      Bailey's Landscaping was hired by me and my husband January 2023. Their commitment was to install three to four inches of pea gravel around my house. The other was to install French drain in front of the house and a sloping swale. Because of drainage issues living on a mountain. Although they were paid for both jobs. Certain issues have come up concerning the functionality of the swale. They first used half of the pea gravel that was supposed to be put around my house in the swale. They also used 100 ft of corrugated pipe in the swell that belong to me. I purchased from ******. They also did not slope the Swale. When they came back a second time and brought River Rock. They failed to pull up what was left of the pea gravel. They did not realign or dig swell on a slope. They just laid the river rock on top of the pea gravel causing more drainage issues. I also destroyed property by piling up dirt in an area of my yard. I now have to weed eat and use machete I keep maintained the best I can at 65 years old. My husband passed in March just 2 months after Bailey's Landscaping was hard to do the works. When they came back the second time made matters worse. I now have I swale ************* uphill. **** Bailey was never on the job with his workers to give proper direction. The workers also could not speak a word of English. Making it impossible for my husband to communicate with. **** Bailey is unprofessional and arrogant because he does not understand that ****** don't run uphill. He also thinks it just because my husband is no longer here that the problem will go away. We were given a one-year guarantee The Works would be functional and it all fell apart Within weeks of installation.

      I am rejecting this response because:

      I chose not to pursue the matter in court because it involved resurrecting my my husband's ashes and reliving this very sore subject over again.

      I'm still living with a non functional uphill swale and damaged property. **** Bailey is not licenced. He has no brick and ****** business. He has no equipment other than shovels, bucket and one flatbed truck. His workers are undocumented ********* scabs that speak no english.  only in America can a person build a business out of thin air and Rise To The Top.

       

      The estimate to fix by a licenced landscaping is about $2200. I've been digging up the swale myself. So to make it cheaper when they come to fix.

      On March 2, 2022, I was told that they would get started on my yard in 3-4 weeks. They finally finished on June 29, 2022. Within 2 weeks after they had finished and I had made the final payment, I had 2 of the 6 trees that were planted die. I contacted **** and asked that he replace the trees and also make a few corrections to the retaining wall that they built, and a few minor fixes. We set a date that he would come by and we could discuss what needed to be fixed. He texted me after the appointed time saying he was running late. He never showed. I finally just sent him pictures and details of what needed to be fixed. He said no problem. Every week after that, I was told a different excuse about why no one came to take care of the issues. After hearing "I will get you taken care of by the end of the week" countless times, they finally came and pulled out the 2 dead trees and put some sand in a low lying area in the yard on September 2, 2022. No one ever came back to replace the trees or to fix the other issues. On September 6, 2022 I started messaging **** every other day to find out if anything was going to happen. As of today, September 20, 2022, nothing has happened and he has not answered any of my calls or texts since September 6. I just want this job finished.

      This job is complete. I do not understand. I replaced the trees and fixed the wall after she told me she was happy with our work. 2 trees didnt make it so I went back and picked them. I told her my supplier was waiting on a big shipment to arrive! That it could be weeks. We do apologize. And the job is complete. Thank you.

      I am rejecting this response because:

      On June 6th, I paid for the completion of the work that Mr. ********************* company did. A few weeks after payment, I noticed that two of the trees that they had planted were dying. I contacted him to inquire if the trees could be replaced and to also ask if he could also fix some other problems that had come to light. There is a dip in the yard that had been sodded over in the middle of the of what was supposed to be usable yard space. When I watered the sod and trees, and when it rains, the dip fills up with water, which sits stagnant for a time, and then leaves a muddy mess after the water finally drains. Additionally, after some days of rain, it had come to my attention that the end of the retaining wall needed to be reinforced in some way because the rain was already washing mud down from behind it. Since they would be coming to take care of these items, I also asked him if the rock they had laid for water diversion could be altered. Mr. ******************** agreed to the fixes that I had asked about and indicated that he understood my concerns. He even complimented me on the pictures I sent him to show him what needed to be corrected. (The pictures were sent after he stood me up for an appointment that we had made for the previous day by texting me running late and then never showed.)

      On August 24th, Mr. ******************** texted me, saying that they would be there tomorrow (August 25th). On August 29th, I texted him to ask if they would be coming soon to replace the trees and fix the other things he had agreed to. He answered immediately saying that he would be by to fix everything by Friday of this week. On Friday, September 2nd, they did show up and Mr. *********************ent me a text saying They got the two trees and put some sand down. We need more. They will get the trees and sand Tuesday. [September 6th] In the same text he also said, He got a block count so we can fix the wall the way you want it. Nowhere in our text exchange from August 24th through September 6th did he tell me that, as he states in his response to this complaint, his supplier was waiting on a big shipment to arrive. He stopped responding to my texts and wouldnt return my phone calls on and after September 6th.

