Refund of deposit due to false advertising and no service provided. (Details in PDF I attached)Business response

Mr. *****'s complaints are unfounded.
Ottawa experienced a grand total of ONE snow event after which he made a complaint to the ***. As you know, every snow removal company has its trials and tribulations at the beginning of the season and he launched a complaint after the first snowfall. And we provided service. All of our GPS and logs show this.
So I refuse to go into every minute detail about his insane complaint. We have continued to have his driveway on our route list as he had paid us the first instalment. This said, we will remove his property from our route lists effective at midnight tonight as the 2nd payment would have been due on January 15th.If you require anything else please let us know.

I am rejecting this response because: My complaint was two-fold:1. I asked to cancel the contract and be reimbursed my deposit BEFORE ANY SERVICE was provided by Precision. They refuse and are unwilling to reimburse me.
2. Misleading and False Advertising: As I mentioned, the main reason I chose Precision was the claim that they would provide multiple alerts via email, text and Twitter. I also signed up for the Plow Call Alerts on their website. I never received an alert. They DO NOT have a functioning system in place to provide these alerts to their clients. Below is what is statd on their website:
(5). Snow Alerts
We try to notify our clients of any impending storms and our proposed snow storm management strategy. We do this by emailing our clients ahead of time. Phone calls are made to our customers as we get closer to our commencement, during a storm, and after a storm. This is done for many reasons, such as giving our valued customers an increased opportunity to move their vehicles prior to our arrival.3. Their contract does not have a clause stating that there would be no refunds for cancellation yet they refuce to refund me.
I respectfully ask that my depost be reimbursed.
Sincerely,
***** *****Business response

He cancelled the contract after ONE SNOWFALL.
Our alert system cost us a fortune. Over $25,000 this year alone. But there was no way to finalize it before the first snowfall of the season. It is an extremely labour intensive process as all of the last-minute clients are signing up for service.
He decided to cancel the service not because of the call alerts but for another reason, whatever it was.
Moreover, the call alerts were never part of the contract but as an added feature for which that WE DO NOT CHARGE.

We hired Precision Snow Removal in December 2021 to take care of our 2-car laneway during the winter months. My colleague spoke directly with Kent P*****, the president of the company. Kent provided an invoice and we made a payment of $575.17 in full as required. Over the course of December, Precision did remove snow from our laneway. However, it wasn't until following January 17th 45cm snowfall that the company completely neglected our shop. On Tuesday we called Kent and had asked if the plow will stop by since they never came the night before and he had informed us his driver went home sick and that we can expect someone to come by around noon. Unfortunately for us and our clients, there was a parking ban and because our laneway was not plowed, we all received a parking ticket. We continued to wait after 12:00pm on Tuesday and a driver never came. Again we called Kent and he proceeded to tell us his drivers got "confused" that's why no one came. He then said the trucks will be out until 10:00pm and someone should be stopping by to plow our laneway. To our surprise, the following day (Wednesday) our laneway had still not been cleared. We called Kent again to see what what going on and he did not answer the phone. This continued throughout the day and we were never able to reach him, it even got to a point he was screening our calls. We then sent an email and still no reply. Wednesday night out of desperation, we flagged down another snow removal company and they were kind enough to clean our laneway. It is now January 26th and Kent and his company still have yet to reach out.
