      I bid on an “as Is” appliance which was reported to have and showed in the picture, a dent in one of the corners. I won that auction. Lot number ********, invoice *****. Upon receipt of the item, January 26, 2024, the item was as described, plugged the appliance in, and the unit would not power on. Auction Mongers omitted this detail in the sale description. Reported same to company, January 26 2024, email, they replied the unit was sold on an as is basis without warranty. I emailed them, pointing out the unit auction listing in description deceptively omitted the mention of not working and they replied “This Item is sold AS-IS. No guarantee on condition or function.“ No mention of the unit being dead, non functional, will not power on. The product LISTING, does not state “This Item is sold AS-IS. No guarantee on condition or function.“ Refer to the online auction listing, under terms and conditions, the As Is clause is also not included here. A person much search their website to locate the As Is clause. This is not an issue of buyer remorse, this is clearly a matter of deception on the part of Auction Mongers, who, I have bought from previously without issue.       We are sorry to hear about the issue you recently experienced with your purchase.
      Unfortunately, the item was clearly marked and listed under "AS IS" condition which might include being unfunctional or missing parts. We do offer 10 days guarantee for all items that are listed as New, Open Box, or Used but there is no warranty on the "AS IS" items.

      I won an auction item from their platform on November 23. I believed to have won a *** *** Soundbar with Subwoofer. Unfortunately, I *** ********* **** **** ***** *** was unable to inspect the item for 10 days. When I was able to inspect the item, I found out the item was the wrong item. I filed a claim through their website to be denied even though they gave me the wrong item.

      Good morning,

      Our terms and conditions clearly states that the items must be picked within 10 days after winning the bid and the same is indicated on every page of the invoice the customer receives after the auction.

      We tried reaching out to the customer to schedule his pickup within the 10 days period and offered him the shipping option. We also guarantee our products and offer a warranty if a claim received within 10 days of receiving the items (which is also stated in our terms and conditions).

      Despite failing to follow our terms and conditions, we still tried all possible means to help the customer resolve the issue.

      And more importantly, the customer already received a FULL refund of his purchase on 28Dec2023.

      I am rejecting this response because:

      While I understand they have a 10 day guarantee refund policy, that does not excuse the fact that they were not willing to originally refund me my purchase even though it was the wrong item. Additionally, they did not attempt to follow-up with me at all during or after the 10 day period. Their attempt at following up with me was the STANDARD AUTOMATED e-mail that is sent out after the auction period has concluded. I followed up with them when I was able to on December 11th, 2023, where I explained my situation regarding the item, and that I would like a refund and they denied my claim outright because it was past the 10 day period. I to filed another claim to further explain the situation and they responded by saying that they already denied my claim and further emails will be ignored.

      The only reason I received a refund was because I had to escalate the situation through my credit card company to dispute the transaction on December 19th, 2023. They opened a dispute at that point, providing the business 30 days to respond to the dispute claim and at this stage, I received a reversal on the transaction. A few weeks later, they charged my credit card again for the same amount without my authorization or knowledge (I only noticed when checking my credit card statement). I called my credit card company again to dispute the transaction and they stated that the business has not responded to the original dispute but charged my card again. I disputed the second charge on my card and had to cancel it to avoid another unauthorized charge.

      They were extremely uncooperative during this entire situation. **** ******* **** ***** ****** *** ******** ***** ** **** *** ******** ******* *** ****** *** **** *** ******* ** **** I am responding to refute the statements they made.

      I won and paid for items from an auction under Auction Mongers held from sep 29 to oct 3 (Invoice Number: ******Lot Number: ********). The lot was ************ described as "********** Belmont Conversation Chairs, includes 2 chairs, 1 loveseat, & 7 cushions, Blue like-new Some Screws Replaced/Chairs measure 30.6 in. W x 29.8 in. D x 32.6 in. H/Loveseat measures 51.9 in. W x 29.8 in. D x 32.6 in. H" Upon inspection, it was missing one chair and included a glass for a missing table. I filed a complaint with the company hoping that the other items were just left behind when I picked them up and was willing to go back to retrieve them. The response from the company was" Good Afternoon ********, After a careful review of your claim, We found this item was sold on October 4th, 2023. Auction 209. As per our policies, terms & conditions, The guarantee period for your item has passed. Our policy is 10 days guarantee from the Auction Day. Your claim cannot be processed." The company was trying to hide behind the terms and conditions which they violated from the start and was moot in the first place as it was ************ advertised. Instead of coming to a resolution, this company just brushed me off.

      I registered for an auction on Sunday evening and have used an incorrect credit card. Used my USD credit card instead of my CAD credit card. I emailed them Sunday evening and twice on Monday morning without a response. I also, telephoned Monday around noon as I explained to them that I do not want to incur any foreign transaction and bank fees.. Their customer service rep said I must submit a form online which I did and have received a response saying that they cannot change the transaction as it already been billed. That response is illogical, as any business is capable of reversing and re-charging the transaction as this is done electronically. Need your assistance to resolve the issue.       In general, I bought some items through an online auction service and the items I won by way of the auction process were not as described in the description that the auction house provided. The auction house made misleading descriptions about the products which I believe were intended to increase the bidding amount on those items. The auction house is Auction Mongers, 145 West Beaver Creek Road, Unit #2, Richmond Hill, Ontario, L4B 1C6. I emailed the auction house on November 29, 2021 to request a refund via their warranty process. They denied my claim on November 30, 2021 as it was outside their timeframe for returns. I contacted them again on December 1, 2021 by email to describe the situation in more detail and ask them to reconsider. Today, December 2, 2021, at 9:44am I received a call from Andrew, the manager, who advised me that they would do nothing to rectify the situation. I advised Andrew I would be contacting the Better Business Bureau and the RCMP CAFC to make a report and he wished me good luck and hung up. I paid the auction house $556.57 for the two items that were misleadingly described. The first item was described as Lot #XXXXXXXX "New **** Creator Expert Gingerbread House XXXXX Building Kit, New 2020 (1,477 Pieces) ********** $161.99". I was the winning bidder on this lot at $125.00 CAD, including fees and taxes $155.38. What I received in the box was a number of bags of **** ******** product and a bundle of paper which I presume was to represent the building manual. The second item was described as Lot #XXXXXXXX "New **************: ***************************** XXXXX Building Kit; 3,187 Pieces ********** $416.99". I was the winning bidder on this lot at $330.00 CAD, including fees and taxes $410.19. For the most part, this item was described correctly in that it was a **** set matching the description. It was however, not in new condition with no manual and hundreds of missing pieces required to compete the set.

      I bid on an item that consisted of a large box with an assortment of items that was placed on a pallet. I paid the invoiced amount and completed the pickup pages on their website. When I went to pick up the box I was denied access to the box as I did not arrive with a truck that was the same hight as their loading bay. The box could have been passed down to me and I could have unloaded it within a couple of minutes. Their site indicate that pallets must be picked up by a truck with a higher deck, but this was just a large box placed on a pallet to move around, the box was not attached to the pallet. I had a round trip of five hours to pick up a box which was fully paid for and they denied me access to the box or the contents.
