I purchased a 2022 Hyundai Kona from Hawkesbury Hyundai at the beginning of June 2021. My wife and I had dealt with that dealership before. When the salesperson ****** ***** came to our house to discuss the purchase a few days before, I had requested four brand new winter tires and rims free of charge. Right away, ****** contacted someone from the dealership over the phone to see if this was doable. He said, "Done." I decided to buy the car and provided my banking information. When ****** delivered my new Kona, he had me sign the paperwork. The payments were to start in a little while, so I set everything aside. After a couple of weeks, I looked at the papers to see exactly when the payments would start. That's when I noticed that a $1,000 charge had been added for 4 winter tires and rims. Right away, I called ****** to ask him about it. He said it was normal and that this was for insurance purposes. He said that if we got the tires stolen, we'd need proof for the insurance company that we had these tires. Then, he proceeded to tell me that it was taken out from the amount. When I told him we didn't see that anywhere, he said he would come over and explain it. A couple of days later, he comes over, and my wife and I met him outside. He then said it was for the insurance and that nothing in life was free. He asked us if we were happy with the payments. We said we were ok with them but would have preferred not to pay for tires and rims we were supposed to get for free. He said that the only thing that mattered was that we were ok with the payments. Come end of August, I noticed no payments had gone through. I found out that Scotia Bank was unable to process the payments in August 2021 as scheduled because Hawkesbury Hyundai had given the lender the wrong banking information, i.e., my old baking information they had kept on file, which affected my credit rating. I want my credit corrected and a reimbursement of $1,000 plus all interest for the tires and rims.Business response

Good afternoon,
On May 27th 2021 Mr ********* purchase a 2022 Hyundai Kona from Hawkesbury Hyundai. He met with one our sales rep ***** ***** where they agreed on price and financing terms. Once the vehicle discovery and price discussion was completed a sales contract was signed by the customer with the agreed terms and conditions. In this agreement ** ******** asked for 4 winter tires and rims. ** ******** states that the winter tires and rims should have been at no charge but yet signed the bill of sale which clearly shows the charge of $1000 plus taxes. ** ******** also states that our finance manager did provide the bank with the proper banking info to take out his new monthly payments. He says that the bank did not take any payments for the following 3 months. he blames our financing department for not providing the proper info to the bank. He says that the financing department should have asked for a new void cheque since he had changed banks 4 years prior to purchasing this new vehicle. even though ** ******** new he had changed financial institution and new that the info was wrong he did not advise my financing department of these changes. after having not providing any financing information and after a month went by and no payment was being taken from the his bank account. He choose to wait 3 months before calling someone to find out what was happening. At this point the financial institution holding his finance contract sent him a letter and only then did he realized maybe he should be making payments on this new car.
** ******** is claiming full reimboursment for the tires he signed for on his bill of $1000 plus the interest he paid on the $1000 at 3.38% which adds up to $33.80. He also claims dammages for his credit being affected by the 3 months where he was late on his payments.
i contacted ** ******** and explained to him that his business was very important to us and that even though he had signed a bill of sales that clear states " this agreement is final sale, please review the entire contract, including all attached statement. this contract is final and binding once i have signed it unless the motor vehicle has failed to comply with certain legal obligations. No other terms promises or terms have been made to me that are not part of this contract ". I offered in good faith to refund his $1000 for tires plus the taxes of $148.90 plus the $33,80 of interest. I also offered to provide him with a letter and explaining to the credit bureau that this could have been an oversight from our financing department. this letter might help to dispute the negative impact he states he has on his credit bureau.
** ******** refused my offered and wishes to proceed with legal recourse. Our offered to reimbourse him $1182.70 still stands and our offer to provide him with a letter for the credit bureau also stands.
