Hyatt received $375k to rebuild my home after a fire in my livingroom. He left my house in a worse state & removed my home renovation supplies to build his own apt. He never purchased what I wanted. Put in ****************** doors that dont work, didnt complete the roofing, I ordered maple kitchen cabinets but thats not what I got & never received my granite counter. I can not live in my home; no kitchen no bathroom & can not turn on my forced air furnace. Hyatt did not disclose that he failed an insulation/vapour barrier inspection in September 2023. My home burnt on December 25, 2022. I was selling my home but cannot now because its not fit. They painted my brick but over sprayed on my soffits. The eavestroughs are not installed properly & I almost lost them; theres no snow ******* on roof. Drywall had to be removed in the basement due to failure on ******************* barrier. The deck is not supported & theres tripping factors I never got what I requested or what was required to complete my home **** Hyatts cell. ************

      Business response

      29/02/2024

Lets start at t he beginning, This was almost a full gut job and rebuild of which approx. 75 percent had been completed with many extras added to the original scope of work.

No materials were ever used on our apartments.  I do have apartments but any supplies put into renovations at those apartments were purchased with renovation funds from those buildings.

The windows and doors did work they were just not finished with insulation and trim yet

There are areas of the job that are not finished but she served me with a do not trespass or contact notice so I am unable to go back and finish the work.

I can prove that she went directly to the cabinet store and picked her solid wood top quality cabinets herself and the entire fight climaxed when I refused to provide her with $10,000.00 worth of granite countertops.  ************* scope of work called for laminate countertops of less than $3000.00 in value but I had agreed and she previously had ok'd the order of quartz countertops at approx. $4500.00 in value (I have those text messages where she said yes order them) but all of a sudden that's not good enough.

There was not a fail on the inspection in September

There is absolutely no truth to her statements.

There was a Hydro infraction that cost extra as well as a new gas line infraction that had to be corrected.  Her cousin stole all the copper in the house so we had to replace the furnace at an extra $17,000.00 cost as we could no longer keep the radiant heating and the list goes on.  To date we were $74,000.00 over budget on this job and again we can not finish as she has forbid us to contact her.

      Complaint: 21294541

I am rejecting this response because:

I am sending you the contract Hyatt submitted to Cooperators. As you see he was to be done by December 15th.  My drywall was unfinished, My furnace could not be turned on due to drywall dust that would void the warranty on the new forced air furnace he wanted.  *********** that installed the furnace is **** from NRG Essentials Heating & Cooling Specialist and he told me Do NOT TURN ON the furnace.  Hyatt was bent on turning it on and said he would just change the filters constantly so **** disconnected the electricity to it. I wanted to keep my radiant heating but he threatened to  walk away from the **** job if I had Reliance come on HiS JOB SITE.  I was burnt out of my home and my home was not secure.  My demo workers would call and tell me they found copper cut and hid in the basement many times.  **** HYatt called me to say my 3" drain pipe under the toilet, the stink pipe and the copper pipe for the radiant heater loops were missing.  Hyatt refused to secure my building.  The only people that had keys were, ***** *********************** Levi *********************** ***********************, (his family) and his worker **** and the electrician *********************.  My *************************** & I would not sabotage my home, we were working on the property before the fire because it was for sale.

**** Hyatt instructed His son **** to remove the rest of the copper from my home and remove the remaining radiators on November 21st, 2023.  **** also removed my gas line to my gas stove upstairs, which now needs to be installed.   Hyatt refused to run a water line to the fridge upstairs and install the proper exhaust vent system for the exhaust fan over the gas stove upstairs so there are three more items that Hyatt 's incompetence shines through. Hyatt says the stove exhaust doesn't need to vent outside but I had that existing before the fire so it was another item to be replaced.

When we first started working on the demo, he had to use extension cords run from the shop to the house.  I had a fridge in the shop also so I had given keys to **** HYatt, **** and *********************** and **** Hyatt.   One day I went to my shop and saw I was missing all my Dewalt tools and batteries and chargers and my Milwaukee tools, and a box of deadbolts and door k**** with many keys per lock set.  I then rekeyed my shop door.

My kitchen cupboards he installed can not be used because you can not open the doors, they need spacing in between them.  They were supposed to be solid maple like Hyatt states but they are press board and MDF fronts.  Yes I did have black granite countertops in my kitchen and I had black granite on my breakfast nook in the kitchen.  Hyatt knew when he bid, that there were errors and were corrected.

