The contract was made on 3/28/24 to have a footing & foundation installed for 2 story addition on home. The addition consisted of 3 walls 10X14 roughly & was to match the existing home foundation. On 3/28/24 ******* was paid for materials & 400 for rental to ******* with Ge Renovations. Materials except brick arrived 4/4/24 & on 4/5/24 ******* & two others showed up & dug the footing & poured concrete for footing using 80 lbs bags of concrete mix. Then on 4/6/2024 the crew returned while I wasn't home, delivered the bricks & started installing the cinder block walls & was 2 layers high . After returning home that evening found 2 out of three was where in wrong location no allowing for the brick, several block joints missing mortar, the walls was 3 1/2 inches out square. also found footing was not poured thick enough either. Contacted ******* & mention i had concerns with the work. ******* & one other showed up on 4/8/24 where i expressed all my concerns & how several things didn't match quote. I asked where we stood & his words was it up to the customer because im paying for the service. I expressed only way this would be corrected would to be completely removed & start over. i advised him that neither one of us wanted that & i think that we should stop the job at this time. I asked for him to have all material removed from property & not to waste any more time with what they had started. i stated to be somewhat fair where we both was losing, he keep ******& return 5k to me. He stated he would call Lowes & have materials picked up & he could Zelle my money to ****** request cash because that the form of payment i used to pay him . He said that was fine. 4-11 he stated he would be by that weekend to pick his tools up & lowes would be picking up the material on 4-15. no one showed i have txt & called several time & have not been responded to. Im out money for materials that other contractors are refusing to use.

Customer was made aware that materials and rentals are non refundable. All materials where left in possession of customer since they belong to Mr. ***** Contract states that  contractor is only responsible for purchasing and delivering all materials on site and on time. Mr. **** was not satisfied with the work being done so project was cancelled and contract was voided. Labor was not charged since not much work was completed yet. All materials were purchased and left with owner. All contract cancellation fee were voided since we were only on the beginning stage on the project. Mr. **** is able to do as he wishes with the materials on site as it all belongs to him.

I am rejecting this response because: the job was cancelled due too it being done wrong & poor craftsman ship. Also if u wasn't going to return any money or return materials then you should of had the respect to tell me the day you was on my property.  You agreed to return the money, you stated that u could send it to me on a app & when i stated i prefer cash sense that how i paid you u agreed and said u would bring it back. u stated u would contact Lowes & have materials picked up that following week. if that was not the case why in the test did u state Lowes would pick up material that Monday. I may have the material that are left but u wasted almost a whole pallet of concrete, several bags of mortar & on top of it the brick u brought here are not the correct size nor colors to match the home.  you voided the contract when you didn't do the footing correct.  I still believe that you owe me money from wasted material & wrong materials. I was honest with you 100% and up front with you & i wanted same from you. I would like to come to a agreement.

      Sincerely,

      ***************************

work to be done by GE Renovations LLC, which included, but was not limited to, installing a metal roof to the home and porches (raising the roof line to a 4/12 to 8/12 slope), adding three dormers, along with installation of vinyl siding on gables and soffit and fascia. The quote was for $13,740 in materials and $10,200 in labor. ******* had provided a quote and a electronic contract was signed. His crew arrived on Monday, September 19, 2022, and began the project. On September 20, 2022, I asked if you had purchased all the materials and ******* answered yes. I asked about the metal for the roofing and ******* responded that you he was waiting for the framing to be finished so the vendor could cut metal to required length. I also specifically asked about the vinyl siding to make sure what ******* purchased and matched the existing siding and ******* responded that it was not a problem and he had ordered everything. After working four days, on September 22, 2022, I discovered ******** team was not planning to return until Monday, September 26, 2022, because the crews had already worked their hours for the week and because the metal would not be ready until Monday. However, part of the roof had been removed and was exposed to the elements. I inquired about the potential of rain and ******* responded rain was not in the forecast but that they would come and cover the exposed roof if it rained. On Sunday, September 25, 2022, it began raining. ******* responded to my call, covered the roof, saw the damage inside the house from the rain and confirmed his company would cover the damages. ******* assured me the roof would be completed by the upcoming Friday, September 30, 2022, in light of the predicted hurricane weather. However, no crews came on Monday or Tuesday (September 26 and 27, 2022) to continue the work, so upon inquiry, the reply was that the initial materials purchased were already used and an additional $16,500 would be needed for materials (lumber for framing, metal roofing, soffit, ***********., but did not yet include the vinyl siding). The texts also indicated that GE Renovations would not be responsible for any further damages from weather, referencing that the crew was initially not to remove the metal roof, but rather the crew was going to build on top it. The texts further stated that the only metal being removed was for front and back porch. This is completely unacceptable. I paid $13,650 as the quoted amount for all the materials outlined on the quote, and additional $4,500 for half of the labor. To now be told after the roof is already exposed, that another $16,500 in materials is needed is ludicrous. The rain damaged 12 rooms in my home - per their homeowners insurance, the cost to repair each room is estimated to be $1,500, which totals $18,000.While I *************************** was out of town, ******* came to my house on Friday, September 30, 2022, to pick up his tools. ********************* called ******************** myself and arrangements were made for ******* to meet Myself on Sunday, October 2, 2022, to discuss this matter further; however, ******* did not show up nor respond to texts.****** is hereby made that ******* immediately refund the full amount of $18,150, as well as pay $18,000 for the rain damage caused to the home as a result of your negligence in leaving the exposed roof to the elements. Its as if ******* was trying to force me and my wife into a corner by leaving the house exposed to the elements and then demanding $16,500 for additional materials to fix the problem, after ******* said he already had all the materials.
