      I recently went to Nelius auto sales to purchase a used car on December 14, 2023. I paid $500 for a $1000 down payment on a **** GMC ****** ****. On 12/16/23 I went to a professional mechanic at ************ services were the owner, ******* inspected the truck. While inspecting underneath, he told me that the frame and bottom was rotting out, the gas tank was held by a ratchet strap, and the truck was unsafe and shouldnt have been sold or for sale to be driven. On 12/18/23 I went back to Nelius Auto to speak to ******* who wasnt there so I called her and explained what was wrong with the truck to see if I could get into something safer or my money back. She was very rude, kept cutting me off, and would not listen to anything I said. At the end of the call she told me I cant get my money back or even trade. Afterwards I called the owner Cornelius who didnt answer but called back and I explained to him the issues going on with the truck and all he did on the phone was tell me all the good about the truck and the engine and how it was normal for the underneath to be rusted as he said, but it is not it is rot. They both expressed that I was not going to get anything back or a trade. They were not honest about the truck that they sold. It is a very unsafe truck to be driven and they sold me a lemon. I recently got online and looked up the lemon law, and according to what it states by law, I am supposed to get my money back or they are supposed to put me in a more safer vehicle that can be driven on the road. All I want is my money back or safer trade. They did not help me try to resolve the problem. If a car is going to be sold by law, it should be inspected to see if it is safe to be driven on the roads, and if not, should not be sold or even advertised on the lot or online. Please help me resolve this problem. I just want my money back or a fair trade.

      The office manager was never rude to the complainant she simply explained to her the conditions of the contract. She also referred her to me. When I spoke with her her concern was that she had been told by ************ that a rachet strap was being used to secure the tank and that the vehicle was unsafe because of that. I explained to her that fuel tanks are secured by straps and that there was nothing inherently unsafe about rachet straps.  I went on to explain that rachet straps are used to bind and secure tons of materials on trailers and heavy equipment. It is not clear as to what her complaint is concerning rust. That was never a focus of the conversation that I had with her. She seemed to understand that what I said made sense and stated that she was OK with that. The conversation was also amicable. My position is that a fuel tank being secured by rachet straps is not a cause for us to return her money or trade her vehicle.

      I am rejecting this response because:
      Not only did I explain the issues about the ratchet strap but I throughly explained that ********************* said that the underneath was rotting out and the frame also. No matter what I explained to them they only pushed and pushed to have me keep a car that is honestly unsafe to drive on the roads. I wasnt rude I didnt know that they were going to deny me my money back or that they put me in a safer vehicle which is only right. The truck I got sold never once said it had any problems with it, it never stated anything but the miles and that it was a **** gmc ****** **** extended cab. Did I notice that the truck bed was bent up. Yes I did but as I drive it more because it is my ONLY means of transportation the truck bed continues to raise up more and crack more. I dont want to pay for a car that is so expensive that is not only a lemon but something that if I continue to drive it, its going to fall apart. Constantly when I am out and about people will walk up to me or comment from a distance that this truck is unsafe to drive. That one day ** going to be driving and the truck bed will just fall off. I really value my life and I dont want it taken because of a dishonest business even advertised a vehicle that was not only rotting underneath and all the other issues I have previously mentioned but something that would either injure me or potentially kill me because its a lemon I really need all my money back or to be put in a more safe vehicle that is actually good. Currently I have paid ***** dollars for a car that is unsafe to drive and falling apart day by day. Please help me either get my money back or put me in a safer, reliable car. Please and thank you!
