      We moved from ********************* on February 15, 2023. The house was cleaned and pictures were taken. A shed and truck was left on the property but was picked up a couple days later. The security deposit was $950. They charged a $300 cleaning fee. So they said that left ** to get $650. They never tried to give ** our money until the month of April, without our persistence. We never got an itemized list of the cleaning charges. We were told to come get the $650 but all they tried to give ** was a charge of $450 from them. Why I don't know and this was at the end of April. The new charge of $450 came up at the end of April. This whole time from February - April they kept saying they were going to give ** our security deposit back. But we still have not received it. We want Cummings Real Estate LLC to pay our security deposit back! Security deposit of $950. We were dealing with a woman names Charity that worked at Cummings Real Estate.

      The Wades were inherited tenants at *******************************************************************; 35810.  When we first inspected the property we told the owners that the tenants were treating the property like a car lot with lots of vehicles, trash and debris around the property.  We were afraid at that time to get a City complaint.  After discussions with the owner, she wanted to keep them there. 

      Tenants are claiming that they left the house clean but that was not the case.  They turned in keys to our office and our office manager, ***************************, went to inspect.  While she was there she noticed personal property still on the premises - trailer, vehicles, and a shed.  The Wades showed up at the time she was there and they began arguing with her.  Charity told them that they were not fully moved out if their property was still there.  She explained that after possession is turned over that anything left becomes abandoned property.  Charity then gave the Wades until the end of the month to remove the remaining items and they were charged for those days.

      After the move out, they called the office and/or came to the office to bully my staff regarding the security deposit.  We get 60 days to close out the account and due to the damages, we were still working through their repairs. 

      Instead of being patient and waiting through the process, they called to bully the elderly owner and convinced her that our company was paying them a partial deposit and that she was responsible for the rest.  She then paid them $300.  When we found out, we deducted that amount from the security deposit as already received.

      As time passed and contractors had completed the renovation work, there is evidence of constant breakins.  When I inspected myself, there were drinks and pizza boxes around the house and the heat was set to 90 degrees,  The locks were changed for a second time.

      After the locks were changed, the garage door was damaged and a fence post was cut.

      After the house was rented, we sent a maintenance tech to change the locks for a 3rd time after tenants claimed that someone was breaking into the house.  While the maintenance tech was there with tenants, the Wades pulled up into the driveway and started cussing everyone out.

      The Wades have pushed this complaint after finding out that they would not be receiving any funds back.

      After returning keys, the Wades had NO business returning to the property and were, in fact, seen at the property on multiple occasions in addition to the evidence of breakins while no one was around.  They are not entitled to any funds back and have been crossing the line of criminal behavior.  The new tenants have installed cameras and a security system due to the incidents and we have encouraged them to file a police report against the Wades.

      Their whole complaint has no truth in it. We have never broke into the house we rented on **************. We have never pulled up on anyone, cussing them out. Their company is so unprofessional. One of the company's employees, it was a lady she cussed my husband out on one occasion. They never gave us a itemized list, when we repeatedly ask for one. They didn't even do a walk through until 2 months later after we moved out. They stopped communicating with us. They totally ignored us like we were just going to walk away from our deposit. We stayed in that house almost 5 years, never missing a payment. We refinished the bathtub twice. We told them about the tub.The bathtub was terrible. They said they didn't fix bathtubs. It had mold on it. We also fixed the whole air conditioning system through the house, when we first moved in. They didn't start dealing with us until the last year or two we stayed there. The owner switched over to the company in the last year or two we stayed there. Our yard was always clean and yard always cut. We were not using it as a car lot. The owner saw our yard on different occasions, never a complaint. If anything had to be fixed, we fixed it. The owner and the company never got a complaint about us at that house the whole time we stayed there. We were good loyal tenants. So why is there a problem about our security deposit? Thank you

      I have attached pictures to show a small portion of how dirty the house was upon inspection. This inspection was completed within 48 hours of the Wades returning the keys the second time. You can clearly see the damaged blinds, mirrors, toilets, floors, etc. were dirty. I explained to the Wades before their move out that in order to avoid a cleaning fee deducted from your deposit that there is a list of items that must be cleaned. I listed, window *****, cabinets, appliances, ceiling fans and so on. They assured me it would be left "move-in" ready. As you can see, the home required scrubbing from end-to-end in order to be move-in ready. 

      The Wades called the office EVERYDAY, multiple times a day, attempting to bully ** into returning their security deposit. They starting calling and asking about this before they had even turned in keys. Each of our office employees can testify to the fact that they were harassed at some point by the Wades. The only way we got the Wades to back off and stop calling and stopping by the office was telling them we'd have to report them to the authorities if they continued to harass our employees. 

      We did not charge the Wades for the multiple times we had to rekey the house due to their trespassing. One of our contractors was at the house working when they stopped by and when we let them know they shouldn't be on the property, they informed him that they had a right to be there anytime they wanted. They continued to use the yard for parties, etc. even after they'd turned in the keys. We have witnesses of each of these statements.

