      Built deck in May 2023, client wanted round brown pickets for railing.  Could not source brown round pickets. installed temp railing. Ordered from ******, ****** sent square pickets Client did not want  Informed client, Could not source brown pickets. Client refused square brown pickets and round black pickets they wanted brown.   offered to do a complete railing for NO CHARGE. Client refused free railing. 70% of contract has been collected 25% remaining. DID NOT ASK FOR THEM TO PAY THE 25% remaing,  Offered to do aluminum round brown for a increase of $600, client refused..  Client refused a wooden railing and refused to accept anything but brown.   Client lets young child (toddler) on deck unattended and tries to accuse contractor it is their fault when unsupervised toddler gets hurt. There was also a blockade across the door to deck that was removed by client to access the deck against contractors advice.   Deck was 100% complete with temp railing and in excess of $1000 owing which was not even attempted to be collected by contractor.  I have offered every solution, free railing which they declined several times...

      Thanks for the reply . OTW construction making story now. He built deck in April not in May . We were agreed with black pickets after 3-4 weeks when he started saying brown is not delivered yet ,we never express issue regarding shape . We signed contract $5200 including pickets . $3200 only deck and $5200 including pickets ,He took  $4100 only for deck. He never answered our call ,once a while texted back after texted him several times . In June he stated ,he is coming for  wooden railing or if we want black pickets we have to pay extra $ 600 . 

       Sir/ madam ...I attached the whole texting conversation . Please read the attachment which I sent you previously. It was so stressful for us that he was not responding well nor his company  for 2 months . Moreover he was provoking us to take legal action ,was sending lawyer information . The contract was to pay $2900 first and rest of after completing the whole work ,We trusted him ,he requested that he need more money we paid him total $4100 before completing work . I request you to read the whole conversation.

      He sent us two contracts, one for the deck and another for including railings. The contract was $3400 for  deck and $5200 for including picket railing . He took  $4100  without putting railings  on the deck . So we want him to deduct $3400 for the deck and return rest of the money

      as one can plainly see from the texts and messages of correspondence supplied by the plaintiff..there were several times  a free quality and astatically pleasing railing was offered. There was 1 contract for the deck and railing, that was agreed upon. The quotes before unrelated to the agreed upon contract have no bearing on monies/costs pertaining to the agreed upon contract. The correspondence clearly shows how much OTW extended itself to solve this problem without the client paying a higher cost to obtain Brown balustars where as in the contract it clearly states BLACK that he refused.

      November 15th we got the quote, they started a few days later. We hired them because our water line and pipes were freezing . I believe they said they worked here for 3 days. When I left for work at 830 am , they were never here and when I got home at 4pm they weren't here. Two weeks later (Dec 4th ) after job was done and paid. I had the same issue. I checked underneath our trailer and everything was plugged in. I messaged him and he said he would come out and look. He did come out and I'm not sure what he did, but he said the heat lamps weren't on. The night before they were. My husband came home a couple days later and he called them again and said the sewer is frozen. My husband looked underneath and there was no heat trace on the sewer and no insulation on the sewer pipe for a stretch of 10 to 15 feet. Which was suppose to be put on according to our invoices. ***** came back and put heat trace on the sewer line. Then after he left our water wouldn't work. We called a plumber . A plumber came out and they ripped the insulation down and there was a a big leak from our waterline, there was hole. ***** was suppose to check for leaks. It caused our whole water line to freeze we had to hire a backhoe to rip our ground 9 feet. ***** sent a 1400 bill for putting heat trace on on the sewer line. We refused to pay for it bc it was suppose to be done in the beginning on the first 2 invoices. We paid 2500 for materials and 3500 for labour. A few days later after getting the heat trace put on and having no water for days. Our sewer stopped again. My husband looked and ***** put the heat trace on wrong and it melted our sewer pipe. Feb 17th ***** messaged and said he was coming to get his heat trace line , bc we didn't pay the 1400. I said you mean the heat trace that melted our pipe ? I asked for receipts of material cost. He refused. Why would we pay 1400, when it was suppose to be all done In the beginning. ***** said he replaced 40 feet of sewer line which he didn't.