Hyatt convinced me to put a black steel roof on instead of fixing the small area of shingles that needed to be redone.  I wanted radiant heating and my boiler/furnace was rented from Reliance who would have replaced it and repaired the radiators.  Hyatt wanted to install a forced air furnace because that would sell better, just like the steel roof.  He had his son **** do a deck on the front of my house which doesn't have enough bracing and the cedar is cut uneven so he had put tin strips on the deck against my brick to cover his errors.  The deck boards are uneven and a huge trip factor.  There is nothing to nail them to underneath that's why they are uneven.

When Hyatt installed the two bedroom windows and I noticed they were 3 inches too small, his response was that my windows need more insulation.  I replied these windows should be in casement windows with brick mold attached to them.  The windows should fit the brick opening but they were 3 inches too small and were sliders. My windows were too big for sliders and he didn't use shims, or even frame them in since they were 3inches too small.  Hyatt used expanding foam so my windows were bowed so therefore they would not open.  Hyatt should have used non expanding foam.  I asked them to have windows operating before they drywalled. Hyatt had them drywall and the Drywall stopped 3 inches before the window and there was no vapour barrier ( thick plastic should go past the windows). I caught them framing my windows with my cedar boards but told *********************** they need to open freely before you do anything else.  I asked many times to get windows working but they always stated wait til the end, then *****.  I know the windows need to open for a child to escape if needed.  Not one lady could open them and men had to use their strength.  I told Hyatt I am not calling you every time I wanted to open and close a window.   I had **************** come in to give me their professional opinion and they said these windows are a very cheap window and are the wrong style of window, hence they should've come as encasements and with brick mold. St **************** says every window is not level or square and no shims were used, that is why they do not open.  Windows need to be removed and replaced and framed properly with non expanding foam.  After that the soffits need to be redone because they are not installed correctly.  Soffits were white plastic and were installed using 3 inch deck screws.  Hyatt had his Worker Teco (granddaughter's boyfriend who lived with Hyatt) paint my red brick because he said there was no money to do brick work and **** painted my white soffits grey. I asked many times before you finish the outside of my windows with trim. I need the soffits replaced with white ones and the windows need to function!.  Instead Hyatt told his workers just to finish it because time was running out; this was December 1st, 2023 and It was to be completed by December 15th.

The steel roof was never finished like the windows or the deck.  The steel roof is missing pieces on the south side and they did not use strapping under the roof so it won't breathe properly.  They never installed the foam end pieces so now the bees will make nests in the roof because there's nothing to stop them from nesting and getting under the roof.  Hyatt did not install the snow breaks so when the snow slid down the roof, it was bending the eavestroughs off.  They didn't even use enough brackets to hold up the *****.  Today my roof leaks in the garage and is damaging my wood framing.  The end cap they installed on the roof where the sides meet is not installed correctly, they never seemed to know how to use a ruler, chalk line or level, it's not even or level.  *** is the guy Hyatt hired to finish the roof, eves, tin trim and get windows functioning.  I told *** before you do eavestroughing to replace the soffits that were painted grey.  Hyatt said that paint will wash off but he never tried to get that accomplished.  There was still a full box of soffits but Hyatt did not use J-trim on the soffits either, which shows his incompetence.  *** replaced a few soffits but was angry about the 3 inch deck screws and every window trim Levi ********* had to be removed, cut and replaced.  *** quit replacing soffits because it was time consuming and time was running out.  *** used silicone to seal the window trim, not exterior caulking.

Hyatt never completed my flooring on the main floor and on December 8th he told me he would order the flooring, the interior doors and the bi fold doors, but they never materialized. I never got to choose my windows and they were cheap, my exterior doors were 36 inches and Hyatt gave me 34 inch doors saying I couldn't have 36 inch doors.  My exterior front door was still in my backyard burnt and it was 36 inches wide.  I wanted my interior doors and trim bought from North Pole in ******, *******.  His wife ***** texted me saying they do not do doors, so I sent her the link.  Hyatt never purchased my toilet, or tile or sink for the main bathroom.  Since there was no heat or light in my home, I had to supply that and they melted my tub using the propane heater.  When Hyatt brought the tub in I told him the drain was to be on the right not the left,  He waited until the plumbing and electrical was done before he changed the tub.  I told Hyatt from the very beginning that the tub was wrong and he would need to install a barn door because the door opening against the tub was stupid.  As a mom filling up the tub, the child would open it and hit mom.  Hyatt told me that I didn't know what side the drain was on, which is ******** since my dad built it and I lived there.   The bathroom walls around the tub were installed poorly and had a big wow on the drywall and his reply was it could not be repaired and he would just use lots of mud to install tiles.  I had ******************* remove a chunk and he cut out the wood and pieced back the drywall.  The plumbing leaked too so **** had to fix the leak and replace *******.  Hyatt knew I was going to put tile around the tub so if you know anything about bathrooms, you don't use Sheetrock drywall, you use ***************** or cement board.  I sent Hyatt information about using a waterproof wrapping but that never materialized either.