      On October 3rd, Mr. ******************** finally brought two trees to replace the dead ones and fixed the retaining wall. They did not bring the sand he had mentioned to fill in the dip. At this point, I had already purchased and planted two new trees, but I am glad that he adjusted the retaining wall. I doubt I will ever see the sand to fill in the water retaining dip in the yard. That will be more money out of my pocket. I write this response only so others can see what to expect if they do business with Mr. ********************.

      Im completely shocked. I fixed everything she asked. I also said I can change the rock if you would like me to. She said no its ok. I didnt have a problem with fixing that. Wall is fixed and trees are there. Again I apologize. at the same time I feel attacked by these comments. Ive medicated daily as needed. Thank you

      We hired Bailey Landscaping in Aug of 2021 to build a retaining wall (90 long x6 foot high) to keep the hill from washing. We gave him 1/2 up front ($6500) for supplies. He was supposed to start in about 2 weeks when he received the supplies and "be done in 2-3 additional weeks 4 tops". its now the end of June so 10 months later.... and he still has not finished the wall, the hill has also washed out just about to the top of the wall and now because the work wasn't done properly whoever finishes the wall will have to shovel out (by hand the dirt that's 2-3 feet deep the entire length of the wall. **** sends 2-3 workers for a couple hours every 2-3 months. He has more excuses than anyone I've ever met. from rain, covid, the block company gave our block to someone else (probably because he didn't pay for it with the money we gave him), personal issues, and the list goes on. those are the excuses when him or his worker actually take the time to respond. most of the time, there is no response at all. like when I filed my first complaint with the BBB about this issues, then he text me and said he'd be out Thursday. but on Thursday he was a no-show again and when I asked what time they would be there, there was no response and here it is Monday and still nothing from him. My husband also reached out to him and he hasn't gotten a response either. At this point, we're tired of all his excuses, if he truly wanted to do the job, he could have found time in the last 10 months to get it done. It will cost us considerably more for us to find someone to fix his shoddy work and get it done now due to his incompetence, poor work and lack of professionalism, and higher cost of everything. We are requesting 1/2 of our deposit back or for him to deliver the rest of the block for our wall. he can eat the labor cost well call it even for the interest on our money that he's been holding and the inconveniance of almost a year dealing with this and still not having it resolved.

      In response to your complaint we would like to apologize for the timing when it comes to the completion of your project. As a small business we having been fighting a loosing battle when it comes to shortages, lack of employees, Covid related delays, and not to mention natural issues such as weather. We had reached out to you via text June 3, 2022 in regards to coming out and working on your wall and never received a response. Again we reached out on June 21, 2022 and you informed us that you didnt respond because there was going to be rain in the area, but when we had originally checked the forecast we werent showing any rain which is why we were trying to set it up for us to come out. Honestly; if given the chance we would love to come out and complete the job. The past 2 years have put a strain on our small business but we are still trying to do the best we possibly can given the circumstances to still keep our clients happy.

      I am rejecting this response because: in 11 months, you have started and finished other jobs while ignoring ours. You had 11 months. Its not that not that big of a job. The one time we did not  responding to you does not excuse the multitude of times you have ignored our inquires of when you would come back out. (BTW it rained 4 of the 5 days that week) we are done wasting time. You told us up front 2 weeks to get supplies after you got our money and 2 months tops to finish. Please just finish the job. We need this wrapped up or we will pursue other avenues which will include recouping our losses. I hope to see your team Wednesday morning as you stated Friday. it still shows 50% chance of rain so it would be great if you could come out Tuesday (tomorrow). Your pattern has been to ignore us until there is rain in the forecast and then you try to appease us by promising to come out, knowing good and well you're not coming in the rain, nor do we want you to come out in the rain. it would have been good to have you out today as I requested Friday. please just finish the job this week!

      We are working on the job. This Job is almost complete. Home owners are happy. And understand that we had problem threw the winter with rain and block shortage. And this spring we had troubles finding workers just like all other small companies so we got Behind. At this point all is good and the wall is almost complete. Thank you! ??

      We used Bailey Landscaping to build a retaining wall and flagstone patio. It took 6 weeks to get work started which was ok. Half the agreed amount was paid up front for materials and the other half was paid upon completion of the work. Work was completed in a few days and all was well. Five days after completion the flagstone began to break and crumble from Improper installation. We contacted Bailey Landscaping about this issue which was about 10 months ago. He promised to return and fix the problem and admitted he knew what was wrong and how to fix it. After dozens of unanswered texts we finally were given close to 10 different dates which we took off work for and he stated he would show up to fix the patio. Most of the scheduled times the company no showed with no notification until we contacted them the following day. We were even told a couple of times they were coming that evening and still no showed. After hearing every possible excuse as to why he has not shown up to fix the issue we have decided to fix the improper installation and poor craftsmanship myself. I have expressed my feelings to Bailey Landscaping and I will never use them for work nor recommend them to anyone else.

