On the week of May 8th sears was contracted to pour a 28x30 slab and to spread gravel on driveway and walkway. His original estimate was 5,900.50. He then proceeded to add fees and charges totaling almost 3,000 . The slab he poured is uneven by several inches the gravel was half spread and the walkway was never done. The final bill was 8,000. When he was notified of the issues by phone on the 27th of May his response was tto call me a **** At this time he is unwilling to make any adjustments or compensation.Business response

*** ****** contacted me by phone to inquire about getting a 28x30 concrete pad poured. *** ****** lives in Muscle Shoals, AL and I reside in Birmingham, AL which is 112 miles (1 hour 50 minutes) away. When I spoke with him, I told him I wouldn’t come that far just to give an estimate. And to have the job done correctly, I would need to see what he wanted done so I could determine exactly what the job entailed (such as whether I would need a machine to dig out and level the ground, if gravel would be needed to fill in, if the ground was packed and stable, etc.). He assured me that he had already taken care of all of that and it just needed to be framed and poured. When I get there with my crew to do the job, nothing had been done correctly. The ground had not been dug out and leveled. Because we had no machine, I had to pay my men extra to dig out this hard ground by hand. I explained to him that because it was done this way, the pad would not be completely level or on square. He told me that that was ok, he just wanted to get the pad poured. As you can see, there was no machine or gravel on the contract. I had to order the gravel, pick it up and have it spreaded in the spot where the concrete was to be poured. It was not in the contract to spread gravel in his driveway, but I did it anyway. The walkway was never discussed to have gravel. So the extra charge was for having to dig out the 28x30 pad by hand, pay for, pickup & spread the gravel. Everything that was done was agreed to by *** ******. And as far as the name calling, *** ****** insulted me first by calling me a ********* And I never called him a “*******”.Customer response

I am rejecting this response because: What Sears stated is not entirely true. I never stated that the area was totally flat and ready to pour.He is further lying because I texted him pics of the site. If he had any doubts or misgivings he had ample time to address them. As for the gravel for the pad all he had to do was arrange for it to be there prior to his start.
As for the pad being unlevel all he had to do was put his level gage on it to check it. Is he claiming he doesn't own a level?
Sears is an absolute liar. If need be I can provide audio of the phone conversation since he was on speaker and as such has no expectation of privacy.
What he needs to be asked is did he or did he not receive pictures of the site prior to accepting the job? He was also sent pictures of the walkway that was also to have gravel spread there by his crew. I can provide proof of him receiving the photos via text along with timestamp verification.
The reality is even if the ground was not level the concrete could have been poured in such a way where it could be made level. Based on his comments it is not possible to pour slabs on unlevel land. We know this is simply not true. That statement makes him either unskilled or incompetent when it comes to pouring slabs.

I am not going to argue back and forth with *** ******* I have stated the facts to the conversation with *** ****** and there is nothing else I can say. He told me the site was level and ready to frame and pour. I told him I couldn’t tell from a photo if the ground was level and I had to take his word for it and as previously stated, it was not.Customer response

I am rejecting this response because: he had ample opportunity to view the photos I sent him to determine the lot condition. He should have examined photos in detail. Once arriving and viewing in person he had the opportunity to cancel the job. Since slabs are poured on uneven land every day and are poured level he has no excuse. What I require is for A.T.Sears to promptly return $5500.00 dollars to me post haste. So that corrections can be made, and for the distress he has caused.

He completely lied through his teeth about several things such as he was supposed to make my driveway level with the grass, so that the lady next door could use my driveway because she doesn't have one. The big deal is that he did not pour the concrete to our established markings. These were painted on the ground/house where we had decided I would have just enough room to turn my truck around, I live on a busy road and didn't want to have to back into traffic, the other major issue is he left large piles of dirt 3-4' tall 6' long from scrapping the dirt with a bobcat. He reassured me several times he would spread the dirt out and pull the giant rocks(which would destroy my mower) out of the ground. This is after he first told me that it wouldn't take ME long at all to smooth the piles and dig up the rocks. Then he said he would have his crew spread the dirt on Saturday when he came to get his forms. I got home from work Friday and his forms were gone, rocks were still in ground and piles of dirt left. I shouldn't have paid till the dirt piles and rocks were gone after several phone calls it was obvious he had zero intention of cleaning up his mess so I had to pay another company with a bobcat to level the dirt out... Never should have payed him. He is a liar and con just wants a check and to move on to the next victimBusiness response

First, I never performed any work at **** ******* *** ********* ** *****. He has falsely provided an address that he has no connections to.
The work that I did for this customer was over 3 years ago which was to pour a new driveway at **** ******** **** ********* ** *****. Which we did and upon completion he was satisfied and had no complaints. Also, there is no neighbors in the house that he is referring to at **** ******** **. This Is a vacant house. And all of the other stuff he’s complaining about, I have no idea what he’s talking about. See pictures of the work we performed, again this was over three years ago, and as you can see by the pictures that he is not a person that keeps up his property. I have not changed telephone numbers or moved my shop and have not heard from this customer since job was performed. Everything that was contracted by this customer was completed.