      I am rejecting this response because: They have told nothing but lies! The neighbors across the street that we know, have cameras. We have not had a party at that house the whole time we stayed there for 5 years. So why would we have a party after we move out. They lying about everything. Why we can't just get what we are owed? We have not talked to any contractors. They need to stop their lies! It's not about the money, we just not going to walk away from what we are owed. They need to tell the truth about the matter! They never had a problem from us the whole time we stayed there! Thank you

      I signed my lease in Apirl I didn't move in until May 5th I emailed the landlady to let her know that I can't move in until May all I know that was fine I I gave them the 1700 instead of the1303.33 for prorated rent. She bring me an eviction notice saying I own for April. After all the calling I did for months May and June didn't no one have sense to let me know nothing. I have pictures and emails of everything from the roof leaking to the stairs that some one fixing now but the whole porch are rotting wood that nails are coming out. I have no air and the back porch are not stable. I paid my July rent 07/06/2022 and she emailed me a 7 days notice for 900. I let her know that I will clear that up on my next check not next week by week after

      The title of the complaint says repair issues; however, she details her rent issues so I am responding to the rent issue.  Ms. *** signed a lease agreement for April 15th with that move in date anticipated.  We allowed her some time with the April payment because she was a referral from an organization and she was seeking assistance.  She is now coming back to claim that she does not owe it after each and every one of my employees AND myself have explained it to her.  She claims that she was unable to get her lights switched over until May.  This, unfortunately for her, is another violation of the lease and she would actually owe the owner compensation for those days of utility use as she had full possession of the unit whether she claims to or not.  She had a lease, she had keys; therefore she had possession.  We are sorry if her anticipated funding did not come through.  The owner is wanted her to be evicted and she received notice of eviction hence the complaint.

      Regarding any repairs, we have a few minor work orders on her apartment that have been assigned and we did a repair on a broken step yesterday.  We anticipate that the complaints will not cease until the eviction is complete.  If she had reached out to us for assistance (with her funding), we may have been able to help her with the organization that told her that they would assist.  We work with all of the assistance organizations.  We unfortunately allowed her to enter in anticipation of funds and now she is filing a complaint against us when we helped her get into the apartment.  We will be very mindful of this in the future.

      I am rejecting this response because: I didn't have no keys and I didn't use assistance I have a job and when I did talk to ******** she told me I owe money ******** told me to reach out for assistance.  I didn't get the keys until May 5th that's when I got the code from *** and ******** word was I thought you moved in already that was Apirl 27 I said no I won't be moving in until May. ******** also said that she was about to rent the apartment out because she thought I was moved in. I have emails and text messages when I been trying to contact them. I talked to *** numerous of time I always got the same answers from her I also talked to ****** numerous of time and nothing. They communication skills are not right. I talked to some one they said ******** didn't finalize the lease until April 15 and I emailed her Apirl 15 with no response from ********. I told Her I had no problem paying the back rent she say I owe but can I pay it with rent by adding extra and still I got no response from her. I also have an email to prove it.

      Ms. *** signed her lease agreement and agreed to the terms irregardless of where she was going to obtain funding.  We help a lot of individuals that are sent from the programs.  She WAS given the code because she was able to enter, view and accept the unit.  If she forgot her code or needed it again she could have asked for it.  The key was accessible to her and she was seen to have possession on the lease date.  When I spoke to her, I told her that I could work with her on accumulated late fees if she would just cover the prorated rent that was due - right now that is nearly half of her balance.  Instead of a compromise, she wishes to battle and the owner has told us to evict based on her failure to pay- hence the complaint.  Ms. *** has sought no compromise except that she is right and we need to remove ALL charges.  This is not the case.  The contract speaks for itself and we will stand by it.

       I am rejecting this response because:

      Now as you can see who was doing all the talking and emailing me. But as you can see I never got a response. I didn't get help from no organization. She never asked me to work out nothing I did all the asking if I would have got an answer. I wouldn't have contacted you all.
      I never said I wasn't going to pay them as you saw in my texts and email of me asking can I pay this way an again no response. I said Im paying. Why I didn't get a call in Apirl about the balance of 433.33 instead of waiting until the balance get to 1000. Again I never talked to ******** the only person I talk to was *** and ****** once or twice .but mostly *** never ******** I left messi texted and emails.

      I moved into a home in January and the landlord hasn't fixed anything that I've put in maintenance requests about. The main thing is the ac unit. It only cold down one room in the house. The rest of the house gets up to 85°. She sent an hvac tech to look at it but he claims nothing is wrong with it. None of the vents in other rooms really work and my utility bill is extremely high as it was in the winter. It's got to the point where we have to retreat to one room with the ac off just to save money or it will constantly run even in auto mode because its so hot in the home. I've put in a couple maintenance requests, a couple in the winter and I've made one this summer. The house is also not ventilated well you can feel warm air coming in from various places in the home. I've reached out to other tenants of hers via Facebook and she has lots of other complaints from tenants who's maintenance requests are also getting ignored

      There is an extreme heat wave going on right now which, of course, is an Act of God not our company.  HVAC units are working if they are cooling 20 degrees below the outside temperature.  That means if the heat index is well over 100 degrees then the temperature inside could be in the 80s.  Our own office has been maintaining 83 degrees this week due to the heat.  This is a problem all over the City and is documented by the news professionals as well.  This is not a company issue, this is a weather issue. 

      This young lady goes by ***** online (Check On Yo Folks) and rounded up her people to intentionally make complaints against our company.  These complaints have no validity and we will fight each one.

      I am rejecting this response because:am rejecting this response because: That's not true haystack it got up to 86 degrees in the home it was so hot we couldn't stay here. During the winter time it was cold in other rooms and we couldn't go in them. Two out of three bedrooms stay so hot we cannot go in them nor sleep in them. There's a gaping hole in the ceiling and the door frame isn't sealed properly allowing air to seep through. The air vent in the second bedroom barely blows out any air plus there's a crawl space in there that isn't sealed properly allowing air to seep through.If no action will be taken I and a couple of other tenants of hers will be going to speak with Clarence at city inspect on Monday and also Holly with legal aid. Furthermore I do go by ***** on check on your folks and yes I did enlist other tenants to group up and make complaints against her as she is  known not fix anything her tenants complain about. Just like in the winter time I complained nothing is sealed properly and air is seeping in from just about every part of the house.
