    Consent Judgment

    The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

     On January 6, 2023 HomeServe entered into a Consent Judgment with the Kansas Attorney General and Sedgwick County District Attorney that settles allegations HomeServe offered electrical home repair plans that failed to provide a material benefit to consumers and made material misrepresentations. Under terms of the Judgment, HomeServe has agreed to pay $500,000 to the State of Kansas, and agreed to pay $350,000 for consumer restitution. Further, HomeServe will ensure that future solicitations using a third-party logo has clear and conspicuous language disclosing that HomeServe is an independent company separate from third party whose logo is used, that the third party is being compensated for use of said logo, and clarification that the repair plans being offered are being done so by HomeServe. The Judgment was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.       In October 2023 I called the company to service my wash machine. A technician came out and said my wash machine needed to be replaced and I would get a $500 reimbursement for buying a new wash machine. They did not leave a receipt. (Contractors sent on behalf of this warranty never leave receipts for me.) I start shopping around and buy a refrigerator. Before installing it I call to get instructions on how to get my reimbursement. I’m told it is not on file from the technician that the washer needed to be repaired. In December I have another technician come out to service the wash machine and they said the same thing. I called a few days later to get instructions on how to submit my claim, at the same time my washer officially stops working. After another run around of the replacement not being on file, home smart calling the contractor and confirming the washer should be replaced, I finally get someone to tell me yes the technician who did the work did notate that the washer needs to be replaced and wait for an email on how to submit my claim. I didn’t receive any information about how to submit my claim. I had to call several times before someone gave me a claim number and an email to send a copy of my receipt. The claim number is ********. I send the receipt using that email. Some time passes and I call to follow up on my claim to see when I can expect reimbursement. I also wanted this confirmation so I can officially install the new washer. I’m told I can install the new washer and it’ll take 30-60 days. I install the new washer and get the old one hauled away. I call again and someone else tells me I didn’t submit my receipt to the correct email. I get a new email and submit my receipt. I’m told over the phone that it will take 30-60 days to refund me. Fast forward to April 2024, I still have not received my reimbursement. I’m getting the run around that I need to call Homeamart, homeserve, or ****. It changes every time I talk to someone. The story I’m told is the servicer of this warranty changed and some records/cases got messed up. I get a new claim number and submit a copy of the receipt and a copy of the receipt from the technician(homesmart called the contractor and asked them to email it to me.) The job number on that one is *************** I now have a message that it will take 30 days to review. I’m told again to call **** instead and no one can tell me how I can expedite this but I am told **** handles it. **** doesn’t respond. I have emailed the following with the necessary information and possibly other email addresses: ****************************** mailto:******************************* mailto****************************** mailto:***************************** I have called the following in this wild goose chase and each company sends me somewhere else. These are the numbers I can recall but there have been many conversations. I have left messages and spoken to people and everyone tells me a different story or does not call me back: **** ###-###-#### Homesmart ###-###-#### Homeserve ###-###-#### I already bought the wash machine. I already installed the new wash machine. I already got rid of the old wash machine. I cannot have someone come out again and confirm it was broken. I don’t have any idea what the hold up is, who or what to believe, and I am tired of waiting for the reimbursement. I did my part. I have made numerous attempts to get this done and do it right. I want my reimbursement.
