      I purchased a used vehicle from a dealership that was sold to me safetied and with a 6 month/6000km warranty, Jan 7 (paid a deposit Jan 2). Within the first week I had problems, and contacted the dealer about fixing them. They told me the problems were fixed and that it was ready to be driven again. Next day i lost my brakes. Brought vehicle to another garage for a second opinion, and they found multiple safety issues, including the problems the dealer said they fixed. I was advised to file complaints with MTO and OMVIC, which i did. I sent the dealer the notes of safety issues, and was told these weren't a big deal and he didn't believe the other garage found these problems. I told him to contact the other garage since he wouldn't listen to me. He tried to tow my car back to him Feb 7 without my permission, which the other garage refused, as the MTO officer was going to inspect the vehicle himself on Feb 9. MTO officer inspected the vehicle Feb 9, and had to remove the plates as the vehicle was unfit to drive. I was sent his official inspection report, and advised to send it to the dealer, which i did. The dealer ignored my email, and i went to see him after work. I asked for a refund, as I did not trust him or his mechanics to complete repairs properly after lying about the safety and the first repairs. Dealer insisted official report wasnt a big deal, and these were normal problems. He tried to tell me he would tow my car to him (again, without my permission), which i replied No, that car doesnt leave the garage where it is without my permission. I asked him to return my money, and take his car back. He told me he refused to pay me back because I had involved MTO and OMVIC, and he wouldn't deal with me anymore, only them.

      In response to your complaint number (********) made by Mr. ******* ( “*******”), my comments are as following:

      ******* purchased used SUV from Bells Corner Auto in or about first week of January. 2022. As per our policies we include 6 months or 6000 km warranty for engine and transmission and additionally we extended 2 weeks of coverage for any thing else goes wrong with the vehicle and agreed to fix the vehicle at our own costs, including parts and labour.

      ******* called me on or about Jan 11th and mentioned that engine light appeared on the dashboard and stated that he loved the SUV. I advised him over the said conversation that there is no need to worry, and he can drop the car at his convenience, and we will look into this and also provide him with the free loaner car during the said period of repairs.

      ******* dropped the car on or about Jan 25th, 2022 and he was provided with free loaner.  He also asked us to investigate some noise under the hood, parking brake and engine light.  After the diagnosis of the car was done for the engine light, we replaced the oxygen sensor, adjust the parking brakes and fix the noises he indicated and all at no costs to *******  He returned on or about after 6 PM to drop loaner car and to pick up his SUV.

      On Monday, the Feb 7th , 2022, when I came to work and checked my emails I noticed that ******* had sent me an email with attachment from other garage mentioning issues with the said SUV. ******* visited my Garage at or about 5:25 PM of Feb.7th, 2022 to discuss the issues with his SUV. He informed in Garage invoice that he has already drove 2000 kms between the times car was sold.  ******* indicated that the major issue to his concern was brakes and oil leakage and I categorically indicated that it is NOT safe to drive and I offered to tow his SUV and fix all the issues, all at my costs, including parts and labour.   ******* agreed and I asked him to advise the Garage where he has left the car to allow us to tow it to our garage for repairs and per our agreement. I have a video and voice recording for this conversation and saved as evidence.

      Per our agreement on February 8th, 2022 I called the Garage and was advised that there is scheduled inspection by MTO for February 9th since ******* has made a complaint to MTO and OMVIC.  I called at least two times to ******* to give him update but He did not answer the phone.

      On February 9th, 2022, ******* sent me an email from MTO with attachment. ******* visited our garage on that day around 5:30 PM and I advised him that I tried calling him and he didn’t answer my calls nor returned it later.

      ******* wanted to fix his car at another place or wanted his full money returned. I told ******* that MTO and OMVIC agencies are involved now, and I cannot make any promise or decision until I have their reports or feedback. He used some unparliamentary words and left the garage. I have a video and voice recording for this conversation as well.

      I am still interested to resolve this issue in a good faith but I have to wait the outcome of reports by MTO and OMVIC.