As for the failed inspection, I will forward St *************************** report that failed SEptember 2023.  Hyatt bid on removing and replacing all my insulation.  Hyatt only replaced the insulation on the area of the fire, Hyatt reused my old pink insulation.  Hyatt failed the insulation vapour barrier inspection because there needs blown-in insulation to R60 rating.  When St Clair ********* came, Hyatt's crew did not have the basement exterior walls insulated.  I did not find out about the failed inspection until I called a meeting with the Cost Accountant, ******************* from JS Held, *********************, St Clair ******** building inspector and **** Hyatt on January 15th, 2024.   Hyatt came in screaming that I am causing this c*** for calling the township.  I need inspections done to get an occupancy permit, Hyatt did not want to get a permit because they inspectors will hold us up.
The wall between the kitchen and the living room was burnt so I got permission to remove that and put up a beam.  Hyatt installed an 8 inch double wide beam.  I kept asking him if that was " to code".  Once ********************* installed all the electrical wires, I told Hyatt he should check that beam because the framing was being inspected soon.  He found out it was to be 15 inches not 8 inches because we removed a 13 ft 3 inch wall.  So he had **** and **** ( another nephew) cut out the 8 inch and bang in the 15 inch and they wrecked the electrical doing so.  ********************* had to come back and fix their mess and *** was not happy.
My fire in the living room also destroyed the flooring and the floor joists and there was an office below.  The floor joists were just put in with a few screws because Hyatt should've braced it with hanger brackets or secured it with wood bracing and screws.  Instead he did not secure the floor joists and they were side by side with burnt floor joists.  The Electrician installed the electrical wires through both floor joists.  I demanded the burnt floor joists be removed because they were burnt and I did not want them left in my home.

Back to the FAILED INSPECTION SEPT 2023.  I came into my home December 12th and noticed they were drywalling downstairs so I texted Hyatt and asked if we passed the vapour barrier and insulation inspection and his reply was he installed two inch R12 insulation and no plastic was needed.  He obviously lied to me because it did not pass because it needed tuck tape to seal around every edge of the insulation and it was only 1.5 inches thick and it is not rated R12.  He used the cheapest white styrofoam boards that crumble when you handle it.  This insulation does not have an R value.  THe West exterior wall needed full ****** insulation because they were 2x4's so the 1.5 styrofoam did not pass either.  I had to remove the west exterior wall in the office to properly brace the floor joists and remove the flooring in the closet because there was 3 inches of water under the closet floor.  To pass the inspection all exterior walls need to have drywall removed and proper insulation added, vapour barrier done and then inspected.  ********************* said the rim was not insulated either and that was also a fail, which he advised to remove drywall on ceiling to expose that area.  THe summer kitchen in the basement, the east exterior wall had to be removed, they just drywalled over old insulation and old paneling.

The reason why I gave Hyatt the job is because he said he would be the one working there and he would give me his undivided attention and I would be his only job once he finished the apartment over the store and the house on ************************************************************  ***** Hyatt misrepresented himself that he was going to work on my home and said he had a drywall crew to do the drywall.  I had a drywall crew scheduled; the bid was $3500 for upstairs and with the downstairs it was $5200 and done in three days tops.  Hyatt said that was too expensive. Instead he had ****, **** and ******* ( who overdosed at Hyatts home on November 4th).  The pictures of drywall look like they did not have sharp knives, rulers or a level; it looked like they chewed it.  They didn't know how to do drywall and that was apparent by the large gaps between the sheets, and the fact that drywall did not go into the corners of the walls.  They did not use enough drywall screws and that was apparent when the drywall bowed and in the basement it was falling/hanging off the ceiling.  The drywall did not meet the windows and it was at least 3 inches away from the edge of the window.  I asked many times how they were planning to attach the trim when there was nothing to attach trim to, it was an open hole.

