      Purchased an in-ground swimming pool from Summertime Pools, LLC. In less than a year the coping began to separate and the concrete began to sink along the outer edge of the pool. **** ****** was notified, numerous times, eventually he cam out a used construction adhesive to reattach a corner piece of coping. Since that time he has been notified numerous times about the continued sinking of the concrete and coping along the one edge. (We have a text message record of our back and forth notifications of this). His response has been to assign blame to one of his sub contractors that he hired. That is his issue, not ours, and he keeps trying to make it our issue. We just want the concrete and coping properly repaired in a manner that will prevent further sinking, so likely involving rebar rod attached to the pool rail. Additionally there are numerous gel coat cracks that are exposing the fiberglass below to water. Some of these are related to the way the pool was handled, and some are from his coping subcontractor not drilling pilot holes before attaching metal lath to the rim of the fiberglass pool. There are now rust marks in some of these cracks from the screws used. Also the skimmer was never grouted in around the coping and is unfinished. And there is a lot of missing grout where the coping was attached improperly to the pool, and also where it has pulled away from the settling, this needs to be removed and properly reset.

      Business Response /* (1000, 5, 2021/12/04) */ In the contract that Mr. ***** signed with our company states that we use subs. We did not mishandle the pool shell during construction. In the contract it also states under the Concrete decking portion that it will settle and crack. We used a 4000psi pump mix to help keep this to minimum. As for the cracks in the gel coat of the pool ( pool structure is ok ) Those are a manufacture issue and we are not the manufacture. I sent an email on behalf of Mr. ***** and I can not control their actions. Mr. ***** has sent me messages and I respond to them and I have been trying to come up with a solution to help resolve the issue. Consumer Response /* (3000, 7, 2021/12/06) */ (The consumer indicated he/she DID NOT accept the response from the business.) We do not disagree that they would use subcontractors, but they were not hired by us, we hired one company, and had no input on who the subcontractors were or to what extent they were involved. We would have built it ourselves if we were going to take this on. As far as the cracks in the gel coat, some are from the way the pool was handled, based on the observation of the two installations it took, and on the documents supplied by Latham the pool shell manufacturer. Summertime Pools, LLC did not follow the pool shell manufacturers guidance for lifting and moving the pool. Further some of these cracks are from the coping subcontractors failure to pre-drill the gel coat before screwing in the wire lathe. These cracks are a direct result of this shoddy work. Summertime Pools, LLC also failed to follow Lathem's drainage guidelines for the pool, which could be a direct causal factor in the settling. We also have these documents that Latham sent with the pool, that Summertime Pools chose to ignore. As far as cracks in the concrete, all concrete cracks, we have no issue with cracks, it is the settling that is the issue. The concrete needs to be either raised or replace on the other edge, and the coping needs to be reset. And Lathem and/or Summertime Pools needs to repair the cracked Gel Coat, and that is for their discussion as to who is responsible based on their investigations.
