      My parents, who are over 80, have been trying for several years to get M&N Roofing to come look at their roof. (M&N may well have originally re-roofed my parents' house over five years ago, their stated warranty period for workmanship.) I cannot find a contract or any paperwork. All I have is my (now) late father's word, via my mother, that it was M&N who put the roof on. Most recently, my mother called them, and they said they would come out Thursday, 8/11/2022. They did not show and did not contact us to explain why. I called M&N this past Monday, told them who I was, and they said they'd be out to look at the roof on Tuesday morning. On 8/16/2022 "John" came out to the house, but the visit was very brief. I showed him the roof and told him that the shingles had not been nailed properly, per the manufacturer's (GAF) instructions. He disputed that the nail MUST go through both parts of an architectural shingle, and claimed 30 years of experience to back up his claim. (The manufacturers of such shingles are clear that the tar that holds the two halves of architectural shingles together, prior to installation, is not intended to bear the weight of the shingle when installed on the roof--particularly a steeply pitched mansard-type roof.) When I persisted, he suggested that since I knew so much about the subject, that I should get up there and fix it. He later sent me a text stating that the warranty period was out, that it was wind damage ... etc. The attached images show the state of the roof, that there are no nail holes in the shingle pieces falling off, and the manufacturer's instructions.

      Dear BBB I’m not sure who he called that didn’t show up because I went when I got the message. I went to this address that I think I’ve been to before , soon as I got out of the truck this guy started Ranting & Raven at me telling me he’s done his research (everyone’s engineers nowadays with E-Net) but I tried not to take it personal. I always try to help everybody that I can I wouldn’t even have went it I hadn’t wanted to help him. Even tho as he stated(the warranty is out ) for the labor .  Had he talked to me and treated me in a respectful way I would have tried to help him anyway. Because I remember his dad and he was an outstanding guy that treated everyone good( like I hope I do ) . I guess he didn’t inherit those same qualities. But nevertheless it is not warranted and this keyboard warrior is mean / disrespectful / and he knows more about Roofing than I do lol and he knows that it is not under warranty so I don’t even understand why we are even having this conversation. I help everyone that I can all that I can some folks I don’t even know and I take a lot of pride in that, that is how I was raised long before I went into business. But this guy made threats to me about BBB/small claims court , while at the same time asking for my help . So yes (even though I shouldn’t have) . Because two wrongs don’t make a right, so I did tell him if he knows more about it than I do for him to handle it. In my defense, I went to him willing to help him and no I am not interested now. Thank you BBB you’ve always been fair to myself and the third-party.

      I am rejecting this response because:

      The business owner did not address the evidence provided. The shingles are falling off the roof because they were incorrectly installed.
      In addition to the photos that I attached, the BBB is welcome to come to the house and see for themselves that the shingles coming off the roof do not show evidence of being nailed.
      I am, in fact, a structural engineer. (I'd be more than happy to provide proof to the BBB.) 
      The business owner's anger began the moment I tried to explain how the manufacturer intended the shingles to be nailed.
      It doesn't take a ninth grade education to understand the manufacturer's installation instructions.
      My father called this business repeatedly several years ago about a roof leak, while the warranty was still in effect, so the owner essentially ran out the clock on the warranty.

      We accepted a quote for a fascia repair, and the business received the full amount as a downpayment. Several months later, the company had not started the work, and statements about the start date were not honored. After more than five months had passed without any work done, we requested a refund. The business agreed to this, but the refund never materialized. Attempts to get back in touch with the company failed, phone messages remained unanswered.

      Business Response /* (1000, 5, 2021/12/15) */ Due to the Pandemic we've had more guys than normal out from work , we've had to Decrease our workload accordingly (hoping it would work out to do the repair before it came to this.(returning a refund)because we've built a reputable business by doing what we say (how we say) but the COVID-19 thing is out of our hands. However we don't mind issuing a refund at all the problem is the legal issue that Mr *********** didn't pay for the repair therefore we don't know 100% if he is entitled to it . So here is where we stand we will gladly issue the refund then of the $1475 to the person that paid for it. We have tried to talk to him and he acts like he don't understand but it is real simple please have him to get in touch with the person that paid the monies and have him to call us. If he needs to have him to call me on my personal # XXX-XXX-XXXX thanks . Or if the BBB can give us a guarantee that no one else can have a claim against our business arising from this , We don't mind . Before my outreach to the BBB, the person who paid the down payment spoke with the company's office four times already to facilitate the refund. Involving the BBB made a difference. Another outreach from that person has now led to a satisfactory resolution.
