On July 21, 2022, my niece went to cheerleading practice from 8am to 10 am. She returned home at approximately 10:20 am with an intact windshield in her car. Shortly thereafter, the lawncare service who maintains the entire subdivision, RPM Four Seasons Lawn Care, LLC, came to cut the yards in the neighborhood. When my niece returned to her car in the driveway where she parked after returning from practice, a few hours later, after the lawncare service had completed their work, the windshield of her car had an approximately 1 foot crack across the top. On July 24th, she contacted ***************************** to report the crack in the windshield. The person that she spoke to, who she understood to be the owner of the business, asked her if she "had video recording of the windshield being busted by the guys cutting the grass", which of course she did not. She was then told that if she could not prove that the crack was due to something from the lawnmower that there was nothing that they could do.This crack was not present when she parked the car. Then, the yard was mowed. When she went to her car, there was a crack.Business response

*********************************, owner of RPM Four Seasons Lawn Care called BBB to say without 100% proof his company cracked the windshield he is not willing to pay for repairs. **************** said he cuts this HOA neighborhood regularly. He starts in the middle of the neighborhood and works his way to the outer homes. The consumers said they noticed this at 8 am, he didn't get to this home until about 1 pm. Besides this, his mower has a bad to catch clippings.

I am rejecting this response because: the response from RPM Four Seasons blatantly misrepresents the facts described in the initial complaint. The initial complaint states that my niece "was at cheerleading practice from 8am until10am and arrived back home around 10:20 am with an intact windshield." Her car remained in the driveway for several hours after returning from practice at 10:20am. When she returned to her car that was unmoved in the driveway (since 10:20am), there was an approximately 1 foot crack in the windshield.
I have personally witnessed, on several different occasions, young men who mow this yard using a stand-on style mower with no bag that collects clippings.It is unreasonable to require video footage of an incident that there is not other sensible explanation for.
