      On May 2, 2023 as I was traveling the service road that runs alongside ******************************* in *******, **, and I was passing a man on a big industrial sized mower, all of a sudden my passenger and I hear a huge "BOOM". It was so loud it sounded like a bomb went off. We immediately stopped to find out what had happened. We discovered that the mower had shot a metal Yetti thermos out of the side of the mower. I tried talking with the workers on site and they were very unhelpful. Their supervisor came to the place where the incident occurred and took pictures. I was instructed to send in 3 estimates as to what the cost of repair would be. I did as asked only to then be told that they didn't plan to pay to repair the damage. I don't believe it's a law just generally common knowledge and common sense that when you are mowing you never have the out shoot pointing to traffic. At this point it's not about money. I just want the vehicle repaired. My husband bought me this vehicle before he passed away last year because he wanted me to have a nice vehicle to drive and now it's got 2 beat up side doors. I have attached pictures of my door, the Yetti and an additional photo showing how the Yetti fits perfectly into the damage.

      The following is our response to our representatives with the City of Decatur on 5/19/23 (our client at the time of the alleged incident):

      I wanted to give you a heads up regarding an alleged incident with a lady regarding damage to her vehicle.  ******************* stopped at one of our work sites on 5/2/23 to claim that we caused damage to her car.  We had the police come out and do a report on the incident.  ********** officer did perform the report.  I have attached the police report, our incident report and photos.  The officer at the site didnt feel that it was damage caused by us as he indicated to us verballyhe didnt include this in the report, nor did he include that we did the damage.  He simply remained neutral in position.

      She tried to hold the cup up to the damage to say that it would fit the damaged area and it clearly didnt from everyones opinion at the site.  We have denied the claim and suggested that she take it to a small claims case if she feels that it is warranted.  As you might expect, she is upset by this that we were not simply paying for the damage.  She said that she would contact the mayor about the incident. We are in no way denying responsibility for our actions, but we dont feel this one to be warranted or valid.  Your department could likely follow up with the officer to get a better understanding of his opinion while on site that day.  

      I am attaching the police report, our internal incident report and photos of the alleged damage and metal cup.  We reported back to ************* on 5/19/23 that we were denying responsibility of the claim.

      I am rejecting this response because:

      Thrive Outdoors workers did cause this damage to my car. My passenger would be more than happy to give a statement of exactly what happened that day. I assure you that I don't go around causing damage to my own vehicle. That is a ludicrous thing to even say. I guess they are ok with damaging a disabled widow's vehicle? I have in fact contacted the Mayor as well as the ********************** of the **** of Decatur regarding this matter. I fully intend to take this matter as far as possible. At this point it's more about the principal of right and wrong as opposed to any financial matter.
