      On March 15, 2022 I applied for summer season renewal. On March 24, 2022 the marina charged my summer deposit and accepted my tow waiver for launch. On April 14, 2022 I requested monthly billing as is an option for tenured members. On April 16, 2022 the marina incorrectly changed my membership from seasonal to monthly transient. On April 19, 2022 this error was corrected and my request for monthly billing of seasonal membership was arranged. On April 22, 2022 the marina terminated my renewal without reason or notice. When questioned, they attempted to cite Rule 2 (a boat must be in working order) which was false, and even thier own mechanic and yard manager attested to my boats working condition. After a couple letters from a legal representative (which the marina outright refused to answer), on May 2, 2022 the marina reconsidered my renewal. However, I do not get my existing dock slip that I have been at for 3 years. I do not get monthly billing options as any tenured member is afforded. And they will not tow my boat, meaning I need to disrupt my work schedule to be available for it myself. I accepted these unfair terms as I am just anxious to get in the water to sell my boat to avoid the even more unpleasant situation at this marina (criminal charges that the marina refuses to acknowledge, of ongoing criminal ********** from another boater of which I am the victim). The terms were also dated May 1, 2022 - past thier reconsidered date. It was also stated they will launch my boat once my account is settled. It was settled on May 6, 2022. It is now May 26, 2022 and my boat still has not been launched. I am told May 30, 2022 is the earliest availability. I am paying for a full month of service that I am not receiving, on top of limiting the accommodations afforded me as a tenured member of the marina, on top of the refusal of the marina to uphold thier own code of conduct and handle the criminal issues perpetuating on thier property.

      Background - We are a marina in the City of Toronto. We have 400 slips and store 500+ boats in our 2 yards. In the Fall of 2021 ***** arranged to have her boat hauled out and requested that it be placed where it could be monitored. We did what she asked. During the course of taking boats out of the water her boat was blocked by other boats that came out later.
      While ***** may have entered into in a payment plan with us in the past that option is at our sole discretion.
      It is our policy to not launch and tow boats that do not operate under their own power. *****'s assertion that our staff attested to her boat being in working order is technically true, but she left out the part where staff have known that the engines have not worked and were only recently repaired. In the past we have towed *****'s boat. However this is not an obligation of ours and is at our discretion.
      In early May ***** attended our office and signed a lease agreement for the Summer - the seasonal rate was applied and she paid $3729.00. in total for Summer 2022.
      If ***** would like me to adjust her billing to account for her actual time on land and in water, then I would bill her as follows (all prices include HST)
      1 month on land = $822.64
      1 month blocking = $854.28
      Monthly mooring fee = $1,229.44 (billed June - September)
