On March 02, 2022, Better Business Bureau contacted Gymmatts regarding an advertising claim found on its website, https://www.gymmatts.us. Specifically, Gymmatts claims, "We aim to provide a memorable experience when you shop on our online store by offering quality products with top-rated customer service", "HOT SALE Last Chance", "30 Day Money Back Guarantee" and "100% Money Back Guarantee". Gymmatts does not provide the details of the guarantee.
When using the term “warranty” or “guarantee” in product advertising, the advertiser must clearly and conspicuously include a statement that the complete details of the warranty can be seen prior to sale at the advertiser's location, viewed on the advertiser’s website or, in the case of mail or telephone order sales, made available free on written request.
Sellers or manufacturers should advertise that a product or service is warranted or guaranteed only if the seller or manufacturer promptly and fully performs its obligations under the warranty or guarantee.
Retailers can advertise “sales” where they are offering a significant reduction in price for a limited period of time. At the end of the sale period, retailers can, in good faith, convert the sale price to a new regular price if they no longer claim a savings. "Hot Sale" or "Last Chance" suggests that the price is for a limited time, yet the products advertised carry the same claim.
The unqualified term “sale” may be used in advertising only if there is a significant reduction from the advertiser's usual and customary price of the products or services offered and the sale is for a limited period of time. If the sale exceeds thirty (30) days, advertisers should be prepared to substantiate that the offering is indeed a valid price reduction and has not become their regular price.
Consumers who have purchased products from Gymmatts claim that the products are not being delivered. Attempts to contact Gymmatts requesting a status update or refund are not being returned.
Despite written requests, as of April 30, 2022, Gymmatts has failed to substantiate or modify its advertisement.
