The agreement was $1234 entered in February 2023 with monthly payments. So far I paid 1420 and they want to repossess my car . They said I still owe 700$

      Business response

      29/01/2024

      Hello,

I have reviewed your file and there seems to be some confusion. The original payment plan was funded November 26th, 2022 and the program you chose was 0% Interest and no payments for 90 days. This program is essentially free as it carries no fees or any interest as long as the total payment plan is repaid within 90 days. This means that in order to ensure no interest or fees were to be added, you would have needed to pay back $1,234.42 by February 26th, 2023. If the payment plan is not paid off within this time period, which in your case it was not, then the payment plan is considered in default. When this occurs the balance is restructured into a 34 month payment plan with the first payment being withdrawn on the first date of default. Also, when the payment plan restructures into payments, it carries a default interest rate of 39.95% and also causes additional fees to also be added. Due to all of this, you currently still have a balance due on your account.

      Complaint: ********

I am rejecting this response because:

not was not mentioned to me. The contract had a blank spot for the payments that were supposed to start on February. Since Feb 2023, automatic payments were taken out of my account. So far, 1700$ have been paid … and I keep getting charged

      Sincerely,

      ********* ******

      * **** ******** *** ******* **** ********* *** **** ******. I also would like to highlight the following sections from within the contract and also provide an explanation. If you have any further questions; please feel free to email ***********@*****.com or use our live chat to speak to an agent.

      1) For “No Payments, 0% Interest for 3 Months” loans, following a Default the Term shall be automatically extended to 36 months from the date of this
      Agreement.

Explanation: Since the loan would be funded for 3 months at this time of default, it means that there would be 34 payments needed for the loan to be paid off in 36 months (with the first payment being withdrawn on day 91).

      2) Annual Interest Rate – The Annual Interest Rate is 39.95% where interest is charged daily at the Annual Interest Rate on the outstanding Principal Amount $1234.42 from the Interest Start Date and added to your account on each payment date.

Explanation: This is the annual interest rate being charged on this payment plan.

      3) Interest Start Date – 2022-11-26 where interest will be calculated and charged from this date. For “No Payments, 0% Interest for 3 Months” loans, interest is calculated and charged from this date and payable only following a Default.

Explanation: This states that interest will only be payable if the loan is not paid off in 90 days.

      4) Payments and Cost of Borrowing -Based on the payment frequency you selected, you will make at least 1 payment(s), provided that: a) For “No Payments, 0% Interest for 3 Months” loans, the Unpaid Balance of Repair Invoice (line 1 above) must be paid in full by or on the last day of the original Term which is 2023-02-26 and that following a Default the number of payments will be determined in accordance with the Payment Frequency and the remaining balance of the Term as determined following a Default;

Explanation: The total amount needed to be paid off by Feb 26th or it would be considered in default. This also means the interest rate from day 1 would not be payable and the payment plan is no longer free.

      5) For “No Payments, 0% Interest for 3 Months” loans, you will not have Regular Payments. You must contact Us to arrange for the unpaid balance to be withdrawn from your account.

Explanation: This means that the payoff is not scheduled automatically and you need to contact us within 90 days to arrange the payoff of the loan in order to ensure interest is not calculated.

Hello - Your Jan 4th 2023 payment was reversed due to a non sufficient charge. We have made multiple attempts to contact you by phone and even sent a courier to your house with a letter stating that your account was past due. Since we have received no response, your file was allocated for repossession on May 19th, when your account was 45 days past due.

These ******, never send me a notice of repossession, i owed them $700 that was the total balance from them and they kept taking money out of my account. They say i was behind 65 days which incurred in $500 of past due. How can i be past due $500 when my monthly payments are $53 and was behind 2 months? on top of that now i noticed this morning it says my total balance is now $2083 and 2 hours later it updated to $3089 how can that be? there is no way they paid $2000 for a repossession fee. They would not answer my calls nor emails and now i am carless. I have reported this vehicle as stolen. They are charging me $3000 that is 4 times what my original balance was. This company are worst than *** ****** ********

      Business response

      02/05/2023

      1) The notice was emailed and mailed to the address that was provided to us on April 11th.
      2) Payments continue to be withdrawn until the account is paid off in full.
      3) Each payment reversal results in a $49 NSF fee. Each collection call results in a $5 fee. Once your file is escalated to the legal department, there is a $249 fee to send out the notice of repossession. Once the file is assigned for repo, there is an additional fee of $100 to prepare and send out the file. These fees are added to the past due amount owing when payments are not being made and no arrangements have been provided.
      4) The balance will go up after the day of a repossession as the file is processed and the repo fees are added. As invoices are received and the fees are added, they will be reflected in the customers online account which can be viewed when they login. This means the amount may change as a file is being processed.
      5) Our cost of repossession is based on the invoice we receive from the tow operator. There is no markup or additional fees put on top of the invoice which was billed to us.
      6) Once a vehicle is repossessed and the file is with the legal department, all communication must be written going forward.

I received an email on March 17 saying that both my February and March payment where both returned. I only found this out on the 17 of March. I have asked why I’m I only finding out now instead of last month. They haven’t given me an answer. Then on the 20th I received a demand to pay letter in which they didn’t give me time to answer the email from March 17. Now they are *********** and ****. But when I ask for clarification and to why I’m only hearing about this now.

I would like to have the 249 for the demand to pay letter in which I wasn’t even given enough time since I found out that my payments didn’t go through

Our system automatically sends a notification to the customer as soon as we are notified by the bank that their payment returned. Although banks typically take up to 5 business days to notify us of a payment reversal, they are technically allowed to take up to 6 months to notify us. In this case, it was a delayed notification by the bank. Which is rare, but does happen. Now that the customer better understands why the notification was delayed, I assume that we can now go ahead and process the past due amounts owing.

      1) Your original complaint stated that you received emails from us so you even confirmed that you do in fact get emails from us.

      2) When you created your profile we sent you an SMS text message with a verification code. You entered that code into the system confirming that you do in fact get text messages from us.

      3) Our phone system does show the calls made. Unfortunately, the called ID might have been from a number you didn't recognize which is why you didn't think we called.

In summary, all communication systems have been confirmed to be working by you at one point. Further, it is unlikely that there is an issue where only some messages are not going through that all while other are going through.

The customer is also provided 30 days to pick up their belongings from the vehicle before it is disposed of. Unfortunately he did not pick up the personal items.
