I reached out to Lindsey J***** to inquire about a Watercolour Sleeve Tattoo. On September 23, I paid a $180 consultation fee and attended the consultation on September 26. During the consultation, we discussed the tattoo details, including a left-arm Watercolour sleeve featuring four flowers (for which I provided outlines), an abstract sunset at the wrist, vertical lines from the left shoulder to the wrist, and a watercolour style. Ms. J***** mentioned that it would likely take two, maybe two and a half appointments to complete the sleeve, and she charges a day rate total of $1921.00. First appt: Sept 29, 2023. By 11 am, Ms. J***** applied four flower stencils and freehand lines around my wrist were applied. The tattooing involved black ink flowers, black ink on the wrist for the bottom of the sunset, and shades of blue on half of my wrist in a watercolour style. The session concluded at 2:40 pm, and I paid $1751.50. (A reduced fee due to her being on a call.) Second appt Oct 25, 2023. This session involved adding straight lines to correct the water portion of the sunset and additional blue inks. Although I didn't capture photos at the beginning of this appointment, tattooing ended at 2:45 pm, and I paid $1921.00. Despite paying for a watercolour sleeve tattoo, I feel dissatisfied with the outcome. The day rate charging model has left me with no recourse, as the artist can work at their own pace, compelling clients to book additional sessions. I chose not to schedule more sessions, as paying $4702.50 for a sleeve tattoo, considering the approximately 7 hours of actual tattooing done, was excessive. I was unaware that the appts are recorded, but this video could verify the actual time spent tattooing. Breakdown of the payments: September 23, 2023: $180.00 (consultation) September 26, 2023: $850.00 (deposit) September 29, 2023: $1751.50 (first appt) October 25, 2023: $1921.00 (second appt) November 12, 203: $850.00 (returned) Total cost: $3852.00

I am rejecting this response because:

I believed she would complete the work I paid for, in the time she said it would take. As the professional, I had to trust she was operating in good faith.

      Ms. J***** was paid $3852 to provide a watercolour sleeve tattoo.  * **** ******** *** ****** ** ** ******* which is 1/4 complete. * ******** *** **** ***** ******** ** ** ******** **********

After two "full days" of tattooing, it was clear that Ms. J***** worked at a pace that would force me into booking additional appointments, costing $1921.00 per day, or approximately $450.00 per hour.

Our email exchange began after my second appointment on Oct 25.

Aside from not receiving what I paid for, Ms. J*****’s response on Nov 10 states that she has video recordings of my tattoo sessions. I would like to see where she made me aware that she would be recording the sessions. Perhaps I signed consent when I arrived, but I cannot remember doing so. The recordings would provide proof of the actual time she provided the tattoo services.

This is a portion of the email I received from Ms. J***** on Nov 10:
"At the end of the ?rst appointment, you said you were happy, you loved everything. Now, I've watched videos of both your appointments, and you never once said you didn't like something, weren't sure of something, or wanted something changed. You were asked multiple times before starting if everything was ok, and ready to start and you said yes. .....I cannot o?er you a refund, but I am more than happy and truly want to keep working on your tattoo. If you would like to ful?l the remaining balance of your deposit by coming in to work on your tattoo, I'm happy to provide you with some free time to get done what we can. Your deposit will cover you for a little over 2 hours, I would match you an additional 2 hours of complimentary time."

This is part of my email response on Nov 11.
This is literally all I’ve thought about. *** * ******* **** *** **** ****** *** ****** * ****** **** ******** ** **** ***** ****** **** ******* ******* *** **** ****** ** ** ** *** ** ***** *** ***** ***** **** **** ***** **** *** *** ****** ****** Do you feel ok about taking $4200 for what is now on my arm forever? You are going to feel proud when I share my tattoo with m family and friends, post it to my socials, you are going to be 100% comfortable with that knowing how truly disappointed I am in what’s been done and how you are o?ering 2 hours worth my $850 and you are willing to ‘gift’ me two hours. That all sits ok with you? What also makes me sad is that I truly enjoyed talking with you, and I really like you as a person. So as someo who was becoming a friend to care so little about the impact on my life. That really is the biggest disappointment.

      Nov 11 she replied
"Hey *******, As an artist yourself, I would expect you would have the same mutual respect to other graphic design artists and wouldn't rip offtheir work at a client's request?"

My response: "This is going nowhere. You’ve made your decision. And so have I."

I received an e-transfer refund of $850 on Nov 12, which I had paid to Ms. J***** on September 26.

She stated that my $850 deposit would cover "a little over 2 hours", and she would "gift" me two hours of complimentary time. If I believed five more hours would have resulted in a completed sleeve, I would have agreed to continue. Given that I had already been at 2 "full day" appointments and 1/4 of the tattoo was complete, there was no way I would have gotten the sleeve I paid for. I would still be in a position to be forced into paying more to complete my tattoo.

If Ms. J***** feels she provided a service equal to the payment she received, I would like to contact other Tattoo artists in the area and enquire as to the amount that they would have charged for the work I have received.

I want to be compensated for the difference.

      Sincerely,
      ******* *** *****

I paid $180 to book a consultation for a tattoo with Lindsay the owner and sent 2 reference photos of what I wanted. We had a zoom meet on May 5th when she informed me she charges a design fee. I was not aware of this when I paid her to book my consultation and it is not stated on her website. She presented 3 options. I chose the least expensive. I then paid her another $1695 for design fee and $1000 to book tattoo date. On May 8th she sent me the design and it looked nothing like the photos I sent her. She told me I would need to pay for option 2 design fee if I wanted another design, asked for another $2260. I told her that since she didn’t take my photos into account when designing the sketch I didn’t feel I should have to pay again. After emailing back and forth about it she informed me there had been a fourth option of not paying a design fee. She did not inform me of that option when she sprung the design fees on me. She refuses to refund me even partially and has stopped replying to my emails requesting a resolution.

I have no problem working with this client to come to a mutually beneficial resolution. There are not any emails I have not responded to, I'm happy to communicate with her by email.

I am rejecting this response because:while she did reply to emails, her reply was an outright refusal to refund any portion and lack of accountability.

This client stated that I had not responded to any emails in her initial complaint, in her response, she states that I had responded to emails. There is clearly a discrepancy in facts here. I am happy to come to a mutually beneficial resolution with this client via email.
