On or about 2/21/2022, an agreement was made with ***** *******, to install an asphalt driveway, with side parking areas, totaling approximately 17,000 square feet. Asphalt was to be two inches thick, with appropriate base material, and included paving an area adjacent to the mailboxes on the side of the road, to facilitate a vehicle approaching and departing without encountering an unpaved surface. A specific area was clearly marked to be paved for future installation of a large carport. This area was to be 36 feet wide. The total price was agreed to be $******. Work commenced on March 1, 2022, and I paid Mr ******* $******, at his request, as an initial payment. On March 2, 2022, I was not at home, and Mr ******* telephoned me, asking for payment of the balance, saying the job was completed. At his request, we met at a bank in ****** ******* where I withdrew $****** and paid Mr ******* the full balance. The following day, I inspected the paving and found that the area intended for a carport was not paved 36 feet wide, but only about 34 feet wide, not wide enough for the carport on order. Also, the back of the carport area was about a foot short of the clear markings I had provided. In addition to these shortages, the approach area to the mailboxes was only about 2/3 of what was required. Mr ******* returned to the site the next day, March 4, 2022, as he was still in the area, doing other paving jobs. He took full responsibility for the problems, and promised to return and correct everything within the next two weeks. He has never returned, and has blocked my phone calls and failed to respond to my text messages. The preferred resolution would be for Mr ******* to correct the shortcomings in a timely manner, giving preference to a customer who has fully paid, over later commitments. A two week period I would think sufficient. Failing that, I request a refund in the amount of $****, which is 15% of the total paid, and what it would cost to have it finished.Business response

The area that was did out by the mailbox was done the way the home owner and my son agreed on. For the price that was talked about. The area where the carport was did was installed based off the lines the home owner put down. It was fully marked by him. That area was graded and based and installed. As far as the payments the owner got several prices and wanted to save all he could with cash payments. Thats the reasons for the bank meet ups between him and my son.
My company prefers checks made to the business. This was all to accommodate the home owner.
I cant just add new asphalt at my cost.
My son agreed to add around a ton of asphalt to the already big entrance for the home owner when im in the area again at no cost. This would go in front of the mail box.
Reasons for that was because we paved a few other drives in the area that seen the nice work we did for him.
The complaint from the owner was did after we had done orderd the asphalt for those jobs. We could not take sombody elses order and just put in front of his box.
I would like to resolve this with the home owner in a timely matter. But the cost to do some of the extra work will have to be at his expense. Also would like to add the salesman on this job was ***** ******* 2 for this job.
