I've made multiple complaints about noise upstairs with a dog which clearly stands in lease no pets or smoking but I was hit with a violation of smoking all because my stove was raggedy which they decided to replace . I called about a backup in my bathroom before I went to work and the same day I was fined $250 for lease violation for so called strong odor in which they said was smoke. It's like pulling teeth to get anything done around here I've sent multiple request to get something done but nothing has happened. I have proof people here have pets which it stated in the lease no pets allowed but its overlooked and the disturbance is out of control.Business response

A First Realty representative was needed to open Mr. ***** door for plumbers to repair an issue in his bathroom. Upon arriving the representative noticed a strong tobacco odor in the unit which lead to the $250 fine in accordance with the lease agreement. When Mr. ***** contested the fine, I went to his unit with another coworker. We both noticed the tobacco odor was still in the unit. Thus, the fine remained. Mr. ***** then complained that his stove smoked every time it was used. A technician was sent and determined that the smoke was coming from dirty stove eyes due to lack of cleaning and was a fire hazard. The decision to replace the stove was made due to the knobs being worn and hard to read. As for the upstairs neighbor with a dog, it is a registered ESA. I am rejecting this response because: they saying it smells like tobacco smoke in my unit and that is not the case everyone knows me knows I smoke outside because now if the smoke is a problem traveling inside they can fix my door which has a gap in it I told the lady sometimes I have my windows open I mean I can have my windows open if I choose too and to have someone come out to my unit while I'm there and tell me what my unit smells like. and just because its a so called service dog does that mean I just suppose to be disturbed day in and day out with the noise etc which I still go thru prime example this morning and over the weekend

I would be happy to allow ***** ***** out of his lease if that would be acceptable. I have reached out to the upstairs neighbors but due to ADA laws, I can not have the animal removed.
