    I retained the services of The Dock Shop on March 22, 2022 for the installation of my dock/ramp at my cottage located at **** ******* *** ********** ***** ********* ***t. I am advised by neighbours that The Dock Shop attended at my cottage on April 28, 2022 for approximately 15 minutes and attempted to install my dock/ramp. I did not receive a call from The Dock Shop regarding an installation. I attended at my cottage during the evening of April 29, 2022 and did not see the dock due to the late hour of the evening. On the morning of April 30, 2022 I found my ramp broken in two and my dock floating in towards shore. Photographs attached. On April 30, 2022 I spoke with ****** ********* of The Dock Shop to advise that my ramp was broken in two and the dock was floating in towards shore. I further advised *** ********* that a part of the ramp was broken off and sitting on the shoreline. As such, I advised *** ********* that it appeared that his company attempted to install the ramp while it was broken. I forwarded photographs of the broken ramp to *** *********. *** ********* confirmed that his notes indicated my ramp was broken, however, he “wanted to get everyone out on the water as soon as possible.” I advised *** ********* that I was still not “out on the water” and that I now had a broken ramp and a dock that was drifting. I advised *** ********* that I had contracted out to renters that summer and required a safe and operational ramp and dock. *** ********* apologized and indicated he would come by that day and try to fix my ramp. *** ********* attended my premises at approximately 5:20 p.m. on April 29, 2022. *** ********* indicated that even though his notes stated the end of the ramp was broken and, even though his men attempted to install it without fixing the end, he advised I would have to pay for the installation. I inquired of *** ********* why did I not receive a telephone call advising me that the ramp was broken and unsafe and he explained his men do not have cell phones. I advised him I would not want him to proceed in attempting to install an unsafe and broken ramp should I have received a call, nor do I believe he should have proceeding in installing an unsafe and broken ramp. I further advised that I should not be invoiced for this broken/improper installation. *** ********* went on to indicate that he installed customers’ docks “whether they were safe or not.” He further confirmed that he would not call the customer to advise if the dock was broken and agreed in this matter, that he went ahead with the unsafe installation, which broke during or shortly thereafter, without even calling me to advise of the unsafe/broken ramp. *** ********* was well aware that I rented out my cottage during the summer and he confirmed that not only was the ramp unsafe, but the deck was unsafe as well. He advised the ramp was safe when his men installed it, even though the end was broken and it was now lying in two pieces in the water and his men failed to install a new end. *** ********* then advised if he did attempt to repair the improperly installed ramp, it still would not be safe. I mentioned once again that I cannot have an unsafe ramp and he indicated he could not fix it that day and it might be “sometime in June” if I wanted him to do repairs, at a charge. He could not give me a due date in June and I advised I had renters coming and needed to know a date it could be completed by. *** ********* then advised it was broken from last year but I would still owe him money for the improper and unsafe installation. I pointed out it was not installed as it was laying in two pieces in the water and the dock was drifting. *** ********* became heated and told me that his company is not liable for improper installations or installing unsafe ramps and docks yet he wanted his money for the improper/broken installation. On May 18, 2022, I received an Invoice No* ***** *n the sum of $290.98, from The Dock Shop regarding an installation of $157.50 and an “Emergency Repair Call (May 2nd)” of $100.00. Invoice attached. The ramp was not installed properly or safely, as it was in two pieces when I attended, at no time did they advise me when they attended on April 28, 2022 that it was broken and unsafe and they further did no such Emergency Repair on May 2nd or on any day. It became necessary for me to retain the services of a carpenter during the high season of dock installations and repairs, which increased my costs significantly. As The Dock Shop was aware, I have contractual obligations with the rental season approaching and am required to ensure the safety of my tenants on the premises, which I repeatedly indicated to them. I do not believe that I should be invoiced for an installation that was never properly carried out and in fact, damaged the ramp further and also, necessitated me to find and pay for a carpenter to have it completed prior to the rental season approaching the height of the season. I require your assistance in this matter as I believe I was wrongly treated and invoiced. Furthermore, I was required at last minute to retain the services of a carpenter to carry out the necessary work to ensure safety of my tenants. Lastly, I currently have an excellent credit score and do not want an unpaid and wrongly invoiced amount effecting this. I look forward to hearing from.
