Date of purchase: Aug 2/21 purchased 2 dwarf lilac trees had them come and plant them, was told they were under warranty and if any problems occurred that they would refund/replace trees in May 2022 we noticed that these trees were dead/dying and contacted Overdevest stating that these trees weren't doing well and he stated that he would come out and take a look, upon coming to look at them, he proceeded to tell us that WE planted them too deep and they were getting too much water. He said that he would lift them up some and give it some time to see what happens. We waited a few weeks and again contacted Overdevest to see what he was going to do with these trees and told us to wait until the end of June and he would come and re-assess the situation. I again called him on July 5 2022 and again he stated the it was our fault that they died as we put a small rock bed around each tree (will attach photo) which was done only 2 days before he came to originally assess them. He also stated that he should charge me for coming out to lift the trees and put in more top soil...again he was the one who planted these trees originally, we did not do anything to these trees other that put a decorative bed around each on. He also stated that we need to call and talk to him before we did anything as they were under warranty...however when we purchased these trees, no instruction or anything was given. We weren't told that we couldn't put anything around or near these trees or anything else. **** ****** **** ***** **** ** *** ******** ************* *** ******* ** ****** *** ******** *** ******* ***** ***** *** **** ****** ** ** *********** ******* All I want now is my money back including all labour/material costs as we have already replaced these trees ourselves.Business response

Hi case#*******In response to this complaint I tried very hard to resolve it. They called me around 10 May\22 and said their trees were not leafing out. I went over to see and they had built a 12 inch wall around each one and filled it up with white marble that was unwashed so it would not let air into the soil. Also it was a cold wet spring yet they were watering with sprinklers 40 min. a day which keeps the ground cold. They had also epoxied the stones(glued) which would not allow the water to drain out properly. When we planted them they were at the right depth and we had bark mulch around them. They created the problem. To avoid a big dispute I suggested they remove the stone cut down on the watering and I would stop by raise the trees to the new level(because of what they had created) which I did and also brought in 3 wheelbarrows top soil so an hour of my time and free topsoil.(never a thank you I also said that the trees should leaf out when it gets warmer about July and I would check them out the end of June as I was pretty sure they should be ok .So about 4 weeks ago they came over and were very rude to my staff telling him I had better get rocking to replace the trees. I did not respond. Then about two weeks ago he called again very rude wanted to know when we were going to replace the junk trees. When I reminded him that i had taken the time to try to fix a problem he had created without a thank you or what do I owe you they had me on speaker as then they both started yelling at me so I hung up. Later that day around 7pm I noticed something in the parking lot and they had dumped the trees on the parking area and left, I took the trees to the back and repotted them and treated them properly so one is now in full leaf and the other is coming along. They can have them back after Labour Day as they should be fine, The only request I have is they pay me the 105.00 for labour and top soil and 55.00 for repotting them and 25.00 for maintenance plus tax so 209.05 .I was willing to go to that much effort for customer relations but when they became so offensive and belligerent I was done. As a side note this business has been here for 70 years and I have been full time sense 1958 and this is the first time this has ever happened. Maybe they think that since I am 80 I would be an easy target. Tell them that if they continue to slander me I will have my law firm talk to them. We did contact Peter in regards to the trees in May, we did follow what he said in regards to the watering and the stone around the trees...we were not belligerent when speaking with him nor any of his staff. We did inquire to as when he was coming to replace the trees as he stated that he would do come the end of June.
When we called the first week of July to again ask when he was coming to replace and reassess the trees, never once were we belligerent, right away he was the one who became belligerent with us and started accusing us again the we were in the wrong and the we needed to ask permission to do things on our own property, and yes I had him on speaker, and there were others here to hear the conversation and when Peter called me an 'ungrateful bitch' I then hung up the phone, and we pulled the trees out and took them back to his location. I do not want the trees back. As for slandering his name, we have done no such thing. And if someone should ask us about the service, I will not lie and tell them exactly what our experience with this company was.
All we wanted was to be treated fairly and to have to warranty upheld as we paid good money for these trees. I see now that we will not be treated fairly and having warranty on a product is only good if and when the business owner deems fit.Customer response

In addition I would also like to say that all the other plants, trees and shrubs that we planted are all healthy and thriving so this issue was not caused by us, but by inferior product and that Overdevest planted them too deep and should honour the warranty y giving us a full refund. Pictures of what we planted are included.
