      Butler Mortgage got me approved for 1 year fixed mortgage with one of the leading banks. They sent me the paperwork via ********. I didn't sign it for a day or two. I got an email from them advising me that by signing this you are just locking the rates and they will continue to shop around for me for better rates. I signed it without knowing that I was entering into their service agreement which says I will get charged $750 if I don't get the mortgage from them. Initially the appraisal fees was around $350 and after the appraisal was done, they appraisal company said that I have to pay around $500 as my home was bigger. When I asked Butlar they said it's appraisal company not them. I ended up paying $500 plus taxes. I wanted the loan money at the end of the month and asked them to change the date from the 1st of the month to the end of the month as I didn't want to pay mortgage interest for the full month. The interest was around $5K. They didn't change the date for me. They never shop around for you once you sign the paperwork. I did it myself and got better rates from another big bank. When I called the Senior Mortgage Broker and told him about the better rate, he mentioned that I got the better rate for 2 years, not 1 year term so I was in breach of their service agreement. He asked me to pay them $750. This is misrepresentation of facts. Rather than matching the rate his answer was to pay them $750. The service agreement doesn't clearly mention that I have to get the better rate for the same term. They sent me another email and asked for the money, which I denied based on the above facts. They ********** me to take me to Small Claims Court.

      This Individual is a Real Estate Agent who understands contracts and agreements PERFECTLY. He signed an agreement and he insisted on a 1  - yr Rate, he was happy to sign a Service Agreement that agreed to pay our company $750 if he changed his mind AND he did change his mind and took a 2 - yr with another lender a month later. Therefore he owes us the $750. He called our office yesterday and ********** us that if we pursued our action in in Small Claims Court he would register numerous complaints with agencies like BBB. His attempt to ******** us failed, The truth is he owes us money and should pay for his breach of contract

      Complaint: ********

      I am rejecting this response because: 1, First of all I never ********** anyone; 2, I called them to find a mutually beneficial outcome which they rejected outright and again ********** me to take me to Small Claims Court and ruin my and my wife's credit. The business representative was fuming in anger and made up his mind to take me to the court;  3,  The agreement doesn't specifically say the term 1 year or 2 year and in fact they own me $750 for not matching the rate.

      Regrettably this is another ***, please provide the OTHER key document which is the 1 - yr Term that you signed for and accepted happily. The truth always catches up to you. If you sign and accept the 1 - yr that becomes the governing document for the Service Agreement. Nothing else makes sense. No Bank or Mortgage Broker could ever guarantee EVERY RATE in existence for several months. That concept is simply ridiculous