The basement windows do not open either and are installed completely wrong and the wind blows through them. ******************* says they need to be removed and installed properly with insulation.  I came in and saw *********************** framing the basement window. I told him to stop because you need to get windows sliding first, then insulate and do vapour barrier.  The way ***** was framing them in with my cedar, they would be drafty.  ***** got angry and pulled *** off the job because I was stopping them from working.  Again,I needed these windows to function and be up to code as per the building codes determined by St Clair ********.  This is apparent by the failed inspection report listed below as of September 28, 2023.

I requested to install a hanging ceiling in my basement so I could prove to the future homeowner ( Hyatt knew I was still selling) that things were painted properly and then anything extra needed could be installed easily. Once Hyatt decided to drywall the ceiling I had consulted Cogeco on December 18th, 2023 and they said I needed a CAT 5 Wire attached to the outside north wall and run the cat 5 wire into the mechanical room.  Hyatt was not very happy and texted me swearing that I am a F****** fool.  Hyatt texted me many times swearing at me calling me a f****** idiot and he actually called me on December 11th, 2023  yelling at me swearing at me telling me to F*** OFF.  All I wanted was to have Hyatt finish the roof, Get windows functioning and insulated properly to code.  Hyatt knew I was still selling my home and said that the $516,000 he was to receive would put my home back to high end finishes so I could still sell for $! Million Dollars.  I have 2 acres on **************** looking at the St Clair ***** and ********* have a 40x 60 ft steel insulated building with 3 phase power and huge electric doors that you can drive a transport through.  This property has been in my family for over 85 years and I have the last two acres of our 40 acre family farm.

My exterior doors are 34 inch not 36 inches and are not what I requested.  They are so poorly installed that They are not flush and square so they do not operate protoo, perly and have major gaps so the wind blows through them too.  The last day the electrician ********************* was there, January 22nd, he had to help me shut the garage man door because it was so messed up.  *** had to stay inside the garage to get it locked but had to leave by the front door.  There were no shims in the door and it was framed on an angle hence the hard time to shut it and lock it.  I bought the lock for the door and they didn't even give me the steel door piece that is attached to the outside frame.  The house door in the garage is so badly installed that you must slam it to shut it.  Now it's damaged, it's been dented at the top because we must slam the door to latch it and keep it shut.  If you don't slam it, it pops open.

After being told to F*** off and I am a f****** idiot it was quite apparant Hyatt was not going to finish my home right or to code.  Hyatt said if he knew I wanted it done perfectly, he would've never taken the job. Hyatt quit texting and calling with me December 18th after the big text about my home not being a new build and I am a f****** fool for wanting a cat 5 wire so I could have internet and a phone because I live in a dead zone and wireless diesn't work the best in my home because I live on the American border.
I went to my house to check on it and I noticed Hyatt had removed two boxes of drywall mud, the bag of sheet 40 mud and the 500 ft paper tape for drywalling.  (I bought the sheet 40 bag and the 500 ft of Tape). Hyatt removed the box of white plastic soffiting and other roofing materials without my permission; these items were purchased for my home with my insurance money.  **** and ***** Hyatt told me the money they received from my insurance company was theirs and not mine and they could do with it as they wanted.  Hyatt knew I wanted to start posting pictures of my exterior and main floor by October but they were not completed and the shoddy windows and drywall was a detriment to selling a high end home.  I live on millionaires row and Hyatt knew I had solid oak doors and trim, Oak cabinets and granite. There's still a hunk of granite from the breakfast bar.  I had a full summer kitchen downstairs.

I complained to **** about **** smoking cigarettes in my home and putting them out in my living room on the new subfloor.  I Was fed up with his disrespect, the lack of professionalism from **** and **** Hyatt. After I went over to Bedrock Granite with ***** to pick out my countertops. **** and ***** said I need to go white and simple because that's what new homeowners want but I wanted something of colour too pop.  So I picked out bluish green granite and ***** flipped out on me screaming I've blown the budget on January 10th, 2024.  The only thing I had in my home was $11,600 Kitchen cabinets installed improperly and most of my flooring upstairs, The windows, roof, deck, drywall, insulation, vapour barrier and complete bathroom were unfinished.  My house was inspected to be about 60% complete, not the 77% they claimed.
After the January 15th meeting at my house, **** Hyatt proved to me he was not going to finish my house properly.   He told me he was not going to redo the windows and the doors and that I did not fail any inspections. He was going to send in the ***************************** (Hyatts daughter in law) when she had been painting over drywall that needed to be mudded and sanded first.  The basement drywall tape was peeling off the drywall and they had drywalled over all the electrical wires drywalled over heat vents and removed my door bell wire.  They did drywall around the heating duct work which was not straight or drywalled properly and when that was removed, we noticed the holes in duct work from them s******* up the 2x2 wooden studs.

