      ***I am lodging this complaint on behalf of my parents, **** *** **** *****, who are 87 and 85 years old respectively. They are happy to speak with anyone (************) to corroborate facts, answer questions, etc. We initially contracted David Jennings of Zwicker’s Roofing to repair the rear of roof at my parents' house on ** ******** ******, Truro, NS. We paid 50% deposit ($2575.00) up front as requested. In April 2023 the job was completed; we were relatively satisfied. The complaint originates when we contracted David Jennings of Zwicker’s Roofing a second time to repair the remainder of the same roof. On June 23 we gave Mr. Jennings a 50% deposit ($3622.50) in person, as requested by him so that he could "buy materials". Waited two months then asked via email when Zwicker’s was going to start roof. This commenced ongoing efforts by my parents via email and phone calls to find out when he was coming to begin work. Several times he stated he would commence but did not. During these communications Mr. Jennings was informed that the roof was leaking and was causing damage to some of the upstairs rooms. After 10 months, in April 2024 my parents mailed a letter to Mr. Jennings saying that they had waited long enough, especially as damage to their home was accumulating. They explained that they were hiring another roofer and to please return their money to them. He phoned promptly and expressed interest in beginning work the next day. They reiterated during the same phone call that another roofer had been hired and again asked to have their money back. Mr. Jennings promised he would do so. Despite two additional letters sent in June 2024, (one of them registered and not picked up,) requesting the money back, Mr. Jennings stopped responding. As of this date, July 11, 2024, no work has been performed on the house and no materials purchased, (as promised in the contract,) and the amount of $3622.50 paid by the homeowners has not been returned.

      We had a roofing job done that was left with enough exposed nails to fail an inspection. The owner was very rude and defensive during initial conversation but said he would come. After multiple calls and no-show ups, we decided to give up and get someone else to fix the work. This company was extremely unapologetic, rude and unprofessional. Not to mention lacks clear communication and organizational skills.

      ***** ******** owner of Zwicker roofing accepted and cashed a cheque I provided to him on December 3, 2022 in the amount of $6,986.25 (representing 50% of his quoted cost of replacing my roof). ***** ******** did not replace my roof, did not provide any materials to replace my roof and never began any work on my roof. Mr. ******** took my $6,986.25 and has not completed any work and, further, refuses to give me my money back. During October and November of 2022 ***** ******** and I continued our email communication. He contracted to replace my roof, sending an email with colour choices for my verification. On December 1, 2022 ***** ******** advised, via email, that he required a $6,986.25 deposit in order to complete my “booking”. He stated in an email of that date that the deposit was required to “complete the booking and be able to order material.” ***** ******** asked that I make the cheque “payable to ***** Jennings”. On December 3, 2022 I personally handed ***** ******** a cheque in the amount of $6,986.25. The cheque was deposited by ***** ******** into his account on December 8, 2022. Following ***** ******** depositing the cheque on December 8, 2022 I did not hear anything from him. Accordingly, on January 4, 2023 I emailed ***** ******** and asked for an estimate on when he would start my roof. On January 10, 2023 ***** ******** responded to this email stating that the weather “had been crap” and sending a screen shot of a weather app. On February 22, 2023 I again emailed ***** ******** to ask when he would be starting my roof. ***** ******** did not respond. Due to ***** ******** lack of email communication. I began a series of text messages to ***** ******** in April-June 2023. At no time during this period did ***** ******** start construction on my roof or return my deposit.

      CONTRACTED ZWICKER ROOFING - CONTACT RECIEVED VIA BBB. ZWICKER WAS CONTRACTED IN APRIL 2023 WITH A DEPOSIT OF $7000.00. AS OF OCTOBER 05, 2023 ZWICKER HAS NOT FULLFILLED THE CONTRACT. OWNER DAVID JENNINGS IS NOT ANSWERING CALLS, TEXT, OR EMAILS. ONLY REPLIES IS: "MY HOUSE IS NEXT" SINCE JULY 2023. LOOKING FOR FULL RETURN OF INSURANCE MONEY

      On June 17/18, 2022, I sent ***** ******** a deposit of $3,795.04 to shingle my roof and was told that the work would be done in the next 3-4 weeks. The work was never done and in October of 2022, I was offered a refund, but that was never given. I retained a lawyer, who asked Mr. ******** return the money. He first said he had sent a check that was never received, then agreed to drop the money off at their law office in the form of a check, but this was never delivered. Provided in the supporting document are the contract, all of the written interactions between Mr. ******** and myself and some additional information for contact. If you require follow-up, I can provide additional conversations between my lawyer and Mr. ******** and am more than happy to discuss further. The resolution I am seeking is for my money to be returned. Thank you very much.

      Buisness partner died, weather plays a huge roll in scheduling and ours has been crap. I was suppose to be at her lawyers friday and its monday. My daughter was removed from school as she ate a cookie containing peanuts and had to be rushed to hospital. We're booked for 2 yrs and trying to make us llok bad by filing a complaint instead of calling will literally accomplish nothing. I have yet to be to the bank to ensure the orginal "cheque" was not cashed (it was a certified cheque) sent to the address of the contract, not the address on this complaint. Possibly whoever lives there took it. Her partner, whom had nothing to do with anything started harassing me and eventually cancelled as starting the next day was not good enough for him. Prices of everything have jumped dramatically and the job was way under quoted, wed have done it. But honestly this situation is much better for us and will be happy to give her her money back. We just booked 270,000 dollars worth of work this mth. Have been busy and attempted to remedy this immediately by issuing the cheque. Cant control the postal service or if theres a shady tenant.

       I am rejecting this response because: Mr. ******** has yet to return my money. It is not possible to consider this complaint resolved until it has been returned to me. As much as I feel for the difficult time he went through losing his partner, that is no excuse for taking someone else’s money, then not providing the agreed to service. He offered me this refund in October - he has had plenty of time to make things right and chosen not to. Again, I request that he return my money to me. He knows the address of my lawyer’s office and can leave it there.
