• On May 26, 2023, ***** ****** deposited our 30% deposit ($13,390.80) in an agreement to provide us with a 3-D professional plan (detailing the layout of the new stairs, the retaining wall design, privacy fence and overall dimensions and structure of new deck) and to complete work by end of June 2023. • After my follow up call to him on June 14, he committed to giving us the plan by June 16. • June 16 - no plan was provided; he dropped off stone on our driveway without any mention in advance and no provision of a plan or agreement that this was the final stone to be used (no reference to colour on the estimate, we didn't agree to this colour) • June 17 - we called ***** and he said the plan would be provided "this week" and we would be very happy with it. He said he would call prior to bringing the plan so we could ensure we were home to review it together so it could be finalized and work start shortly thereafter. • June 28 - 1.5 weeks following our call and your commitment to providing us with the plan, we called again to check status. He was terse and told us he was dealing with several issues with his crew and heat and person who does the plan was not well and needed more time. No timeline was provided except for "soon" and that he was 1.5 weeks behind schedule. • On July 20 - We called again and asked when the plan was coming, he indicated he would call us that night with the details of schedule and bring the plan. I did not receive a call that evening. • July 21, we called to check status and he confirmed the plan would be dropped off by Sunday night (July 23) and work would start Thursday (which he hadn't told us about at all). I reiterated that no work could start until the plan was provided. • No effort has been made on his part to provide us with this plan, and he has consistently made excuses for why the plan cannot be provided yet and missed the last two deadlines (Sunday July 24 eod and 1pm July 25). • Recent timeline indicated work start of Thursday July 27 (which we only found out when we called you to ask about the plan), however, no preparation or plan provided in lead up to this date suggesting this is an unrealistic target meant to defer any follow up on our part. We sent ***** two emails telling him he has breached our agreement, and asking for the return of our deposit in full. He has not responded. All we want is our deposit back and to not have to work with ***** anymore.
