      Contacted Joel Mar, 23 for job, & he provided a quote April 23, & advised start early May. He kept pushing the date out, but due to rain, I felt he could be behind. I did try several times to get a start date & each time he gave me a new appx date. June 10th I received an e-mail, with project date of June 16th/17th & requiring booking deposit of 2085.00, & wanted it e-transferred, which I paid. I did a lot of preparation work each time. My project didn't start & he provided many excuses. Contacted him July 17 again & on the phone he promised to show up on Sat July 24th PM, but did not., he didn't even call, to let me know. So July 18th, I sent him an e-mail to request return of my deposit & to terminate the project. My quote stated it would be VOID if start date of job is disrupted/delayed due to unforeseen circumstances. Mr has called & been ******** ******* & claims I have no right to request a timeframe for my refund. Mr also posting ********** projects, which are stock photos etc. **Update Sept 7/21** *********** *********** Sept 1 2021, I received another e-mail (attached) & a **** ********** phone call from Joel L. Joel needs to refund my deposit of 2085.00, but has yet to make any effort to pay me back. He keeps saying he never said he wouldn't give it back, but he also has not made any attempt to do so. He never did any work for me and I cancelled his services after more that two months of waiting. In his call to me, he was **************** and ******** at me because, I was trying to expose his use of ************, which he puts notes besides them on his Social Media, claiming he has just completed these projects in these photos and even providing local locations of the attached photos. He also ********** to post negative reviews on ****** against my business, which has nothing to do with his contract for cement work at my home. And he says he will continue until I remove this BBB complaint. He was so **** on the phone call, I finally asked him "why on earth did he even call me today", since it was almost two weeks after BBB had sent him this complaint. Joel knows that if he refunded my deposit, he could resolve this complaint, but he'd rather ******** his client or previous client, instead of doing what is right. I'd like to let others know how I've been treated by this Company, so they can possible avoid either losing their money too or not getting any work actually completed, in a timely manner. Attached is the recent e-mail from Joel,as well, to show how is tries to make threats to his client. Beware!!!! Additional information about Events, with Joel from Geneva Concrete & Epoxy. When I sent the email to Joel to request my deposit be refunded, and to terminate the project, as I could not longer wait to get my back yard fixed, he immediately called me and yelled at me for not being understanding of the whole contractor industry. He claimed he never promised me anything and was ***************e to me. He then called a second time the next day and left a message to say he was sorry for being so short tempered and for his behaviour, and did say if I wanted my deposit back that would be OK. But, by the end of the call he was trying to turn the situation all around again, and stating that he never promised me anything. Also that he was disheartened to learn that I was just reading the negative review and encourage me to read good reviews. Then he said he was actually going to come out to my home, today... but I heard that many times. He wanted me to let him know if still going to terminate the project or not. I did inform him that I no longer wanted to deal with him and to just get my deposit back. He said he would give it back, but only when he gets it and was unwilling to make any arrangements of amounts or times with me, to pay me back.. He subsequently left another message in my voice mail, and said he is not a ****** ***** where you can just go in and get your money back. He said when he gets money for the business, he uses it as he needs and was upset that I should think that my deposit be used for my project only. He also ********** me by stating it would be unwise for me to complain to the BBB, as I have a business of my own? I work as ***************************************. I of course have done nothing wrong, as far as my business, so this is an ****** ******* He also said that, I've done nothing nice for him lately. I just hired him for a project; I don't need to do anything nice for him. On this same message, he claims that I knew he was only a small business owner, so what did I expect. The problem with that statement is that he has placed many *********** photos both in his Gallery, on his website, but also on ********* & ********** noting on Social Media that these are his actual projects and even giving locations where the work was completed, which makes him look like a big company, not a small one. ************************** He said that if I expect him to take money from other clients to give it back to me, that would be just unheard of, but that is obviously what he did with my deposit. Even in his request for the deposit payment, two weeks prior to the start of construction, for good faith, is stated that it allows him to prepare for upcoming work by ordering materials, delivers and project requirements. So my deposit should have only been used for my project. I'm sorry for so many detail, but this has become a real issue, and I would really appreciate your assistance with trying to get my deposit back. Contact Phone: XXXXXXXXXX Contact Email: *****@**************.ca We as a business made every possible concession to meet *******'s demands. Myself, and my office clerk, Kylee, were bombared daily by emails and phone calls by ******* demanding to know are every move and whereabouts. Whe as a company had several delays this year due to weather, labour shortages, and material shortages, and of course Covid. We explained this to ******* multiple times and were forthcoming and honest about the situation from the beginning. We also explained that we would not be raising the cost of her project even though the cost was rising for us as a company. I explained all of this to ******* to no prevail with little to no sympathy. I am saddened that it has come to this