      Mr. ***** *********,

      Supervisor, Marketplace Services

      Dear Mr. *********,

Thank you for providing us with the opportunity to review this customer's requests

Following please find our dealership's response to this customer's requests:

The trade value of $34,000 was contingent on the customer repairing the tail light and rear bumper before trading in the vehicle…he decided not to complete the repairs and accepted a $2,800 reduction in the trade value in lieu of completing the repairs himself. If the customer had arranged for the repair of the vehicle prior to trading it in, any resulting increase in the trade value and related HST credit would have been offset by the cost of repairs and associated HST incurred by the customer to have the repairs performed, therefore we do not consider this request for a refund of $420 HST to be reasonable.

The vehicle was a new vehicle, not a demonstrator, and the customer was the first registered owner. The 196 kms at delivery would have been incurred by the test drive at the factory, our technician’s test drive as part of the PDI process and the test drives of potential customers such as this customer while the vehicle was in our inventory. By this customer’s standard, any vehicle that is test driven by a technician or a customer prior to its sale would be considered a demonstrator and should be discounted, which is not reasonable. We do have demonstrators and service loaners that are registered and plated and driven by customers and employees. Typically they are kept in service for 10,000+ kms and when they are grounded they are offered to the public with a discretionary discount relative to the months in service and kilometers driven. The vehicle that this customer purchased was a new vehicle, not a demonstrator, and therefore was not considered for any discretionary demonstrator discount.

Please contact me if you have any questions.

      Thank you and best regards,

      Business response

      ***** *********,

      Supervisor, Marketplace Services,

      Dear Mr. *********,

Thank you for your note. We have nothing further to add to my original response.

The trade value was reduced from $34,000 to $31,200 to reflect that fact that the customer decided to trade the vehicle in without repairing the tail light and rear bumper. Our cost to complete these repairs was estimated at $2,800. If he had invested in repairing these items the trade value would have been $34,000. but he would have been out of pocket the cost of the repair. He was aware of the trade value at time of purchase...it is clearly stated on his bill of sale and finance contract.

Regardless of when the vehicle arrived at the dealership, it was a new vehicle when it was sold. New vehicles can often remain in inventory for many months before they are actually sold. It had never been registered or advertised as a demonstrator and was sold with under 200 total kilometers on it which, in my experience, is well within the normal range for a new vehicle.

Given these factors we do not feel that a monetary settlement in any amount is warranted or reasonable.

Please contact me if you have any questions.

      Thank you and best regards,
