      After attending the NS Spring Ideal Home Show I hired East Coast Paving and Concrete to come and do my driveway. The agreement was $4200 plus tax to dig down 2-3 feet and widen the driveway by 2 feet on each side, graded 6” from back to roadway, excavated to proper depth, surge and gravel tamped to proper specifications, asphalt step as required, lawn sloped to new driveway grade and accommodations to drain water from the French drain as mentioned.I also asked for 3” of asphalt and 5 yards of 1/2”gravel.**** came back with$4200 for everything but if needed the surge would be another $4-700 and that 3” would be compacted to 21/2”.On June 7th 2023 driveway dugout and gravel applied as well as load of gravel left as requested.The day **** came out to pave 2 other driveways my wife told him that I needed to discuss more about the driveway before proceeding. On July 10th I asked if we could meet the following Wednesday to discuss the remainder of the job. Agreed to come the following Monday July 17th but didn’t come.Tried another meeting July 20th excuse “Bad Cell service”**** planned another get together on July25th but on July28th **** decides that” we just part ways I’ll send a bill for work we did will treat you right”I said “ I would have to have someone else come to do an estimate and see what is the difference. I will pay you whatever is remaining.”I sent a text again explaining on what we had agreed on with this message and there has been no more correspondence with me since. It is now August 10th. No money has been paid but we would like the work that was agreed upon.

      In response to Mr. *********** complaint we would first like to mentioned that obviously it would be advantageous for us to be able to complete the work on his property however in working with this customer he has consistently looked for more then was on the original contract was argumentative and belligerent to the point where out of all of the customers we had on that street which was several we had to walk away from his project as we were unable to satisfy him or meet his needs outside of the original proposal given. Referencing the original proposal given Mr. *********** property was to be a 14 foot driveway with two foot extensions on either side driveway totaling 18 feet wide 35 feet deep price quoted was $4200 plus hst. Additionally, there was line items on the proposal set out for digging down two to three feet or more and adding surge as needed at an estimated cost prior to excavation of between 400 and and $700 and in addition to that he also requested gravel material be left for a project that he was working on at the rear of his home. Two date in a timely fashion East Coast paving arrived on the property remove the existing asphalt spent several hours digging and removing several feet of material both underneath the driveway and excavation of the sides. Once complete we then installed a tandem load of Class A gravel to elevate and level the existing parking area add the contracted width. Sence completing this portion of the project the homeowner requested additional with to the driveway outside of the contract requested landscape edging around the hole that he got us to dig which was outside of what was contracted and put us in a position where we were unable to move forward and complete the project. In addition we have several statements from neighbors as to the type of information that Mister ********* was referencing our company with And also have several character statements from neighbors as to the quality of work that they received the professionalism that they were met with and the overall result of their project. At this point we will be invoicing the homeowner for all work completed all materials removed and all of the new material installed.

       I am rejecting this response because:

      It would be most advantageous for Eastcoast Paving and Concrete Ltd to finish the job as discussed; before he sent the quote and as clarified, in my texts to said company regarding the quote.  The text is a part of the original proposal.  The texts can be viewed in the pictures provided earlier and can be viewed above in the documents.

      To address the "timely fashion":  I gave him the go-ahead to start the project on May 9th; it was almost a month later before he showed up; June 7th he started with no prior mention he was going to start.

      Mr. **** ******(unsure of spelling of his name; not stated ; only written) refuses to acknowledge the text messages I sent to him on May 6th which clarifies his quote or the original photo of the driveway prior to start.  We went through everything before his quote was sent to me. His quote does not mention most of what was discussed so I sent him the text to make sure everything we discussed was in fact included in the quote; to which he said everything was included.  This is confirmed with the extra gravel, he provided as part of my text  but not included in his quote, and acknowledged in his BBB communication dated August 30th. 

      I gave him much patience and even told him he could ignore some of what he acknowledged; in my text; if he could just finish the job (July 29th- the job was started on June 7th).  It is now September...  at this point I would like everything as mentioned in his quote and in the texts dated May 6th.

