      1. I signed an agreement with Pave It Paving Inc on 17th Sept, 2020. 2. Copy of the agreement/Invoice Number BN# XXXXX XXXX ************ 3. The agreement was signed by Mr. ******* on behalf of his company Pave It Paving Inc. 4. According to the agreement 3 inch of hot Asphalt was supposed to be laid on my driveway 145 feet x 10 feet. 5. The amount agreed as per agreement/invoice was $5000 for the entire work. 6. 40% was agreed to be paid when crushed stone layer was to be laid prior to laying the Asphalt. 7. It was verbally agreed that the work should be completed before the winter (i.e., before of by December, 2020). I explained my hardships that are faced due to existing gravel driveway during the winter and is the reason for getting the Asphalt laid ASAP and before the winter. 8. After the agreement was signed on 17th Sept, 2020 we kept waiting and calling Mr. ******* who kept giving us dates after dates for start of the work under excuse that he is awfully busy. For some of the calls he never bothered to return. 9. After several calls to Mr. ******* and leaving messages with the company we eventually got the gravel work done on 11th November, 2020 with a promise that the asphalt will be laid before the winter starts (i.e. before December, 2020 but no fixed date provided). 10. A check of $2000 (being 40% of agreement amount) was handed over as advance the same day and as per agreement after laying of gravel was completed with a promise to complete the asphalt laying in the next couple weeks. 11. After 2 weeks, when nobody contacted us, we started calling back as the winter was fast approaching. 11. Again under the same excuse we are given dates after dates and eventually Mr. ******* regretted that he can't do it and will have to leave the remaining job to be completed soon after the winter mean any time after April, 2021. 12. End of April, 2021 we started calling to get a date for getting the remaining work done but without success. 13. During this time laps and due to heavy rain the gravel washed away leaving potholes for us to fill several time. Once I had to pay over $150 to get the gravel pushed back on the driveway which was washed away by the rain and was sitting at the bottom of the driveway. The driveway is still very bumpy and needing more and more work to keep the gravel in place due to occasional rains. 13. So much so that on 15th Sept, 2021 when once I got a hold of Mr. ******* over the phone he blankly refused to complete the work as according to him I'm insisting too hard for a set date to complete the job. 14. On the same day, I contacted Mr. **** ******* who told me that he is the owner of the company and explained him the situation. He said he will call back in 1 hour after fixing the problem but he never called. 15. The following day I wrote an email to the company summing up the whole situation in brief. 16. I got a reply from Mr. ******* in which he demanded raising the price for the job. The advance amount of $2000 which was 40% is now considered as 30% and remaining balance 70% is further to be paid. ******************************************* 17. He also demanded that the balance amount has to be paid in advance and before start of the work through a bank draft. 18. He further demanded that if he does the job he will only inform the night before he intended to work which is a problem for me being too short a notice for me to manage parking of my 4 cars for the next few days and until the Asphalt becomes hardened enough and drivable. My concerns are: 1. Since Mr. ******* is wholly and solely responsible for breach of contract, raising the price is totally unjustified, unfair and unacceptable. 2. Even if he agrees to do the job accordingly to the agreed upon and quoted price, having had such a bad experience with Mr. ******* of Pave It Paving Inc, I cannot trust him for handing over the full amount before the job is done. 3. We still don't know when and if ever, will he do the remaining work and will he still do it honestly and the work quality will remain up to the mark and that he will not screw it up. 4. Informing night before start of work will not work for me as I have a 145 feet long driveway with 11% ramp and the only way for my 4 cars to go in/out from my parking. We will have to arrange to leave the cars with the neighbors but that again requires heads up time. If we get the Asphalt laid it would require 3-5 days not to be used to get a good hard surface. What we want now : Since there is a breach of contract on several occasions and the kind of service we have got so far and for new conditions set forth for completion of the job we are now not comfortable and trusting to go ahead with this company even if they can do it for the initially agreed upon price and prefer to get the advance money ($2000) back ASAP and to get the work done through some other company.

The date for contract and price is correct as for the date of completion it was always 2021 and after you would have some landscaping done. Your call to proceed with completion did not come in till June 2021 at which time you had told me that you would no longer be getting shoulder course done. Because of the grade at your home we needed all hands on deck to deal with the slope. Unfortunately the summer passed us by and COVID didn't help, we were short staffed, men off due to quarantine, sprinkle in some equipment failure and backordered parts to fix things and lets not forget weather factors. We do our best to keep all of our customers happy and when we last had a phone conversation I explained our turbulent season and had assured you I would be coming the following week to complete your job. That was not good enough for you and you asked if I had a firm day of the week that could not be provided at that time and I let you know that I would confirm the day before which is standard scheduling procedure for us other than commercial work. You started dictating how you wanted me to complete your job after pleading some time with you I felt we could not complete the job on your terms and told you to look for another paving contractor. That enraged you and you were *********** me if I did not complete it. Probably why I am sitting here responding to nonsense. You received the grading work that you paid for we also supplied and graded 2 triaxle loads of 3/4 crush run. In regards to my responding email to you the prepaid before we do your job is correct the 70 balance was a clerical error and your balance is 60% $3000 I was not trying to raise your price. Regrettably you feel this way but in my opinion you received what you paid for and I rather not do any more work for you considering the communication we have had. Once I had to pay over $150 to get the gravel pushed back on the driveway which was washed away by the rain and was sitting at the bottom of the driveway. The driveway is still very bumpy and needing more and more work to keep the gravel in place due to occasional rains and traffic. So much so that on 15th Sept, 2021 when once I got a hold of Mr. ******* over the phone he blankly refused to complete the work as according to him I'm insisting too hard for a set date to complete the job. Never even once he mentioned any disability of completing the job due to the pandemic effect but keep iterating "he is too busy". ******************************************************************************************************************************************************************************************************************** Looking at the time being taken to reply to my complaint with the BBB, Mr. ******* again trying to be very smart not showing promptness and utilizing his maximum days to reply so that the matter can be delayed as much as possible as he did it before and he succeeded again as we are now sitting in the winter of 2021/2022. There seems no responsible person in this company who could have taken the matter in his hand rather than leaving it on to the person who has already messed it up and keep on doing the same. For Mr. *******, a complaint from a customer is a "non-sense" as he mentioned in his reply and not keeping his written commitment is just fine. This tells a lot about the person and the company and the business practices that it follows. I signed an agreement for Asphalt laying and NOT for grading. I don't know what a 2 triaxle loads of 3/4 crush run is but it sounds like to justify my advance of $2000 that was paid for laying of Asphalt. The driveway already had gravel on it and needed uneven and potholes be filled. It would have not required too much of the gravel to bring it to the position when Paveit worked on it a year ago. Moreover the gravel that was done last year by Paveit has developed potholes again due to rains and traffic which was fixed few months back at my own expense. Since Mr. ******* of M/S Paveit has already denied to complete the work I demand refund of $2000 paid as an advance for laying of Asphalt to be refunded in full and ASAP so that I can get the job done by some reasonable company as a lot of my time has already been wasted and as I have faced a lot of hardships already and more to face in the coming days until the driveway is Asphalted. Not doing so is a breach of agreement and will be dealt accordingly.