Ordinance was moving the hydro and the gas line which he sent invoices totalling $16.046 which includes his markup of 20%.

So I had to stop the stupidity.  I knew I would need the last draw to salvage my home.  No Idea how Hyatt can claim he's $74000 over budget.  He has **** cut out my radiators in my basement, which was not needed.  Any work my workers did, we were instructed by Hyatt.  Hyatt had me and My friends do the demo because he couldn't, his crew had finished ***** and the Apartment.   Hyatt did not instruct his family how to work efficiently and he never came and educated them on how to frame the basement, the drywall, mudding or the steel roof.  Hyatt never used any professionals to do my roof, drywall, windows, or kitchen cabinets.  I found out from Bedrock Granite ***** Hyatt bought the cheapest quartz and the cheapest sink ($40) ***** could and these people at Bedrock Granite know me and my home.  Bedrock granite did my granite in my kitchen twice and my granite bathroom counter upstairs.

Hyatt actually removed his tools and my supplies for my home and my propane heater On  December 20th to 27th.  *******************, *********************** and *** came back December 27th and 28th without proper tools and never returned again.  Hyatt told my insurance rep that they'd finish January 31 if not interrupted but they were working at the apartment on ****************************************************  The last two days they drywalled the laundry room and summer kitchen, covering the heat vents.

I received a phone call from Chatham-*********** at 3:46 pm on January 22nd, 2024.  Hyatt reported that he got beat up on St. ************ in *********** and stated that My *************************** assaulted him and he witnessed me driving the getaway car.  I was at my home all day with contractors and ******* was busy in ****** with family.  Hyatt also reported that I made a bomb threat. So the police advised me to give them trespass notices which they would enforce once I served them January 23rd, 2023.

Hyatt did not pay the electric bill when we rebuilt using the Shop power   $110/mo for 7 months.( MAY 2023-November 2023)   $770
Hyatt has not paid the hydro bill from the home since November 2023 to January 31, 2023 (when He gave a 2nd date to finish)  $148.84
Hyatt still owes the Enbridge bill for the heating of the home using the fireplace $167.55.  TOTALING $1,086.39.

I have included all documents needed.

      Subtotal                                                                   $397,217.97

      Hyatt Bid                    $516,693.64
      Last Draw is                $141,600.00

**** Hyatt received $375,000 and The new builder doesn't think the last draw and ordinance will cover all items to be redone.  My home is not repaired by Hyatt with High end items as per requested by me.  I never was allowed to pick out my windows, doors or tub.  I sent **** screenshots of tiles, a toilet and flooring I wanted but none of the required items ever materialized.  ******************* did measure and count up the interior doors required but they never materialized either.  Hyatt's wanted to install commercial grade trim which ***** showed me at her Office.  I sent her pics of the trim and I wanted to get my interior items from North Pole in ******, they deliver for free in our area.

I had to hire another contractor to document the incompetence and the fixing of my home so I can move in.  Hyatt left my home unlivable and I can not turn on the furnace due to  the unfinished drywall & the dust because the basement is not finished.  That is from strict instructions from **** at NRG Essentials. I have no hot water because Hyatt did the plumbing in the mechanical room and it leaks.  I have included the 2nd contractor information.  Due to Hyatts explosive & unprofessional behaviour I would expect that the 2nd contractor information will not be visible to **** Hyatt.

You are welcome to come and see the destroyed matter that Hyatt left my home in.   **** Hyatt states, he gets all the pictures from ***** after every day so all the work on my home has been documented.

      Sincerely,

      ***********************

We bought a trailer in wild wood by the lake . This trailer has a house roof on it. when we bought it in April of this year, I was told the roof would be fixed by Mr Hyatt .Months have gone by, mould set in so I had to have it fix. We got another company to do it . The roof was only put on 4 years ago.it cost over 4000 dollars to fix it . I have made lots of attempts to contract this company . They do not return messages or emails.