and I want to be able to come to some sort of resolution without being ******** by *******. The agreement that ******* signed for our services that were suppose to be rendered has a clause at the bottom for a minimum booking deposit of 30%. All of our quotes say this at the bottom. ******* was fully aware of this when she signed the agreement and moved forward with us. Futhermore, there is a seocnd clause that speaks to the length of time from when the contract was signed to when the work was to be started and this time has elapsed long before we were to start. Our policy is that this booking deposit is non-refundable, and our policy dictates that we recieve this booking deposit in order to put you into our very busy schedule throughout the summer. This was all explained to ******* via email and phone. I spent many nights doiscussing her project with her to ease her mind. I understand she would like her money back and I explained that I would be willing to work with her on this manner even though we typically don't return booking deposits, however I asked for 7-10 business days to coordinate the return and this was unacceptable to *******. I have contacted ******* on several different occasions to work out some sort of resolution but havent had any success whatsoever. My fear now is that she is just going to continue ********** my company with no justification. The last phone call I had with ******* was asking her to remove the review so I could send her money back. She replied with "return my money and I will remove the review". I dont have time to play these types of games without any guarantee that she will remove this review. I just want to come to some sort of resolution without getting ********* by someone who knows little to nothing of our workmanship and quality of work, and for work we never even got to start. She also is proclaiming and making ***** *********** about my business, websites and social media pages. I have explained to her that everything illustrated on our website, shows clearly and conscisely the services we provide as a business and we would not post photos of things that are inaccurate like she is claiming. This isnt fair to me as a small business owner trying to manage thru this extremely difficult time. She was difficult to work with from the beginning and when she did not get what she wanted, she attacked me on the Better Business bureau with ***** ***********. Id like to be able to deal with this with ******* directly but everytime I contact her, she ends up ******** ********* my company. I'm very willing to resolve this issue, with Geneva Concrete, by having my deposit refunded to me. My deposit was paid way back, on June 10th and this Complaint can be resolved by simply giving me back my initial deposit, on a project that Geneva Concrete never started. My Response to Geneva Concrete's latest Submission**** Three phone message transcripts are added to my response, to show my difficulties in dealing with Geneva, once I had cancelled this project, due to my project not ever being started, over two and a half month period of waiting... Most of Geneva Concrete's responses to my Complaint are not true. No concessions were made to me and my only request was to have him show up and do the work he was contracted for & then requesting he refund of my deposit back, as he never showed up. His phone messages say "Thanks for being patient. I was very understanding of the weather in the spring or I would not have waited till July to terminate this project. I did contact them often, as they gave me several different timelines for my project and then would not hear from them. I was very nice to his office clerk, just asking to leave a message or if I could speak to Joel. Joel never discussed increasing costs & why would he, he did not work for me. He only caused me to work very hard in preparing my backyard for each time he said he would come, which is mentioned in his first phone message. Nor did Joel spend many nights discussing my project, only when pushing my start date out. Dealings with Joel only became an issue for him, when I e-mailed to canceled my job, after waiting all day for him to come. I decided to not deal with Geneva at that point and requested my deposit back. The 30 % deposit clause in his contract "says it's required to start construction" & nothing is mention about not being non-refundable at all, as he claims. Also, the contract only says that if date of job is disrupted or delayed due to unforeseen/uncontrollable circumstances, it would be rendered VOID., such is the case, as he never started my project and kept pushing it out. delayed in any timely manner. So the real issue is the deposit needs to be refunded, to me. In his phone messages, he said several times that if I still wanted my money back, that would be OK. Joel, did not work with me on paying me back or be willing to set up a actual arrangement. Nor has he contacted me on several occasions to discuss, he only contacted me and ****** at me, etc. when he finally got around to reading the BBB complaint. He insisted that I cancel the BBB complaint if I wanted my deposit back, but I told him I would cancel it if he did pay me back, first. I was never difficult with ****, as he notes in his phone messages, "I was patient," until I could not wait any longer. He also apologized for loosing his temper the day I made my cancellation. With regard to the ***** Photo issues, I would not have a problem with a company using ************ for the overall design of websites and social media. The issue is showing these in the company's Gallery, so as to make the viewer think these are actual jobs completed by the Company. Also on Social Media sites, with the ********** posting of claims in the Captions accompanying the photos, that he has completed the project and even in Specific local locations, which of course are untrue & misleading. This did lead me to think he was a larger company, who could take on my project, in a timely manner. Since Geneva Concrete didn't fulfill their contract with me, and keeps claiming that they haven't ever said they wouldn't give me my deposit back, this all can be settled by just providing the deposit refund back to me. This will keep Geneva in good standing as a company.
