I had my driveway done in October 2021 and was advise by ***** (owner) that he is the best in the city and this is why his price is higher then everyone else. He advised that it's all about what's under the concrete prior to laying it down. I went with them and thought I was in good hands. From the minute the driveway was "almost" done I had problems with them. I questioned when it was going to be completed 100% and ***** turned on me saying that this job $7,500.00 is pennies for him and I should be calling asking for small little things to be done. After calling over and over again they finally came and completed the few things left to cleaning up the driveway and making it somewhat right. During the winter I noticed the driveway start to get a hairline crack to which I emailed them immediately. I would told this is normal however ***** said this is why you should go with him to so this didn't happen. Then each week the driveway got worse and worse. I continued to email asking is this normal. Then I would told i needed to seal it, which I was not advised when the driveway was done. I got the sealer contact from them and had it done. When that company arrived he advised that the driveway was in rough shape and he didn't know if this was going to help. We did it anyways in hope for this to help. Well it didn't. I then sent an email to Ascon saying that I was going to file a claim and they immediately advise they would remove the driveway and refund me in FULL once this is done. I agreed. Once this was done, then first advised that they were not going to refund me anything and to deal with their lawyer. I sent back the email stating full refund. They have refunded me part of it now $5200.00 and their lawyer has advised they are not paying for anything else. I have advise I will be taking next steps as it's very clear a FULL refund would be given. Not a breakdown of a partial payment. I have no driveway at this point and partial refund.Business response

Mr ****** ***** has received a reimbursement back from Ascon which was transferred to his account in the amount of $5275.00.The original amount of his project was $7525.00. He wanted his step left in place which was originally billed at $525.00 leaving a balance of $1725.00 which was the charge for excavation of the original asphalt driveway and what was underneath. We supplied 16 ton of stone for the new base, set grade and compacted which was not disturbed when the driveway was removed. At this point the remainder in question is in the hands of our lawyer since being advised by Mr ***** directly that we would be hearing from his lawyer.Thank you***** RobsonBusiness response

Good morning
As I said in my previous response this matter has been sent to our lawyer. We have realized that there is no pleasing this customer as we are aware that he is trying to get something for nothing. He provided pictures of damage to his garage area and we have before pictures showing that the damage was there before the driveway was removed. We will let our lawyer handle it from here.

I am rejecting this response because:
They have a lawyer that has left the firm and knowing this, have not provided the new business information for paperwork to be served. We will submit all forwarding information addressed to the owner of the business at the address that's on file. We will not continue this back and forth as it's time consuming and pointless at this point. The business has not fulfilled their obligation for a FULL refund.Thank you.