      It would be a welcome expression of good faith if you as a third party and both **** and I could get together; go through everything to date and get this concluded and the job finished.  I would suggest at our residence to make clear all the details.  Furthermore I would suggest going through all the text messages to be caught up before meeting

      I had my driveway paved in May and I wasn't pleased with the way it turned out. I let **** know in June and he said he would be in touch to come check the job. I never heard from him again and contacted him end of August, and let him know that I was still waiting for them to fix the driveway and that by that time I had a piece of hosta plant growing up through the new pavement. They had never removed the plant from the small garden area I'd asked them to pave over. I sent him photos and **** said he would be in contact soon and come check the driveway. I then waited until the middle of September and messaged him again, and he once again said he would be over. In early October I contacted him to try and find a time we were both available for him to finally come see the driveway. I attempted to make 4 different dates and times for him to show up and 4 times he didn't come. My time was wasted waiting at home for him to show up and at one point I even cancelled a client so I could be available, which means I was also out my pay for that time. I'm beyond frustrated with this situation. He then contacted me to say there was no need to come and check the driveway and that he was going to send someone to fix the issue with the hosta in the pavement and they would recap the driveway. This doesn't solve the issue as far as I'm concerned. I paid to have my driveway paved and they didn't do the job correctly. At this point it's too late in the year to fix it and I'm done dealing with this company. I would never recommend them to another potential customer because of the extremely poor customer service. I'd like a refund for the amount of $3277.50

      We are very sorry that you feel an additional visit had to be made as we were aware of the warranty issue which is the growth beneath the asphalt drive where the garden was removed. unfortunately it seems that we missed a root causing the issue and had made verbal communication to you that it would be resolved. Upon inspection of the driveway there is nothing else that warrants its removal or refund. If you would like the repair done please confirm.

      We have been by and had a look and took pictures and again there is nothing wrong with the driveway other than the growth by the house that will be fixed in the spring when we reopen. If you elect not to seal coat and protect the driveway that is totally up to you and will not effect the warranty.

       I am rejecting this response because:

      I had my driveway paved in early May of 2021, and in June I first let **** know I wasn't happy with the outcome. He said he would come by and see for himself what the problem was. 
      During that time I had a friend who was having her driveway done as well. When she saw my driveway she asked if she could take photos to show **** or **** when they came to do hers. She agreed with me it was a poor paving job and said if hers turned out like mine she wouldn't be paying for it. From what she has shared with me, there was a conversation with one of them where they told her they agreed it was a mess and had to be fixed. They also mentioned to her that they never recommend doing a pave job in early May but that my neighbour was insistent they do her drive, so when they arrived to do hers they called me and I had mine done that day too... they never shared with me that they wouldn't recommend paving that early in the season. It was started May 4. 
      When I messaged **** in June he did say he intended to stop in in the coming days to see what could be done.
       Then the summer went by and I didn't hear back from him.

       I began calling and texting **** in late August and at that time I let him know that there was a piece of hosta growing up through the pavement. I also explained why I wasn't happy with the pave job as there were many uneven and rough areas and you could see where the pavement hadn't been flattened out properly. There are also 2 very noticable seams in the driveway that I don't see in other pave jobs so I'm unclear why mine look so bad. 

      There were texts and phone calls back and forth between end of august into mid october and I really didn't get anywhere. He said he would stop by and never did. At one point there were 4 different times he said he'd be over and didn't show up. 
      I found this very frustrating as I don't think what I'm asking is unreasonable. A job was done that I'm not happy with and I'd like someone to come by and speak with me about it. The last communication I had with **** was him letting me know they would recap the driveway. I had further questions about this that were never answered and I waited another week to hear back from him. Since there was no further word from him I was fed up and filed a complaint with BBB. 
      And now, after all this time you're telling me someone came by and took photos and there's nothing wrong with the pave job. When were they here and why wouldn't they let me know they were coming to take photos?
      I'd like to know what might be done to fix this situation and if you could please forward the photos with your reply that would be appreciated.
