I hired Titan, at my home builders recommendation, to landscape my property Aug 2019. By mutual agreement, the project was modified to include re-grading for proper drainage and to modify the plants to include full size purple lilacs. Titan began work that fall but did not complete the agreed upon work. The edging was not fully installed, soil was not added in the front yard, the wildflower seeding was insufficient, and the grade was not corrected, resulting in drainage issues. I addressed this with Titan in Oct/Nov 2019. Nov 2019, I received this text from Titans project manager, *******************************: "I will give you some extra seed in the spring. I will also install edging and soil ** in the front. We also have a 1 year warranty on your project. So if the drainage is an issue Ill fix that next year. Please use this text as our agreement ******************************* Titan LLC If you could please leave a check on your door that I can pick up tomorrow that would be great."**** agreed to leave extra seed in exchange for the payment. He picked up the check and left no seed. He then questioned why I withheld $500 from the check. I understood that we had agreed to withhold $500 until the remaining work was completed. He stated that he was treating the remaining work as warranty work to be completed in Spring 2020, including the extra seed promised. Spring 2020 I called Titan to complete the work. The "lilacs" planted turned out not to be lilacs, as Titan confirmed, and agreed to replace them. May 2020, **** said he'd call me next week to get things done. Titan refused to correct the misplaced plantings and the drainage and failed to replace a dying plant they previously stated would be replaced under warranty. In September 2020, I reached out to Titan, hoping it would honor its promises and complete the project so I could pave my driveway. Titans response was rude and unprofessional. My expenses to re-grade, finish work, etc is $5500. My lawyer sent a letter Aug 2021. No reply