      We have come to and agreement on this job. The home owner is out of town this week. We are going to fix the patio next week. Water from the ******************** is running under the patio! And causing it to ***** the soil from underneath the patio We are installing a drain to catch the water and run it away from the patio! Natural causes.

      We met with Cody at Baileys' multiple time to get a quote on our job, which was to clear a hill (large trees included), rock the hill and install a retaining wall before we have a pool installed. We agreed to a price and put 50% down on 4/26/21. I have followed up almost every week and similar to the other complaint have heard every excuse. Over the last 7 months they cleared the small stuff on the hill, couldn't get the large trees down so I hired another company to do that. They did agree to cut the bill down, so that was positive. Then they installed the weed screen (this was September so 5 months into it), and now we sit idle again. Total time spent on this job over the last 7 months, I would guess to be 10-25 hrs of labor.... At this point the pool is to begin in Late November and we need the hill rocked before Thanksgiving. We are ok letting Bailey's continue if they can meet this deadline if they can't I am asking for a refund of our money. I have in writing where Bailey's agreed to be at our project everyday until completed but they haven't held up their end.....they actually broke that agreement within 2 weeks of making it (again September). We have given them the option to refund our money multiple times as they let our project sit idle and every time they said they want the business and can do the job (again I have this in text and e-mail).

It is even stated in your contract that you agreed to the we were going to be using pool dirt to backfill your retaining wall. There would be no way for us to do this if both companies were not working simultaneously together. Also as we have discussed previously in regards to the "big trees" we were able to do those as well but once again we were going to be working with the pool company and bring in heavy equipment when they had theirs in so we would not have to track up your property multiple times when there was no need for it. As far as our agreement goes we are a small company so we hired a company to bring in your rock and they have had issues getting it to us which you have also been informed about, and when you asked if we could arrange one of our company vehicles to deliver we told you we would try to free something up and would let you know something by the beginning of last week. You reached out to the owner of the company via text message last Monday regarding your job in which he responded within 3 minutes of your original message and you have still yet to respond; instead we have received this complaint and would appreciate if we could come up with a reasonable solution to fix this issue. The response did not address the past 2 months of this company not getting the hill completed. The hill being completed has nothing to do with "working with the pool company" and is the main focus of the complaint. I listed 2 reasonable courses of action, first being prioritize our project to finish the hill or refund our money. I am sure there are multiple companies that will deliver the rock. The reply from Cody said "Hello. Mike. I've got one wall I'm trying to finish! And I'll have a truck that can run rock! I talked to Bo today he's looking at 2-3 weeks! I'll have my rock down by the time he gets started digging the pool. Which is perfect timing! So I can move strait to the wall!" This was received on 11/15, so Monday 11/29 will be 2 weeks with no movement at our home. There are other statements that are incorrect on the response, one being "we didn't want to track your yard up twice." It was never disclosed to us that Baileys would not work on our project until the pool company was ready to start, we would have chosen another company rather than give almost $9000 to your company to have nothing worked on for 7 months. Only thing was they would use the dirt from the pool to backfill the retaining wall and fill in the washed out spot. The hill we were under the understanding would be finished in June/July after we met with Cody and he said he would be at our house in two weeks. Since Cody's reply said the rock would be down in 2-3 weeks then having the hill completed no later than 12/6/21 is acceptable or if that can't be met then a full refund is acceptable. Thank you.

      On May 18, 2021 Bailey Landscaping entered into a written contract for landscaping at my property. The property belongs to myself and my siblings. My sister ***** resides there and is the contact. To date Bailey Landscaping has not fulfilled its portion of the contract. Over the last six months, Bailey Landscaping has verbally committed to get the task completed 6 times, the latest being starting work on November 8, 2021. The commitments were made by the office manager *******. None of the dates were honored. Bailey landscaping did not call to cancel or to reschedule. I have tried to establish contact with Bailey Landscaping every work day since they did not show on November 8, 2021. I have been forced to leave messages and none of my call have been returned.

Six times they have failed to show, 6 times have failed to call. 6 Times they have not rescheduled. If the failure to show is due to rain. One day of rain equals a 30 day delay. They set a firm date of November 8th, 2021. There was no rain, no reason for them not show. They did not show, they did not call. Now the work has been put off for 3 more weeks. Past practice says they will not show on the 29th and they will not call. They have latched on rain as an excuse. The real reason is that Bailey Landscaping is pushing our work to the side so that they can take on bigger more lucrative contracts. Shameful way to treat persons that entered into a binding contract with good faith. GET THE WORK DONE. Call if you have to reschedule. Then reschedule not delay. Horrible way to conduct a business.
