project..

      This "customer" supplied all the materials and arranged a waste box for clean up..

      At the time I was happy to lend a hand to a family member.. but " No good deed goes unpunished"

       I am rejecting this response because:

      Good afternoon,
      It was suggested by Mr ***** ***** (owner of B T ***** Contracting Ltd) that the re-shingling of our roof be completed by his business, B T ***** Contracting Ltd, as he needed exposure in our area. In speaking with a lawyer regarding this situation, it was confirmed that a written invoice/bill of sale is not required in order to infer a contract. A verbal contract is enough to take to Court. There was an agreement with the owner of B T ***** Contracting that we would advertise his business' work upon completion of the re-shingling. 
      Mr ***** references "Brian" in his response to our complaint. ***** is the homeowner. He was not involved in the work done to re-shingle the roof, as he has a fear of heights. This is part of the reason why we hired B T ***** Contracting Ltd to complete the re-shingling of our roof. This is also one of the reasons why we hired another contractor to inspect Mr ******* work (besides Mr ***** requesting this). ***** is unable to go up on the roof himself.
      Materials were purchased on the advice of the business owner, Mr *****. He provided a quote from the building supply company that his business uses. We arranged for the same materials to be purchased from and delivered by our preferred building supply company, as the cost was lower. We also arranged for disposal of the spent roofing materials. The materials and disposal of spent materials is not the issue, and are not directly related to the completion of the work or the resulting leaking caused by B T ***** Contracting Ltd. 
      Mr ***** claims that the work was not completed by his business, but states that he was there to do the work. He also returned to our home in order to lift shingles and re-attach them with PL Premium, and then roofing tar. In doing this, he told me that coming back to fix his mistakes "does not look good on his business."
      We are rejecting his response as he is still not fixing the issue which he caused. He admitted to causing the damage in offering to repair the roof if we purchased the materials. B T ***** Contracting must cover the cost of replacement of our roof and ceiling, per the suggestion of our chosen contractor, as his work is the reason for our leaking roof and the resulting (and worsening) damage. If the issue remains unresolved, it will be brought to Court.

      Hi..

      ***** responded with claims that I was looking to advertise BT***** Contracting Ltd. through her.. FALSE!

      Taking on work outside of Shelburne County wouldn't be something I'm typically interested in.. Liverpool would be over an hour drive from me..

      No contract, be it verbal or written was ever issued on behalf of BT*****..

      ***** (Homeowner) was very much a part of this project. He arranged drop off of new materials and drop off/pickup of a waste box.. ***** took care of all ground work duties, and was in charge of clean up.. ***** made all the of the arrangements including picking the date, Saturday August 19th 2023..

      On December 19th 2023, I returned to the house to see what appeared to be a problem with condensation and ventilation.. which then I suggested seeking the opinion of a local contractor.. It seemed to me that the change in season and change in temperature was causing the warm attic air to make moisture on the inside.. This roof has an over hanging g covered patio (cold area), which only adds to this problem..

      The work preformed was in No relation to BT***** Contracting Ltd. I was there only as a family member lending a hand.. I only Visit liverpool to attend family activities..

      In April I was notified by ***** that his roof needed to be re-shingled once again..

      So, I gave him the same deal as the start..

      "If you want to line up the materials.. And grab one of your buddies from work.. Pick a Saturday and I'll lend a hand."

       I am rejecting this response because:

      Good afternoon,

      The distance travelled by the contractor is irrelevant. Many contractors travel well outside their communities to perform work. There was also no claim made that the homeowner was not part of the process of re-shingling the home. To be clear, the homeowner was not involved in the installation of the shingles. He is unable to be on the roof, due to his fear of heights. Also, we do not have experience with the act of installing shingles. This is the reason we hired B T ***** Contracting Ltd. The leaking was not caused by the arrangement of a dump box, nor the disposal of the old roofing material, nor the date of the installation. The leaking was caused by the work done by B T ***** Contracting Ltd. 
      At the request of Mr *****, a contractor has been hired and has advised us that the cause of the leaking is improper shingle installation by B T ***** Contracting Ltd. Mr ***** is aware of this fact. He was made aware of the presence of the contractor at the home (so that they could discuss the issue), but he did not show up at that time, nor at any other similar opportunity. The claim Mr ***** made that the leaking is due to condensation forming is incorrect, and was deduced from a YouTube video which he found. If condensation had been the issue, the roof would have leaked in the past. It also would not be restricted to one side of the roof (the side of most exposure to the elements). I had only gone into the attic for the first time just before B T ***** Contracting Ltd completed the work. I remarked at how fresh it was up there. It is now damp and musty. Though the leaking has been occurring on the elements-facing side of the roof, the entire roof must be replaced, as the other side was also installed improperly. The bedroom ceiling also has damage as a result. The damage will only continue to worsen if something is not done to fix it soon. 
      As previously mentioned, Mr ***** offered to repair his improper shingle installation if we paid the cost of the materials again. As stated, we will not be paying for materials that were damaged upon installation by Mr *****. In conclusion, the damage is a result of the work completed by B T ***** Contracting Ltd.
