      We hired Angelo D. of Delbro Landscaping to plant trees on our property on two occasions in Nov 9 2020 and April 13 2021. He gave a one year written warrantee "As for the warranty, I'm offering you a 1 year replacement from the time of installment" (email Nov 23, 2020 7:14 PM). We contracted him Nov 9, 2020 Contract #*** ($16210.25), in which he planted 15 trees and in April 2021 Contract #*** (9790.14). After he planted the trees, we followed all his recommendations for feeding, watering and wrapping the trees for winter as he directed. Unfortunately, we had to contact him on Aug 31, 2021 asking him to come look at trees from both the Nov 2020 and April 2021 plantings as some did not look healthy to us. When he came out to our property at the end of Sept 2021, we showed him 8 trees that were completely brown and 2 other trees that were mostly brown. We expressed that the 8 trees looked dead and the other 2 looked to be dying. We had to followup multiple times with him to try to receive his response. We even took a video of a completely dead branch snapping to send to him as he stated he was trying to deal with the nursery. We are writing to BBB as he has not honoured his written commitment and we now have 10 dead trees on our property.

      Business Response /* (1000, 5, 2022/01/04) */ ***** contacted and hired my company to supply and install Black cedars and Hemlocks. Contract #*** & ***, I provided healthy full Black Cedars & Hemlocks from a nursery that I purchase all my plants/shrubs from, *************************. I also mentioned to ***** that they would have to pay attention to the newly planted cedars as there are many older shrubs and trees thats will make it harder for the cedars to take. I provided ***** with a 1 year warranty on the first contract #*** dated on Nov 9th, 2020 via email for that contract. I told ***** that these cedars will need plant food (root booster) and or any other plant food ************. When I was contacted for a site visit due to some cedars not looking to heathy, I had asked ***** and her husband **** if they given the cedars root booster, there response to me was a laugh and "NO that wouldn't work". All newly planted shrubs or plants require plant food after being transplanted from a nursery to your home is what I had mentioned to them. Warranty was issued for the first contract #*** and not the second contract #***. I have pictures showing that all cedars were not covered before the first snow fall this year 2021 and poorly covered there after. This will result to damaging the root system of the cedars. For this reason I emailed ***** that warranty will be voided due to improper care of there cedars. I also have an email from ***** dated Oct 7th, 2021 "We are sure that this is a nursery problem, so hope they they have confirmed that they will replace the 10". My company didn't provide ***** with a written warranty for the contract #***. Cedars planted with contract #*** still had colour and life in them. Consumer Response /* (3000, 8, 2022/01/15) */ (The consumer indicated he/she DID NOT accept the response from the business.) There are unfortunately, erroneous statements made by the company. NOT all of the cedars planted with contract #*** had colour and life in them. Two of them were brown and dead on Angelo's visit to our house. He had provided a one year guarantee for contract #*** and in the absence of a written withdrawal, it would be presumed that the same conditions apply to ongoing business with the same company based on precedent. The industry standard, having contacted a number of other companies, is one year guarantee on trees. Hence anything less than that would be sub-standard business. 8 of 20 cedars planted on contract #*** are dead and brown. We 1) DID/HAVE wrapped all new trees the first year of planting, 2) we DID feed and water them as directed by the company, and 3) we DID apply root booster to dead brown trees as directed by the company. We are requesting fair and honest treatment from this business, with a refund from the company for the 10 of the 30 trees (33%) the company planted dying within 1 year of planting. ******************************************************************************************************************. Business Response /* (4000, 10, 2022/01/18) */ Warranty was issued via email to the client ***** for contract #*** dated Nov 9th 2020. No warranty was issued for the second contract #*** dated April 13th, 2021. A warranty can not be presumed to be an ongoing condition per contract unless it was offered in writing. On my visit to the clients house 2 of the 10 tress were brown but still had a good chance. I had broken a branch and it still showed colour, I asked if root booster was given or any other plant food and the response given from the client (s) was a laugh and said we're doctors and I'm sure that would not work, "No we will not give root booster to the cedars". 8 of the other cedars were not full brown, they still had green colour in most of the trees. The clients didn't show that they cared properly for the cedars, they didn't give root booster, not enough water was given ***************************** (ground was very dry, no other plant food was given, cedars were not covered well before the first snow fall ***************************************. A refund of 10 cedars isn't fair at all when 2 of the 10 cedars were brown, 8 cedars still had colour, more green than brown as the client mentioned the their response. I provided healthy green full cedars and planted them for the client and the client saw all the cedars before planting. After the cedars are planted its up to the client to properly care for the cedars. I didn't plant nor will I plant anything that doesn't look like it will survive. All cedars that I provided were full, green and healthy. ***************************************. All cedars were provided and planted in full green and all healthy. Your refund request of 33% of 10 cedars isn't fair at all, knowing that only 2 of the 10 cedars were brown. Consumer Response /* (4200, 12, 2022/01/30) */ (The consumer indicated he/she DID NOT accept the response from the business.) 10 of 30 trees planted by the company died within 1 year, despite the fact that we followed all of the company's instructions. The facts are being mis-represented by the company as we have previously stated hence we will not restate them here. By refusing to refund the dead trees, the company has failed to honour their warranty. Business Response /* (4000, 14, 2022/02/03) */ As I clearly stated in all my responses to the client (s) also providing enough pictures of before and after pictures, of planting the cedars that all cedars provided from the company to the client (s) were all green, full and healthy. The client (s) didn't burlap each cedar well enough before the first snow fall as shown in pictures and did mention to me on our site visit that they didn't and will not give the cedars root booster. Cedars were damaged by the client (s) due to the fact that they didn't follow watering, plant food and burlap instructions. The facts that "I" the company stated in all responses weren't mis-represented. I will not refund the client (s) 10 cedars out of 30 when the client (s) clearly stated that 2 of the 10 cedars were brown. I will not provide a refund due to the facts of the client (s) negligence.
