In January, 2023 I put a deposit of $100 towards a kitchen island priced at $1000. After 2 months of continual communication, Brampton Kitchens finally agreed to locate 2 pallets and put the cabinets on the pallets for shipping. Then another month passed before I was able to locate a shipper who would handle the 10 foot long stone counter top, plus the 2 pallets of cabinets. So I then called Jaspreet at Brampton Kitchens to arrange final payment of the remaining balance of $900 and was informed that the kitchen island had been sold 2 weeks previously to some other customer. I was not notified prior to this sale and it was sold out from under me, despite my deposit. I was never informed that there was a deadline to complete the sale. I would like Brampton Kitchen to make good on their promise to sell me the island as we agreed. They will need to retrieve it from wherever it has been shipped to in the meantime. They have offered to return my deposit, but I want them to complete the sale to me and prepare the island for my shipper so I can arrange to pick it up.

      To whom it may concern,

January we listed the showroom display Island & Kitchen for sale on ****** as we were putting in a new kitchen and we needed this gone as soon as possible. ******* ****** contacted us and offered to purchase the island only for $1000.00 (pick up only) and we agreed. We explained to him that we need it gone as we are putting in a new kitchen and don’t have space to keep it. ******* sent us an e-transfer deposit on Feb 11, 2023 and mentioned he will let us know which date he can have it picked up and shipped to where he is.

Feb 28 he mentioned he is still trying to locate pallets and figuring our shipping details. On March 1 we asked him status of him arranging shipping and again he mention that he will be sending shipping company to us now. We asked him to pay the full balance so we can disassemble the island and have it ready for pick up. Then we didn’t hear from him from in till May 11th 2023. We did call him in April and left him a voicemail stating that we have other interested buyers however we never got any response from him. When he called on May 11th, we advised him we sold it to another customer as we never heard from him over 2 months and he knew we needed to move it out of our showroom. We offered to sell him another island however he said no. We advised him we have returned his deposit of $100 back to his email and he can accept it, however he never did.

This was our response to ******* via email on May 13, 2023:
“This was a verbal contract. We had listed this island for sale as we needed to clear our showroom for a new kitchen that was mentioned to you.  Every day the island is on the floor is costing us money, you understood it was a product that need it to be moved and this product was first come first serve as it needed to go and you sent us $100 but there was no commitment made to hold it for over 4 months. By holding it this long, we were suffering losses so we had to sell it. After you made a payment of $100, it was understood that you would arrange shipping in the next few days and we would have it ready for pick up but that never happened. You were unable to locate two pallets as per your emails and verbal conversations with us, which is why a goodwill gesture was offered by us to source them for you. There was zero delay from our end, instead we helped in any way we could to expedite this process, hence why the island price was extremely low. This transaction was supposed to be purchased and shipped in a reasonable time frame, however that never happened. There was no commitment made to hold this island over 4 months especially since we are suffering losses by holding it. We have given you an alternative solution to purchase a similar island which you have refused.”

We still want to return his deposit of $100 if the client accepts. Let us know if you require any further information. Thank you.

      Sincerely,

      Padam T.
