      In Dec '23, I gave Sun mgmt notice that i no longer wanted them as my rental property manager after 10 years. My contract was for one year, going mo to mo after. I was to give 30 day notice on terminating. The contract was due to renew in May '24. THEY IMMEDIATELY went to evict the tenants. There was nothing in either my contract or the tenants that stated they should be evicted should ***'s contract end. The tenant and I both followed the stipulations in our contracts to the end. As soon as Sun found out the tenants were not moving out, they turned their usual ugly selves, and started threatening us. Then they kept the final rent payment, did not forward my portion and did not return my maintenance deposit. They say this is my consequence for deluding them. They did not ever check on my property the entire 10 years of the contract.

      I am sorry that you have been mislead. I will attempt to explain and clarify the situation. We had a management contract with *********************** and managed her property sucessfully for many years. The management contract plus correspondence from *********************** will satisfy our legitimate and legal actions. The tenants are tenants of Sun Realty not ***********************. She agreed through and addendum we attached to our lease to hold a portion of the tenants rent toward ******* money as they wanted to purchase the home one day. That is the question I ask her below about returning the held funds to the tenants. As you will see from her own correspondence, she was in total agreement this is how everything was suppose to happen. Months later she admitted to the default when we were trying to do our job and remove our tenants following procedure. I have included that as well.  *********************** tried to deceive the management company because she knew what was in the management contract. Now, she is not telling BBB the truth. We have not performed anything outside her written acceptance or in accordance with the management contract as you will see below.

      Sorry to hear this. It was good working with you as well. I will need to move our tenants out of the home. So, I will give notification to them. There is the matter of the money you have been holding for them. How are we to handle this?

      Ok, the earliest we can cancel is the end of their lease contract. We will do the move out inspection and handle the security deposit as required. If they have left damages we cannot legally turn the security deposit over. We must have repair bills proving what the security deposit was used for. Hopefully there are no damages and we can just return their security deposit. So, we will figure all that out when it gets closer.

      *****, Please send me the total amount you have for the ******* money. We have to notify the tenants plus send them a non renewal and official notice to vacate, plus our notice of inspection.       *************************** management contract is terminated due to Owner default. This is the section of paragraph from the management contract. It is found on page 1, #2. *********************** has her copy:

      If Owner terminates this Agreement or if Manager terminates this Agreement due to Owner's default, Owner shall immediately pay Manager all fees and commissions they would have earned had this Agreement not been terminated but instead had been in effect for the entire term set forth above(24 mo). Manager may deduct the full amount of such fees and commissions from any monies being held coming to Manager which would be due Owner.