       Sewer line was repaired/replaced with heat tape and insulation and sealed up and west end skirting was rebuilt with power for heat tapes and easy access to area for future service purposes. Everything was complete and clients were happy.  4 days after the repair we recieved a text from *** ( the client) stating the sewer was froze and backing up . When I accessed the crawl space I came to discover that the light fixture near the north crawl space was removed and the light was broken and all the insulation we wrapped around the sewer pipe had been removed and tampered with. *** then confirming he did it trying to get everything warm with electric heaters. And that he tried to pour hot water down the tub and toilet to thaw it out causing it to overflow and get everything under the trailer all slushy. We thawed the sewer line and retaped the entire length and rewrapped insuation around it We left and *** texted saying he has no water,.Upon returning  we accessed the area in the trailer floor where we repaired   it was very warm not frozen but warm to the feel. So we reinsulated the area and resealed it. *** informed us he unplugged the heater a day ago cause the weather warmed up.  The heater in the well and lines was unpluggedSo we plugged in all the heaters. due to the client unplugging power to the heating equipment to ensure nothing freezes further and gets damaged.  And we did not have any equipment on site to excavate and check. So we informed him there would be a bill for the service call as everything we did was correct and repairs the second time were not to incompetance or faulty work/application. . Upon excavation they discovered the line froze between the trailer and well and split the waterline causing no water..The 2nd service call regarding the refreezing and repairing of the sewer line was due to power disruption to the heating equipment via client.  And we stand by the job we did

      I am rejecting this response because:

      No one tampered with anything! *** wasn't even home the first time. I called ***** back out when the pipe froze the first time after the job was finished. There was no heat trace on a huge space of the sewer pipe. Then when they came back thr second time and put heat trace on, it melted the whole pipe and the pipe needed to be replaced.  We paid 6000 dollars just to repay someone else to  start the whole job again and finish. The insulation was sagging because of the water leak *** found. So all the insulation had to be replaced after the job was completed as well. *** told them before the job was even started there maybe a small leak in the water line and they need to inspect it.  If all pipes were heat traced in the beginning,  why did they come out a 3rd time when *** was home to put heat trace on. Then charge us a second time.  ***** texted me one night and tried to intimated me over the heat trace, he claims he bought. Although it should have been included with our first bill because they stated everything was heat traced and it wasn't. 

      Note all the pictures sent , the one with a hole in the pipe that's circled of the water leak. The melted pipes. The rude conversation I had with *****.

       Several things are rejected because the people do not like or agree with the answer. However this does not negate the facts. Perhaps the husband did not tell the wife everything discussed. 

         I will not "argue" about the facts.    The client "***" told us that he unplugged the heater in the well house 100 feet away from the trailer where it froze the main water line coming from the well. Which has nothing to do with the work the company did, and unrelated to a frozen sewer discharge pipe.. As no water lines were frozen in the trailer...

      On July 29,2022, I had hired "Off The Wall Construction" contractors to complete drywall work (mudding, taping) for my garage. ***************************, total price agreed upon as per quote was $800.I had to deposit 50% ($400 down payment) which I e-transfered to them on Aug. 8. The agreed start date was Aug. 8 - the contractors did not come to complete the work nor did they promptly answer my calls/text messages. On Aug. 10, ****** text messaged me that he would be unavailable to complete work and that he would refund $400 back, this is reflected in attached text messages. ****** agreed a refund would be issued on Aug. 11 as seen in text messages. This never happened and this is when the contractors started to ignore my calls, text messaged and email messages. Unexpectedly, ****** then emails me and lets me know that a refund would be issued in 30 days- this was never agreed upon initially. I voiced that this made no sense as he (******) had himself cancelled the proposed work. As any person would, I continued to try to connect with him via email until Aug. 17 as he kept repeating the same phrases as seen in the email messages. I then received a final email dated Aug. 27, stating that due to "constant nagging" that my deposit will not be returned. However, according to my records, the last time I sent ****** an email was Aug. 17. I informed ****** that this was not a legitimate reason not to refund my deposit as he, himself, had informed us that he was not available to complete work. I have emailed ****** since, however I have received no response for the same. Because of this ordeal, I had to scramble to find another contractor to complete my garage work on short notice. I have also endured financial stress due to fact that $400 is no small amount in this economy. In addition, I have had to spend numerous hours trying to connect with ******. As newcomers to Sask., we were completely taken advantage of, which has left as feeling very wary of hiring contractors.
