      In September of 2022 I made a contract to have a tub installed with the condition that the Safe Bathing Canada company obtain Board approval for the installation. The sales person, I think his name was Paul, added some wording on the front of the contract that sad “upon approval by *******, ******* ***** ********** ***”. I was very, very explicit verbally that Safe Bathing would be responsible to obtain the approval. The approval was not forthcoming and around June of 2023 I requested by phone that, because the contract was not completed 1: in a timely fashion and, 2: approval of the Board had not been obtained, I requested a refund of my deposit. Lots of calls later and it is now March of 2023 and Safe Bathing Canada Inc has done nothing. Can you help me?

      We are currently trying to arrange for an engineer to inspect the bathroom in order to install the safety tub.  Safe Bathing Canada does not normally provide this service......the words written on the contract "upon approval by *******, ******* ***** ********** ****" is not meaning we are in charge of obtaining the approval.  Mrs. Saad knows and has been told that the condo board does not deal with the contracted company, they deal with the owner.  

      Having said that, I am trying to deal with this board who, in my opinion, has been absolutely awful to deal with.  They are preventing someone who requires a tub to have one installed.  In ten years, we have never had to deal with a board like this.  I will continue to give efforts to help her get this tub and stay safe in her home.  We definitely don't need her deposit if a solution cannot be determined.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me except as stated here. 

      The wording on the contract was chosen by the  business’ agent. The intent I communicated was that the business would need to obtain Board approval, as I had had negative dealings with Management and the Board in the past. Legally, the wording would be deemed more favourable to me, since the business worded the contract. 

      I am still concerned that the deposit would not be returned if the Board does not approve the installation of this much lighter tub. This is the third tub I have tried to get the Board to approve, since they keep complaining about the weight issue, which the business and I do not believe is an issue.  I am content with closing the BBB case and will open a new one should the need arise.

      Just for your info, the Management has stated that if a 300 pound woman were to compromise the building’s structure, then they would force the woman out.  Based on their calculations as shown on the architectural drawings, a 300 pound person WOULD compromise the weight distribution for the building/ floor.  I found this response by Management to be offensive and very representative of my dealings with this Condominium corporation.

      I personally did not accept either verbal or written to put in the bathtub they decided to put in my new home. I never even got to see the tub. I was under the impression that they were another company that I had been previously talking to and saw their bathtub. I had told them that they could measure the space in my bathroom and give me a quote, but I would not be able to do anything till I got back from my vacation in January 2023. Instead they told my son I had given them permission to install the tub right away. He was working in the house so he had no problem if they were there as well but, he told them that he had no authority to sign or pay them and they still installed it without my consent. The bathtub is not the quality that I wanted and I do not want it. what am I suppose to do with this tub. I had wanted the tub that was a lot better quality and good for my body. not what this ***** person figured I should get. I did not give any money or signed anything but I am stuck with this bathtub and they want their money.

      In all my years of dealing with the public, I have never encountered a person like this.  The only words of truth in her complaint is “I did not give any money or signed anything”.  I have gone through over an hour of recorded conversations on our business line confirming the opposite of her complaint. 
      Just a few examples:

      1.  Rescheduled our appointment on the phone because her dog passed away but, confirmed while looking at the catalogue I sent her, she liked the Guardian tub and if the price was right she would like that tub.

      2.  Confirmed our installation date while being driven to the airport by her son, who also comments that he will be available for the installation. 

      3.  A lovely recording of her ready to pay for the tub after installation but didn’t feel safe reading her credit card number over the phone in public.  Said she would call when she got back to where she was staying which never happened. 

      Plenty of other proof but I feel no need to go further as we have already removed the tub as requested.

      I am rejecting this response because:  The reason I rejected this response is that his (***** ********) continued to being ******** to me but,  as far as the compliant: I accept that the bathtub has been removed and I was able to have an honest sales man to sell me the bathtub that I needed. Thank you for you help in dealing with with problem.
